REGULATIONS[1]


Commencement [11 November 1980]


1 Short title


These Regulations may be cited as the Electoral Provisions (Parliament) Regulations.


2 Interpretation


(1) In these Regulations: —


"the Act" means the Electoral Provisions (Parliament) Act;


"the registration period" means the period from the publication of the notice under regulation 8 to the expiry of the period of 21 days from the date of such notice;


"the election registration period" means the period from the expiry of the registration period to expiry of the period set out in the notice published under section 8 of the Act for the receipt of applications for registration;


"Registration Officer" means an officer appointed under regulation 5(1);


"Revising Officer" means the officer appointed under regulation 6;


"Niulakita Registration Officer" means the officer appointed under regulation 5(2);


"Applicant" means any person who delivers an application to be registered in an electoral district to any Registration Officer;


"list of applicants" means the list of applicants names prepared by the Registration Officer in accordance with regulation 11;


"notice of objection" means a notice of objection to the list of applicants delivered in accordance with regulation 14(1) or (2);


"list of objections" means the list of objections prepared by the Registration Officer in accordance with regulation 15.


(2) In these Regulations references to Regulations refer to Regulations in these Regulations unless otherwise stated.


(3) Any notice which is required to be published under these Regulations shall be published by Public Exhibition outside the appropriate Council Offices or in some other prominent position where the officer publishing the same is satisfied the notice will receive general attention.


3 Time and Means of Service


(1) Where any act or thing is required to be done under provisions of the Act or these Regulations within a specified time after the date of publication of any document then that time shall be computed from the date on which the document was first published.


(2) Any notice or other document which is required to be sent by a Registration Officer, a Revising Officer, the Minister, the Niulakita Registration Officer, or by a Returning Officer in accordance with the provisions of these Regulations may be served or delivered by telegram if it appears to the sender that any other means of delivery is likely to be unduly delayed and the form of such notice or other document may be amended so as to render it susceptible to delivery by telegram.


(3) Where any form set out in the Schedule is to be used under these Regulations then that form shall be amended by the additions or deletions appropriate to the Regulations in question.


4 Supervisions of elections


The Secretary to Government —


(a) shall exercise general direction and supervision over the administration of elections; and


(b) shall issue to election officers such instruction as he may deem necessary from time to time; and


(c) may correct any apparent errors, or omissions or duplications in any electoral register; and


(d) may on the application of any elector amend any Register to record an amended name or address; and


(e) may strike off a Register the name of any person whom he has good reason to believe dead or otherwise disqualified from voting; and


(f) may add the name of any person to a Register where he is satisfied that that person is qualified to be included in that Register and that their omission is inequitable and due only to some technical or clerical error in the application procedure whether by the person or not;


(g) may reduce or extend any time limit provided for by these Regulations and provided he is satisfied that no person will lose his opportunity of being registered for or voting in an election and that if it is in the general public interest to do so by notice adapt, amend or otherwise alter the requirements in connection with registration provided for in these Regulations


5 Registration of Voters


(1) The Minister shall by notice appoint a Registration Officer for each electoral district who shall be responsible for the preparation, maintenance and a revision of the Register in that district.


(2) The Minister shall by notice appoint an officer in Niulakita to be called the Niulakita Registration Officer.


6 Revising Officer


The Minister shall by notice appoint a Revising Officer for each electoral district.


7 Remuneration and expenses


(1) Registration Officers and Revising Officers and the Niulakita Registration Officer shall receive such remuneration as the Minister shall direct provided that should any officer be a public servant then he shall receive no additional payment by reason only of his appointment as such officer.


(2) All expenses properly incurred in the preparation or revising of the Register shall be a charge on the public revenue.


8 Notice by Minister to Registration Officer


(1) The Minister shall when he deems it necessary and in any event not less frequently than once in every 4 years give notice to each Registration Officer and to the Niulakita Registration Officer that the registers are to be generally revised and such notice shall be in the form set out in the Schedule to these Regulations (Form A).


(2) The Minister shall when he deems it necessary and in any event once in each year in which a notice of a revision of the register is not given, give notice to each Registration Officer and to the Niulakita Registration Officer that the registers are to be open for additional applications for registration and such notice shall be in the form set out in the Schedule to these Regulations (Form B).


8A Revision in respect of one or more electoral Districts


(1) The Minister may, in circumstances which he considers appropriate, direct that a general revision or additional registration take place as provided for in Regulation 8 in respect of any specified electoral districts.


(2) Regulation 9 shall apply with any necessary changes to give effect to any Ministerial direction under this Regulation.


9 Public Notice


(1) On receipt of any notice under Regulation 8(1) all Registration Officers shall immediately publish a notice dated in accordance with and published not later than the date given in the notice under Regulation 8 as the date from which there shall be a registration period and the notice shall be in the form set out in the Schedule to these Regulations (Form C).


(2) On receipt of any notice under Regulation 8(2) all Registration Officers and the Niulakita Registration Officer shall immediately publish a notice dated in accordance with and published not later than the date given in the notice under Regulation 8(2) as the date from which there shall be a registration period and the notice shall be in the form set out in the Schedule to these Regulations (Form D).


10 Application for Registration


All applications for registration shall be in the form set out in the Second Schedule to the Act and shall be delivered to a Registration Officer or the Niulakita Registration Officer during the registration period.


11 List of applicants


(1) When an application for registration is received by a Registration Officer within the registration period which applies for registration in the Register of the electoral district of that Registration Officer then the name of the applicant shall be included (together with the name of any applicant to be included in accordance with Regulation 12) in a list of applicants if and only if —


(a) the application is in the form prescribed by Act; and


(b) the Registration Officer is satisfied that the applicant is qualified to be registered in the Register of the electoral district of that Registration Officer. Provided always that in the event that a Registration Officer is satisfied that an applicant is entitled to be included in the Register for his electoral district for one of the reasons provided for in Section 5 of the Act which was not indicated by the applicant in the application form then he may include that applicant's name in the list of electors.


(2) When an application is received by a Registration Officer within the registration period which applies for registration in the Register of an electoral district other than the electoral district of that Registration Officer then that Registration Officer shall, immediately on expiry of the registration period —


(a) inform the Registration Officer of the electoral district to which the application applies by telegram and so that the telegram arrives within 5 days of the expiry of the registration period: —


(aa) that the application has been received within the registration period; and


(bb) of the name and address of the applicant; and


(cc) of the grounds upon which the applicant claim that the electoral district to which the telegram is sent is the applicant's home island; and


(dd) where the application does not appear to be a valid application of the matters which in the view of the Registration Officer sending the telegram invalidate the application; and


(b) send the original after first making a copy of the same by the first available post to the Registration Officer of the electoral district where the applicant wishes to be registered.


12 Addition to list of applicants


When a telegram sent in accordance with Regulation 11(2) or 23(1) is received by a Registration Officer within 5 days after the expiry of the Registration period then that Registration Officer shall if he is satisfied that any applicant named in the telegram is qualified to be registered in the Register of that Registration Officer's electoral district, include the name of that applicant in the list of applicants prepared under the provisions of Regulation 11(1).


13 Publication of list


A Registration Officer shall as soon as possible after the preparation of a list of applicants and in any event within 14 days of the expiry of the Registration period publish the list of applicants in the form set out in the schedule to these Regulations (Form E) and keep it displayed for at least 3 days. 14 Notice of Objection[3]


(1) Any applicant who is dissatisfied with the omission of his name from any list of applicants published in accordance with Regulation 13 may within 5 days of the date the list of applicants is published give notice of objection in the form set out in the Schedule to these Regulations (Form F).


(2) Any person whose name appears in the list of applicants or whose name already appears in the Register for the electoral district in which the list is published and who is dissatisfied with the inclusion of any name in the list may within 5 days of the date the list of applicants is published give notice of objection in the form set out in the Schedule to these Regulations (Form F).


15 List of Objections


Each Registration Officer shall compile a list of all objections received in accordance with Regulation 14(2) and shall within 7 days of the expiry of the period allowed in Regulation 14 for the delivery of notices of objection:


(a) Deliver a copy of such list together with the original notice or notices of objection after having made a copy of the same to the Revising Officer of the electoral district in question; and


(b) Publish a copy of the list by notice.


16 Date of enquiry


On receipt of any list in accordance with Regulation 15 the Revising Officer shall: —


(a) fix a date within 10 days of receipt of the list for the holding of a public enquiry into the objections; and


(b) give in such a manner as he considers appropriate not less than 1 days notice of the time and the place where the enquiry is to be held to the objector or objectors concerned and to any applicant or applicants concerned;[4] and


(c) publish notice of the public enquiry.


17 Hearing of Enquiry


The Revising Officer on the hearing of the public enquiry may: —


(a) receive evidence on oath and for this purpose is authorised to administer oaths; and


(b) consider any representations in writing or by telegram supplied to him by any objector or applicant involved provided that such representations are read out aloud at the enquiry; and


(c) conduct the hearing in such manner as he deems fit.


18 Notice of Decision


(1) The Revising Officer shall at the conclusion of the enquiry either dismiss or sustain the objection and shall: —


(a) state his decision orally; and


(b) deliver a signed notice in the form set out in the Schedule to these Regulations (Form G) of his decision to the Registration Officer within 3 days of the conclusion of the enquiry; and


(c) publish by notice a copy of the signed notice sent to the Registration Officer; and


(d) deliver or cause to be delivered a copy of the notice sent to the Registration Officer to any objector or applicant concerned.


(2) The signed notice under paragraphs (1)(b), (1)(c) and (1)(d) of this Regulation shall include a direction to the Registration Officer to add or delete to or from the list of applicants the name of the person to whom the objection relates or a direction that in respect of that application the list of applicants is to remain unchanged.


19 Signing of list


(1) In the event of there being no notices of objection delivered to the Registration Officer within the period allowed for the delivery of notices of objection provided for by Regulation 14 then immediately on the expiry of such period the Registration Officer shall re-date and resign the list of applicants under the words "I hereby certify that this is the final list of names to be included in the Register."


(2) In the event of there being an objection or objections to the list then immediately on the receipt of the notice or notices under Regulation 10 and in any event within three days of the receipt of such notices the Registration Officer shall make such deletions or additions as may be directed in the notice or notices and shall re-date and re-sign the list as correct under the words "I hereby certify that this is the final list of names to be included in the Register"


20 Register


(1) The Registration Officer shall immediately upon signing the list under Regulation 19 and in any event within 7 days: —


(a) in the event of there not being a Register in existence or the Minister having ordered a Revision of the Register under Regulation 24 cause a Register to be prepared in the form set out in the Schedule to these Regulations (Form H) listing all the names included in the signed list provided for by Regulation 19 in a numbered list in alphabetical order each name being allotted a number in sequence;


(b) in the event of paragraph (a) of this paragraph not being applicable add in alphabetical order all the names included in the signed list provided for by Regulation 19 numbering those names so that the numbers continue in sequence from the numbers already recorded in the Register;


(c) date and sign the Register after the last name had been included under the provisions of paragraphs (1)(a) or (b) of this Regulation.


(2) In the case of the Registration Officer for Niutao only the Registration Officer for Niutao shall not complete the Register until such time as he has received the names and addresses of all persons entitled to be included in the Register from the Niulakita Registration Officer under the provisions of Regulation 23(b). On receipt of such names he shall provided that such names are not names to be included under the provisions of paragraph (1) of this Regulation.


(3) Immediately on signing and dating the Register of electors the Registration Officer shall send a signed copy of the Register for his district to the Secretary to Government.


21 Late applications


(1) Subject to the provisions of Regulation 21(2) any application for registration which is delivered to a Registration Officer other than during a registration period is invalid.


(2) Any person who was unable to deliver an application for registration during a registration period shall be entitled to deliver an application for registration to the Registration Officer if and only if: —


(a) the application is in the form set out in the second Schedule to the Act; and


(b) the application is delivered to the Registration Officer before the expiry of the election registration period; and


(c) the applicant was unable to deliver the application within the registration period because of ill health or because he was absent from Tuvalu or has reached the age of 18 years since the expiry of the registration period or has reached the age of 18 years since the expiry of the election registration period


(d) the application is delivered to a Registration Officer;


(e) the application is accompanied by a letter stating the reason why the applicant was unable to apply for registration during the registration period.


22 Election Registration Period


When an application is received in accordance with Regulation 21 by a Registration Officer within an election registration period that application shall be dealt with in accordance with Regulations 11 to 23 inclusive in all respects as if that application had been received by him during a registration period save only that: —


(a) the time allowed for the Registration Officer receiving the application to inform by telegram the Registration Officer of the electoral district to which it applies shall be 2 days instead of the 5 days allowed in Regulations 11(2), 12 and 23(1);


(b) the time allowed for the preparation of the list of applicants after the expiry of the election registration period shall be 2 days instead of the seven days allowed in Regulation 11; and


(c) the minimum time during which the list of applicants must be displayed shall be 1 day instead of the 3 days allowed in Regulation 13;[5] and


(d) the time allowed for the delivery of a notice of objection under Regulation 19 shall be 1 day from the publication of the list of applicants under Regulation 13 instead of the 5 days allowed in Regulation 14;[6] and


(e) the time allowed for the Registration Officer to prepare a list of objections and deliver it to the Revising Officer shall be one day from the expiry of the period allowed in Regulation 14 for delivery of notices of objection (as amended by Paragraph (c) above of this Regulation) instead of the 7 days allowed in Regulation H;


(f) the time allowed under Regulation 16 for the Revising Officer to hold an enquiry shall be 1 day and the time for the notice to be given to the objectors or an applicant shall be 1 day instead of 10 days and 1 day respectively;[7] and


(g) the time allowed for the Revising Officer to give notice of his decision shall be one day instead of 3 days allowed in Regulation 18; and


(h) the time allowed for the Registration Officer to prepare an amended list shall be one day instead of three days as allowed in Regulation 20; and


(i) the time allowed for the completion and signature of the Register shall be 2 days instead of the 7 days allowed in Regulation 19;


(j) the words "election registration period" shall be read as replacing the words "registration period" wherever these words appear in those Regulations and where the context admits;


(k) the Registration Officer shall only include the name of the applicant in the list of applicants if in addition to the matter set out in Regulation 11(1)(b) he is satisfied that the applicant was unable due to sickness or absence from Tuvalu to deliver an application during the last election registration period.


23 Special Provision for Niulakita


(1) When the Niulakita Registration Officer receives an application within the Registration Period which relates to registration in an electoral district other than Niutao then he shall immediately on the expiry of the registration period: —


(a) inform the Registration Officer of the electoral district to which the application applies by telegram and so that the telegram arrives within 5 days of the expiry of the registration period: —


(aa) that the application has been received within the registration period; and


(bb) of the name and address of the applicant; and


(cc) of the grounds upon which the applicant claims that the district to which the telegram is sent is the applicant's home island; and


(dd) where the application does not appear to be a valid application of the matters which in the view of the Assistant Registration Officer for Niulakita invalidate the application; and


(b) send the original application form by the first available post to the Registration Officer of the electoral district where the applicant wishes to be registered.


(2) When the Niulakita Registration Officer receives applications for registration in the Niutao electoral register he shall prepare and publicly read out a list of such applicants in alphabetical order of those applicants who have in his opinion submitted a valid application to be registered in the electoral district of Niutao and who are in his opinion entitled to be registered in the Niutao electoral register.


(3) At the conclusion of the reading out of the list in accordance with paragraph 23(2) the Niulakita Registration Officer shall invite oral objections: —


(a) from any person whose name has been omitted from the list and who claims he is entitled to be registered in the Niutao electoral register; or


(b) from any person whose name has been included in the list or in the event that the registration period does not relate to a revision of the register whose name is already registered in the electoral register for Niutao and who objects to the inclusion of any name in the list on the grounds that the person whose name has been read out is not entitled to be registered in the electoral register for Niutao.


(4) When the Niulakita Registration Officer is satisfied that there are no more objections he shall investigate every objection and in this connection shall consider any evidence put before him or he may consider appropriate and shall determine whether such objection is valid and in the event that he determines that such objection is valid shall make the appropriate amendment whether by addition or deletion of names to or from the list prepared under paragraph (2) of this Regulation and shall then sign the list as correct.


(5) Immediately on signing the list in accordance with paragraph (4) of this Regulation the Niulakita Registration Officer shall deliver the list to the Registration Officer for Niutao.


PART III - ELECTIONS


24 Notice of election


(1) The Notice of election under the provisions of Section 7(1) of the Act shall be in the form set out in the Schedule to these Regulations (Form I) and shall be delivered forthwith to the Returning Officer for each electoral district and to the Assistant Returning Officer for Niulakita so that the notice shall be received by the Returning Officer published in each electoral district and by the Assistant Returning Officer for Niulakita in accordance with the provisions of Section 8 of the Act not later than 26 days before the date fixed for the poll.


(2) In the event of there being any difficulty in delivering the notice in accordance with paragraph (1) of this Regulation then the Minister may if he deems necessary cause the said notice to be dictated by radio to the appropriate Returning Officer for Niulakita.


25 Publication of Notice


(1) On receipt of a notice of election in accordance with Regulation 24(1) or upon receiving a copy of a dictated notice in accordance with Regulation 24(2) the Returning Officer and the Assistant Returning Officer for Niulakita shall: —


(a) cause a copy of the notice of election to be published; and


(b) in the event that the notice of election gives notice of a General Election publish notice in the form set out in the Schedule to these Regulations (Form J); or


(c) in the event that the notice of election gives notice of a Bye Election publish notice in the form set out in the Schedule to these Regulations (Form K).


(2) The notices published under 25(1) shall be published not later than 21 days prior to the date fixed for the poll in the notice of election.


26 Special Provision for Niulakita and Niutao


In the event of there being an election in the electoral district of Niutao then the Assistant Registration Officer for Niulakita and the Returning Officer for Niutao shall within 24 hours of the expiry of the period for delivery of nominations inform each other of the names and addresses and occupations of any candidates in respect of which they have received a nomination which the officer concerned holds to be valid and such information may be given by any means including radio that the officer giving the information deems appropriate.


27 List of candidates


The list of candidates to be published in accordance with the provisions of Section 11 of the Act shall be in the form set out in the Schedule to these Regulations (Form L).


28 Notice by telegraph


The notice under Section 15(1)(a) of the Act may be given by telegraph if the Returning Officer deems it necessary to ensure that such notice is received within the time provided.


29 Form of Notice


The notice under 15(1)(b) of the Act shall be in the form set out in the Schedule to these Regulations (Form M).


30 Code


(1) The Returning Officer for any electoral district other than the district of that Returning Officer shall carry out the notification of the Returning Officer of the Electoral District in respect of which any such votes were cast in the following manner: —


(a) by completing a telegram in the form set out in the Schedule to these Regulations (Form N); and


(b) by translating the body of that telegram into the code provided in accordance with paragraph (2) of these Regulations; and


(c) by causing the coded telegram to be transmitted to the Returning Officer of the electoral district in respect of which the votes recorded in the telegram were cast.


(2) The Secretary to Government shall inform each Registration Officer and the Assistant Registration Officer for Niulakita of the cipher of a code which shall be used by them to translate the telegram into code and to decipher it. He shall take such steps as he shall deem necessary including changing the code from time to time to ensure that only the Returning Officers and Assistant Returning Officer are aware of the code.


31 Niutao and Niulakita Schedule


(1) The Assistant Returning Officer for Niulakita shall, in the event that there is a contested election in the electoral district of Niutao, publish a notice in accordance with the provisions of Section 15(1)(b) of the Act.


(2) The Notice published under paragraph (1) of this Regulation shall contain as the Statement of electors entitled to cast their votes in Niulakita: —


(a) All the names recorded in the electoral register of the electoral district of Niutao; and


(b) The Names of any persons who have made application to cast their votes in Niulakita in respect of a contested election in electoral districts other than Niutao.


(3) Any application made under the provision of Section 15(2) of the Act to cast a vote in Niulakita in respect of an election in an electoral district other than Niutao may be made to the Assistant Returning Officer for Niulakita and in the event that such application is made the Assistant Returning Officer for Niulakita shall deal with such application in a like manner as if he were a Returning Officer save that he shall inform the Returning Officer of Niutao of the result of such application as soon as possible.


32 Forms in the Schedule


For convenience the form set out in the Schedules of the Act may be cited as follows:


(a) Second Schedule (Application for Registration as elector - (Form P)


(b) Third Schedule (Nomination Paper) - (Form Q)


(c) Fourth Schedule (Application to cast vote in electoral district where not registered) - (Form R)

(REGULATION 9(1))


To all citizens of Tuvalu


Take Notice that there will be a general revision of the electoral register. This means that unless you apply to be registered in the new register and your application is accepted you will not be entitled to vote in any parliamentary election. The registration period will commence on the ..............day of ................................................20 .......... and continue for 21 days.


If you wish to be registered in this or any other registration district you must apply to the Registration Officer on the prescribed application form.


Warning


Only these persons whose names appear on the electoral register of an electoral district can vote in a Parliamentary election in that district.

Note


(1) All citizens of Tuvalu who are over 18 years of age when they submit an application for Registration are subject to the provision of the Constitution entitled to be Registered as electors.


(2) The application for registration must be on the prescribed form which is obtainable from the Registration Officer.


(3) Completed application forms may be delivered to the Registration Officer on this Island although the application is for registration in the electoral register of a different electoral district. Any such applications will be forwarded to the appropriate Registration Officer.
