Office of the New Zealand Representative}{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 -(1) The Office of the New Zealand Representative shall be accorded the same privileges and Immunities as are accorded to a diplomatic mission by the 1968 Act. \par \par }\pard \ql \fi-709\li709\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin709\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid5050687 (2)\tab }{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (a)The premises, furnishing, means of transport and other property of the Office of the New Zealand Representative; and \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (b) The archives and documents of the office of the New Zealand Representative; and \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (c) The official correspondence of the New Zealand Representative; and \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (d) Articles for the official use of the office of the New Zealand Representative, \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par shall be accorded the same privileges and Immunities as the case requires as are accorded to those of a diplomatic mission by the 1968 Act. \par \par (3) Without limiting the generality of section 4 and sub-sections (1) and (2) of this section- \par \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (a) The 1968 Act shall apply to every bag used for the official correspondence of the Government of New Zealand as if it were a diplomatic bag referred to in that Act; and \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (b) Every diplomatic courier of the Government of New Zealand shall be accorded the same personal inviolability, protection, and Immunities as accorded to the diplomatic under the 1968 Act. \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard\plain \s15\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 \fs24\lang2057\langfe5129\cgrid\langnp2057\langfenp5129 {\b\insrsid868735 5. Diplomatic Staff}{\insrsid868735 - (1) Every member of the diplomatic staff of the office of the New Zealand Representative shall be accorded the same privileges and Immunities as are accorded to a diplomatic agent by the 1968 Act. \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 \f5\fs20\lang1033\langfe5129\cgrid\langnp1033\langfenp5129 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard\plain \s15\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 \fs24\lang2057\langfe5129\cgrid\langnp2057\langfenp5129 {\insrsid868735 (2) The pr ivate residence of every member of the diplomatic staff of the Office of the New Zealand Representative shall be accorded the same privileges and Immunities as are accorded to the diplomatic agent under the 1968 Act. \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 \f5\fs20\lang1033\langfe5129\cgrid\langnp1033\langfenp5129 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par (3) The papers, correspondence, proper ty and articles for the personal use of each member of the diplomatic staff of the Office of the New Zealand Representative shall be accorded the same privileges and immunities as the case requires as are accorded by those of a diplomatic agent under the 1968 Act. \par \par }{\b\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 6. Members of families of diplomatic staff}{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 - Every person, being a members of the family and forming part of the household of the member of the diplomatic staff of the Office of the New Zealand Representative and not in any cases being ordinarily resident in Niue shall be accorded the same privileges and Immunities as are accorded to the members of the diplomatic staff of that office by sub-sections (1) to (3) of section 5 of this Act. \par \par }{\b\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 7. Other staff members and their families-}{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (1) Every person who is- \par \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (a) A member of the administrative or technical staff of the Office of the new Zealand Representative; or \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (b) A member of the family forming part of the household of a member of the administrative or technical staff of the Office of the New Zealand representative; \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (c) A member of the service staff of the Office of the New Zealand Representative- \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par not in any case being ordinarily resident in Niue shall be accorded the same privileges and immunities as the case requires as would be accorded to that person under the 1968 Act if that office were a diplomatic mission. \par \par (2) Every person, being a member of the administrative, technical, or service staff of the Office of the New Zealand Representative who is ordinarily resident in Niue, shall be accorded im munity from jurisdiction and inviolability in respect of office acts performed in the exercise of his functions. \par \par }{\b\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 8. Premier may determine fiscal privileges}{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 -}{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid5050687 }{ \f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 Without prejudice to the provisions of section 3 to 7 inclusive of this Act, the Premier with the c oncurrence of the Cabinet, may from time to time determine, either generally or in any case of class of case, the fiscal privileges which shall be accorded to the Office of New Zealand Representative or person connected to that Office notwithstanding that the determination may extend treatment more favourable than that required by the provisions of this Act, and may in like manner determine the terms and conditions on which these privileges may be enjoyed. \par \par }{\b\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 9. Proof of Status-}{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 If in any proceeding any quest ions arises as to whether or not any person is or was at any time or in respect of any period accorded any privilege, or immunity, under or by virtue of this Act, a certificate issue by the Secretary to the Government stating any fact relevant to that que stion shall be conclusive evidence of that fact. \par \par }{\b\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 10. Privileges and Immunities}{\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 - Subject to the provisions of this Act, privileges and immunities conferred by or by virtue of this Act shall be conferred in the same terms and conditions as to commencement and cessation, and as to waiver, as provided in the 1968 Act. \par \par }\pard\plain \s15\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 \fs24\lang2057\langfe5129\cgrid\langnp2057\langfenp5129 {\b\insrsid868735 11. Transitional provisions}{\insrsid868735 - (1) This section shall apply to every person on whom any privilege or immunity is conferred by any of sections 3, 6 and 7(1) of this Act. \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 \f5\fs20\lang1033\langfe5129\cgrid\langnp1033\langfenp5129 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par (2) Notwithstanding that- \par \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (a) Any person to whom this section applies has entered Niue to take up his post before the commencement of this Act; or \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard \ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 (b) The appointment of any person to whom this section applies has been notified to the Secretary to the Government before the commencement of this Act- \par }\pard \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\f0\fs24\lang2057\langfe5129\langnp2057\insrsid868735 \par }\pard\plain \s15\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 \fs24\lang2057\langfe5129\cgrid\langnp2057\langfenp5129 {\insrsid868735 the privileges or immunities conferred on that person by this Act shall be deemed to have commenced on the date on which that person so entered Niue, or as the case requires, on the date which his appointment was so notified, and in eac h case to have had effect continuously until cessation or waiver (if any) under this Act. \par \par }{\b\insrsid868735 12. Consequential amendments-}{\insrsid868735 (1) Section 5 of the Immigration Ordinance 1967 is hereby amended by asserting paragraph (b) the following paragraph- \par \par }\pard \s15\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\insrsid868735 "(ba) Any person entitled to privileges and immunities under the New Zealand Representative Act 1981" \par }\pard \s15\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\insrsid868735 \par (2) Section 2 of the Air Travel Tax Act 1980 is hereby amended by inserting in sub-section (2) after paragraph (f) the following paragraph- \par \par }\pard \s15\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\insrsid868735 "(g) Any person entitled to privileges and immunities under the New Zealand Representative Act 1981." \par }\pard \s15\ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5050687 {\insrsid868735 \par (3) The Manufactured Goods Tax Ordinance 1964 is hereby amended by inserting the after section 10 the following section- \par \par }\pard \s15\ql \li720\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5050687 {\insrsid868735 "10A.
