tice issued pursuant to subsection (1) of this section declaring any species of animal to be a partly protected species, specify the period or periods of time in the year in which such species is a protected animal and shall, if he thinks it desirable so to do, also specify in such notice a bag limit relating to that species. \par \par }{\fs24\insrsid5264752 (3) }{\fs24\insrsid10565573\charrsid5264752 The Resident Commissioner may, from time to time, by notice in the Gazette, revoke, vary or amend any notice issued pursuant to subsection (1) or }{\fs24\insrsid5264752 subsection (2) of this section.}{\fs24\insrsid10565573 \par }{\fs24\insrsid5264752\charrsid5264752 \par }{\fs24\insrsid10565573\charrsid4792349 {\fs24\insrsid5264752 \par }\pard \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid12389110 {\fs24\insrsid10565573\charrsid5264752 (ii) Destroy, damage or take, or attempt to destroy, damage}{\fs24\insrsid5264752 }{\fs24\insrsid10565573\charrsid5264752 or take the egg of any bird which is a protected animal; or}{\fs24\insrsid10565573 \par }\pard \ql {\fs24\insrsid10565573\charrsid5264752 (iii) Disturb or attempt to disturb the nest or nesting place of any bird which is a protected animal;}{\fs24\insrsid5264752 }{ \ql \li720\ri0\widctlpar\faauto\adjustright\rin0\lin720\itap0\pararsid12389110 {\fs24\insrsid10565573\charrsid5264752 (iv) Disturb or attempt to disturb the lair or roosting place of any protected animal. \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid12389110 {\fs24\insrsid5264752 \par (2) }{\fs24\insrsid10565573\charrsid5264752 Any permission referred to in subsection (1) of this section may be given either uncondit}{\fs24\insrsid5264752 i}{\fs24\insrsid10565573\charrsid5264752 onally or subject to any conditions which, in his absolute discretion, the Resident Commissioner may in }{\fs24\insrsid4792349 w}{\fs24\insrsid10565573\charrsid5264752 riting deem fit to impose, and any such permission may, at any time, be revoked by the Resident conditions impose d, pursuant to subsection (2) of this section, by the Resident Commissioner, commits an offence against this Ordinance and, on conviction, shall be liable to a fine not possession or control, of such person used or capable}{\fs24\insrsid13376043 }{ \fs24\insrsid10565573\charrsid5264752 of being used for killing or trappi}{\fs24\insrsid13376043 ng}{\fs24\insrsid12389110 any animal.}{\fs24\insrsid10565573 \par }\pard \ql \li0\ri0\widctlpar\faauto\adjustright\rin0\lin0\itap0\pararsid12389110 {\fs24\insrsid13376043\charrsid5264752 \par }{\fs24\insrsid13376043 (2) }{\fs24\insrsid10565573\charrsid5264752 A wildlife warden shall not, without the prior written permission of a Jud}{\fs24\insrsid13376043 ge of the H}{\fs24\insrsid10565573\charrsid5264752 igh Court or of a Ma}{ \fs24\insrsid13376043 gistrate}{\fs24\insrsid214272 ,}{\fs24\insrsid13376043 exerci}{\fs24\insrsid10565573\charrsid5264752 se in any private dwellinghouse or in any private garden adjacent to any private dwellinghouse, any one or more of the powers conferred upon a wildlife warden by para}{\fs24\insrsid13376043 g}{\fs24\insrsid10565573\charrsid5264752 raphs (b) and (c) of subsection (1) of this section. \par \par }{\fs24\insrsid13376043 (3) }{\fs24\insrsid10565573\charrsid5264752 Any person who, when lawfully required so to do, fails immediately to give to a wildlife warden all the particulars referred to in para}{\fs24\insrsid13376043 g}{ \fs24\insrsid10565573\charrsid5264752 raph (a) of subsection (1) of this section, or who otherwise resists or obstructs a wildlife warden in the lawful exercise of any one}{\fs24\insrsid214272 or more of the wildlife warden\rquote }{ \fs24\insrsid10565573\charrsid5264752 s powers under that subsection co}{\fs24\insrsid13376043 m}{\fs24\insrsid10565573\charrsid5264752 mits an offence against this Ordinanc}{\fs24\insrsid13376043 e}{\fs24\insrsid10565573\charrsid5264752 and, on conviction, shall be liable to a fine not exceeding fifty dollars or to imprisonment for a term not exceeding two weeks. \par }{\fs24\insrsid13376043 \par }{\fs24\insrsid13376043\charrsid11292070 6. }{\fs24\ul\insrsid13376043\charrsid11292070 Forfeiture of property}{\fs24\insrsid11292070\charrsid11292070 -}{\fs24\insrsid10565573\charrsid11292070 on}{\fs24\insrsid5264752 }{\fs24\insrsid10565573\charrsid5264752 convicted of an offence mentioned in s ubsection (3) or subsection (4) of section 4 of this Ordinance, the High Court may order that any protected animal trapped by such person, or the carcass of any protected animal killed by such person, or any egg taken by such person in the course of commi tting the offence, or any firearm, trap, snare or other }{\fs24\insrsid214272 device (other then a vehicle) owned by such a}{\fs24\insrsid8679339 person and used by such person for the purpose }{\fs24\insrsid10565573\charrsid5264752 of committing the offence, shall be absolutely forfeited to}{\fs24\insrsid214272 the Crown; and,}{\fs24\insrsid10565573\charrsid5264752 upon any such forfeiture, the an imal carcass, egg or other thing so forfeited shall become the absolute property of the Crown and shall be disposed of in such manner as the Resident Commissioner may, in his absolute discretion, specify. \par \par }{\fs24\insrsid10565573\charrsid11292070 7.}{\fs24\insrsid5264752\charrsid11292070 }{\fs24\ul\insrsid10565573\charrsid11292070 Prohibition orders}{\fs24\insrsid10565573\charrsid11292070 }{\fs24\insrsid12389110\charrsid11292070 -}{ \fs24\insrsid10565573\charrsid11292070 \par }{\fs24\insrsid8679339\charrsid5264752 \par }{\fs24\insrsid10565573\charrsid5264752 (1) Where any person is convicted of an offence contr}{\fs24\insrsid8679339 ary to this Ordinance, the Hig}{\fs24\insrsid10565573\charrsid5264752 h Court }{\fs24\insrsid8679339 may make an order prohibiting s}{ \fs24\insrsid10565573\charrsid5264752 uch person from killing, attempting to kill, trapping and attempting to trap any protected animal for any period not exceeding two years from and including the date of the conviction. \par \par }{\fs24\insrsid10565573 (2) The High Court may, a}{\fs24\insrsid10565573\charrsid5264752 t any time, cancel any such order or reduce the period mentioned in the order.}{\fs24\insrsid10565573 \par }{\fs24\insrsid8679339\charrsid5264752 \par }{\fs24\insrsid8679339 (3) }{\fs24\insrsid10565573\charrsid5264752 Any person, in respect of whom any such order has been Number 72 of the twenty-ninth day of June 1916, shall cease to be part of the law of Niue.}{\fs24\insrsid10565573 \par }{\fs24\insrsid8679339\charrsid5264752 \par }{\fs24\insrsid10565573\charrsid5264752 (2) Without limiting the provisions of the Acts Interpretation Act 1924 it }{\fs24\insrsid10565573 i}{\fs24\insrsid10565573\charrsid5264752 s hereby declared
