COMMUNITY REHABILITATION FUND
(SPECIAL FUND) ORDER


MADE UNDER SECTION 20 OF THE PUBLIC FINANCE ACT

1 Citation and Commencement


This Order may be cited as the Community Rehabilitation Fund (Special Fund) Order 1995 and shall come into effect on the date of publication.


2 Establishment of Fund


There is hereby established a special fund to be known as the Community Rehabilitation Fund.


3 Revenues of the Fund


There shall be paid into the Community Rehabilitation Fund —


(a) moneys received from any other government or from any other person and intended expressly or by implication to be placed in the Community Rehabilitation Fund;


(b) moneys received by way of interest or dividend on any investment or loan of any moneys belonging to the Community Rehabilitation Fund;


(c) moneys appropriated for the Community Rehabilitation Fund by Parliament.


4 Use of Fund


The Community Rehabilitation Fund may, subject to paragraph 5, be used for all or any of the following purposes —


(a) for the restoration, replacement or similar rehabilitation of any community asset damaged or destroyed by a natural physical disaster;


(b) for the restoration, replacement or similar rehabilitation of any private dwelling-house damaged or destroyed by a natural physical disaster;


(c) for the increase of the Fund through investment.


5 Control of Use of Funds


The moneys in the Community Rehabilitation Fund shall not be used for any of the purposes set out in paragraph 4 except under the provisions and in accordance with the Regulations made by the Minister under section 20 (3)(c) of the Public Finance Act[1]

1 Regulations were made by LN 13/1995 that provided as follows –


“The Minister may, with the concurrence of the Cabinet, authorise payments from the Fund to
further the purposes of the Fund as set out in the Order only if the loss or damage sustained or
caused to a community asset or a private dwelling-house is of the nature and kind contemplated by

the Order.”
