receiver when ship or aircraft in distress \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where a ship or aircraft is wrecked, stranded or in distress at any place}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 on or over or near the coast of Niue, the receiver shall upon being informed of the }{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 circumstance, forthwith proceed there and, upon his arrival shall take the command}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of all persons present and shall assign such duties and give such directions to}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 each person as he thinks fit for the preservation of the ship or aircraft and the }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where a ship or aircraft is wrecked, stranded, or in distress as aforesaid,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 all persons may, for the purpose of rendering assistance to the ship or aircraft, or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of saving the lives of the shipwrecked persons, or of saving the cargo or equipments}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 of the ship or aircraft, unless there is some public road equally convenient, }{\f0\insrsid12549309\charrsid730742 (2) Any damage sustained by an owner or occupier in consequence of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 exercise of the rights given by this section shall be a charge on the ship or aircraft}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or cargo or articles in respect of or by which the damage is occasioned; and for a reasonable time until it}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 ca}{\f0\insrsid730742 n be removed to a safe place of }{\f0\insrsid12549309\charrsid730742 public deposit. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 7 Receiver to suppress plunder and disorder}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 Where a ship or aircraft is wrecked, stranded, or in distress as aforesaid,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 and any person plunders, creates disorder, or obstructs the preservation of the}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 ship or aircraft or of the shipwrecked persons or of the cargo or equipments of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 ship or aircraft, the receiver may cause that person to be apprehended. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 8 Receiver to make inquiry}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where any ship or aircraft is or has been in distress on or over or near}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the coasts of Niue, the receiver shall, as soon as conveniently may be, examine on}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 oath or affirmation any person belonging to the ship or aircraft, or any other person}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 who may be able to give an account of it or of its cargo or stores as to the {\f0\insrsid730742\charrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) The names of the owners and the master of the ship, or, as the case}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 may be, the names of the owners and the person in command of}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the aircraft; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (d) The ports from and to which the ship or aircraft was bound; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (e) In the case of a ship, the occasion of its distress; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (f) The services rendered; and \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (g) Such other matters or circumstances relating to the ship or aircraft,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or to the cargo or store of it as the receiver holding the examination}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 thinks necessary. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) The receiver holding the examination shall take the same down in}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 writing, and shall send it to the Cabinet who shall take such action to advise the}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 owners of the ship or aircraft or of the cargo and such other persons as he thinks}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 fit. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 9 Dealing with wreck}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where any person finds or takes possession of any wreck within Niue}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or takes possession of and brings within the limits of Niue and wreck found outside}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 those limits, he shall \endash \par }{\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) If he is the owner, give notice to the receiver, stating that he has}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 found or taken possession of the wreck, and describing the marks}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 by which the same may be recognised; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) If he is not the owner, as soon as possible deliver the same to the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 receiver. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Any person who fails without reasonable cause to comply with this}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 section commits an offence against this Act and shall in addition, if he is not the}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 owner, forfeit any claim to salvage, and shall be liable to pay to the owner of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 wreck if it is claimed, or, if it is unclaimed, to the person entitled to the same,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 double the value of it, to be recovered in the same way as a fine of a like amount}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 under this Act. \par }{\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 10 Articles washed ashore}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where a ship or aircraft is wrecked, stranded, or in distress at any place}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 on or over or near the coasts of Niue, any cargo or equipments or other articles}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 belonging to or separated from the ship or aircraft which may be washed on shore,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or otherwise lost or taken from the ship or aircraft, shall be delivered to the receiver. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Every person, whether the owner or not, who secrets or keeps}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 possession of any such cargo or equipments or article, or refuses to deliver the}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 same to the receiver or any person authorised by him to demand the same, commits}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 an offence against this Act. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) The receiver or any person authorised as aforesaid may take any such}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 cargo or equipment or article by force from the person so refusing to deliver the}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 same. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 11 Claim to wreck}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where the receiver takes possession of any wreck, he shall within 48}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 hours make the same known by public notice given in his name and such notice}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 shall include a description of the wreck and of any marks by which it is}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 distinguished. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) The owner of any wreck in the possession of the receiver, upon}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 establishing his claim to the same, to the satisfaction of the receiver within one}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 year from the time at which the wreck came into the possession of the receiver}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 shall, upon paying the salvage, fees, and expenses due, be entitled to have the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 wreck or the proceeds delivered to him. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) Where any ship or aircraft is wrecked, stranded or abandoned on or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 near the coasts of Niue and there is no owner or agent of the owner or other}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 person present in Niue authorised to protect the interests of the owners, the receiver}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 shall make known to the owners in New Zea land, if the ship or aircraft is registered}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 there, or to a trade or other representative in New Zealand of the Commonwealth}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 country, or, as the case may be a consular representative in New Zealand of a}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 foreign country, in which that ship or aircraft may have been registered or to which}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 that ship or aircraft may have belonged, the facts of the wreck, stranding or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 abandonment, and shall act under instructions received from the owners or trade}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or other representative or consular representative as the case may be, or from any}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 agent, duly appointed as far as related to the custody and disposal of that ship or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 aircraft. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (4) Where any wreck, whether or not belonging to or separated from any}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 ship or aircraft to which subsection (3) applies, is found within the limits of Niue}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or is brought within those limits, and it does not appear that the wreck belongs to}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 persons resident in Niue or in New Zealand, a trade or other representative in}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 New Zealand of the Commonwealth country, or as the case may be, a consular}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 representative of the foreign country, to which the owners of the wreck may belong}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 shall, be deemed in the absence of the owners and of any other agent of the owners,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 to be the agent of the owners, as far as relates to the custody and disposal of the}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 wreck. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 12 Wreck may be sold immediately in certain cases \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) The receiver may at any time sell any wreck in his custody, if in his}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 opinion \endash \par }{\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) It is under the value of $10; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) It is so much damaged or of so perishable a nature that it cannot}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 with advantage be kept; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (c) It is not of sufficient value to pay for warehousing. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\i\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) The proceeds of the sale shall, after defraying the expenses, be held by}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the receiver for the same purposes and subject to the same claims, rights and}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 liabilities as if the wreck had remained unsold. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 13 Wreck claimed by two or more persons, or unclaimed \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where a dispute arises between 2 or more persons as to the title to the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 wreck, the dispute may be determined in the same manner as if it were a dispute}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 as to salvage to be determined under this Act. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Upon delivery of wreck or the payment of the proceeds of sale of wreck}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 by the receiver, he shall be discharged from all liability in respect of it; but the}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 delivery of it shall not prejudice or affect any question which may be raised by}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 third parties concerning the right or title to the wreck. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) Where no owner establishes a claim to any wreck found within the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 limits of Niue, and in the possession of the receiver, within one year after it came}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 into his possession, it shall be the property of Her Majesty, and the receiver }{\f0\insrsid15295406\charrsid730742 shall sell}{\f0\insrsid12549309\charrsid730742 the same and shall pay the proceeds of sale (after deducting from it the expenses}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of sale and any other expenses incurred by him, and his fees, and paying thereout}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 to the salvors such amount of salvage as Cabinet may in each case, or by any}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 general rule, determine) into the Niue Government Account. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 14 Removal of wrecked ships and aircraft \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) If any ship or aircraft is sunk stranded or abandoned on or near the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 coasts of Niue, and there is no authority in any other Act or rule or regulation to}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 remove or destroy that ship or aircraft, Cabinet may, and shall, if in his opinion}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the ship or aircraft is, or is likely to become an obstruction to navigation (or danger}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 to property, life or limb) direct the receiver to cause that ship or aircraft to be}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 removed. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) On receiving such a direction, the receiver, by notice in writing given}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 to the owner or master of the ship or any agent of the owner or, as the case may be,} {\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 to the owner or person in command of the aircraft or to any agent of the owner,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 shall require the owner to remove that ship or aircraft, or any part of it, in a manner}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 satisfactory to, and within a time to be notified by, the receiver. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) If the owner fails to comply with the notice, or if neither the owner nor}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the master of the ship, or as the case may be, neither the owner nor the person in} {\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 command of the aircraft, nor in either case may agent of the owner can be found,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the receiver may \endash \par }{\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) Take possession of and remove or destroy the whole or any part of}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the ship or aircraft; and \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) Sell, in such manner as he thinks fit, the ship or aircraft, or any part}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of it, so removed, and also any property recovered from it in the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 exercise of his powers under this section; and, out of the proceeds}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of any such sale, without any reference to the articles from the same}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of which those proceeds arise, reimburse the Crown for the whole}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of the expenses of removal; and \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (c) If the proceeds of the sale are insufficient to pay the whole of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 expenses of removal, recover the balance from the owner of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 ship or aircraft or from the owner of any other ship or aircraft or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 from any other person if the sinking, stranding or abandonment}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 occurred through the fault or negligence of that other ship, aircraft}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or person. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (4) Subject to subsection (5), the receiver shall hold and dispose of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 surplus (if any) of the proceeds of any sale under this section in accordance with}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the provisions of this Act relating to wreck. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (5) This subsection shall apply to every article belonging to or forming}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 part of a ship or aircraft, as it applies to a ship or aircraft; and the proceeds of the }{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 sale under this section of any ship or aircraft or part of it or other property recovered}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 shall be regarded as a common fund. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (6) In this section \f0\insrsid12549309\charrsid730742 been sunk, stranded, or abandoned, includes not only the owners of the ship or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 aircraft at the time of its sinking, standing or abandonment, but also any }{ \f0\insrsid15295406\charrsid730742 subsequent purchaser}{\f0\insrsid12549309\charrsid730742 of the ship or aircraft or of any article belonging to it or forming part of}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 it as long as the ship or aircraft remains sunk, stranded or abandoned. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 15 Offences in respect of wreck \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Any person who takes into any port out of Niue any ship or aircraft,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 stranded, derelict, or otherwise in distress, found on or near the coasts of Niue, or}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 any part of the cargo or equipment of it, or anything belonging to it, or any wreck}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 found within those limits, and there sells the same, commits an offence against}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 this Act and shall be liable on conviction or indictment to imprisonment for a}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 term not exceeding 5 years or to a fine not exceeding 20 penalty units. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Every person, not being a receiver or a person lawfully acting as such}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or a person acting by the command of any such person as aforesaid, commits an}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 offence against this Act who boards or endeavours to board any ship or aircraft}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 which is wrecked, stranded, or otherwise in distress on or near the coasts of Niue}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 unless he acts with the leave of the master of the ship or, as the case may be, the}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 person in command of the aircraft, and every such master or person in command}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 may repel him by force. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) Every person commits an offence against this Act who \endash \par }{\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) Impedes or hinders, or endeavours in any way to impede or hinder,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the saving of any ship or aircraft stranded or in danger of being}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 stranded or otherwise in distress on or over or near the coasts of}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 Niue, or of any part of the cargo or equipment of any ship or aircraft}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or of any wreck; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) Secretes any wreck, or defaces or obliterates any marks on it; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (c) Wrongfully carries away or removes any part of a ship or aircraft}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 stranded or in danger of being stranded or otherwise in distress on}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or near the coasts of Niue, or any part of the cargo or equipments of}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 any such ship or aircraft, or any wreck,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 and every such person shall be liable for each offence to a fine not exceeding 1}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 penalty unit, and that penalty may be inflicted in addition to any other penalty to}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 which that person may be liable by law under this Act or otherwise. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 16 Receiver may seize concealed wreck}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where the receiver suspects or receives information that any wreck is}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 secreted or in the possession of some person who is not the owner of it, or that any}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 wreck is otherwise improperly dealt with, he may apply to any Judge of the Court}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 for a search war rant and such Judge shall have power to grant such a warrant,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 and the receiver, by virtue of it, may enter any house or other place, wherever}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 situate, and also any ship, and search for, seize, and detain any such wreck found}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 there. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) If any such seizure of wreck is made in consequence of information}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 given by any person to the receiver, on a warrant being issued under this }{ \f0\insrsid15295406\charrsid730742 section the}{\f0\insrsid12549309\charrsid730742 informant shall be entitled by way of salvage to such sum, not exceeding in}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 any case $10 as the Cabinet allows. \par }{\i\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 17 Salvage}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where services are rendered \endash \par }{\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) Wholly or in part within Niue waters in saving life from any ship}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or aircraft; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) Elsewhere in saving life from any Commonwealth ship or any}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 unregistered ship which is owned wholly by persons qualified to}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 own a registered New Zealand ship, or any aircraft which is}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 registered in or belongs to any Commonwealth country \endash }{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 there shall be payable to the salvor by the owner of the ship or aircraft or cargo or}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 equipment saved a reasonable amount of salvage, to be determined in case of}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 dispute in manner hereinafter mentioned. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Salvage in respect of the preservation of life, when payable by the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 owners of the ship or aircraft, shall be payable in priority to all other claims for}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 salvage. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) Where the ship or aircraft and its cargo and equipment are destroyed,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or their value is insufficient, after payment of the actual expenses incurred, to pay}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the amount of salvage payable in respect of the preservation of life, Cabinet may}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 award to the salvor, out of any money appropriated by the Assembly for the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 purpose, such sum as he thinks fit in whole or part satisfaction of any amount of}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 salvage so left unpaid. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (4) Where \endash }{\f0\insrsid12549309 \par }{\f0\insrsid730742\charrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) Any ship or aircraft is wrecked, stranded, or in distress on or over}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or near the coasts of Niue, and services are rendered by any person}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 in assisting that ship or aircraft, or in saving the cargo or equipments}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of it or any part of it, or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) Services are rendered by any person other than the receiver in saving}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 any wreck;}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 there shall be payable to the salvor by the owners of the ship or aircraft or cargo or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 wreck a reasonable amount of salvage, to be determined in case of dispute in}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 manner hereinafter mentioned. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 18 Determination of salvage disputes}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Disputes as to the amount of salvage, whether of life or property, arising}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 between the salvor and the owners of any ship or aircraft or cargo or equipments}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or wreck shall, if not settled by agreement, arbitration or otherwise, be determined}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 by the Court. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Disputes relating to salvage may be determined on the application either}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of the salvor or of the owner of the property saved, or of their respective agents. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) The Court may, for the purpose of determining any dispute relating to}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 salvage, call to its assistance as assessor any person conversant with maritime or}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 aeronautical affairs; and there shall be paid, as part of the cost of the proceedings,}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 to every such assessor in respect of his services such sum as Cabinet directs. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (4) Any party aggrieved by the decision of the Court may, if the sum in}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 dispute exceeds $400, appeal to the Court of Appeal. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 19 Enforcing payment of salvage}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Where salvage is due to any person under this Act the receiver shall \endash \par }{\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) If the salvage is due in respect of services rendered in assisting any}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 ship or aircraft, or in saving life from it, or in saving the cargo and}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 equipments of it, detain the ship or aircraft and cargo or equipments;}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 and \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\i\f0\insrsid730742\charrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) If the salvage is due in respect of the saving of any wreck, and the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 wreck is not sold as unclaimed under this Act, detain the wreck. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Subject as hereinafter mentioned, the receiver shall detain the ship or}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 aircraft and the cargo and equipments, or the wreck (hereinafter referred to as}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 detained property), until payment is made for salvage, or process is issued for its}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 arrest or detention by a competent court. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) The receiver may release any detained property if security is given to}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 his satisfaction or, if the claim for salvage exceeds $400 and any question is raised} {\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 as to the sufficiency of the security, to the satisfaction of the Court. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (4) Any security given for salvage under this section to an amount}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 exceeding $400 may be enforced by the Court in the same manner as if bail had}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 been given in that Court. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 20 Receiver may sell wreck in case of non-payment}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) The receiver may sell any detained property if the persons liable to pay}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 salvage in respect of which the property is detained are aware of the detention, in} {\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the following cases, namely \endash \par }{\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (a) Where the amount is not disputed, and payment of the amount}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 due is not made within 90 days after the amount is due; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (b) Where the amount is disputed, but no appeal lies from the first}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 Court to which the dispute is referred, and payment is not made}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 within 90 days after the decision of the first Court; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid730742 {\f0\insrsid12549309\charrsid730742 (c) Where the amount is disputed, and an appeal lies from the decision}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 of the first Court to some other Court, and within 90 days of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 decision of the first Court neither payment of the sum due is made}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 nor evidence is produced that proceedings are to be commenced}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 for the purpose of appeal. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid730742 {\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) The proceeds of sale of detained property shall, after payment of the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 expenses of sale, be applied by the receiver in payment of the expenses, fees, and}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 salvage, and the surplus (if any) shall be paid to the owners of the property or any}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 other persons entitled to receive the same. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 21 Foreign wreck subject to duties as an importation \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) All wreck, being goods brought or coming into Niue from parts beyond}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the seas shall be subject to the same duties as if the same was imported into Niue,}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 and if any question arises as to the origin of the goods they shall be deemed to be}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 the produce of such country as Cabinet may on investigation determine. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Cabinet may permit all goods saved from any ship or aircraft stranded}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 or wrecked on her homeward voyage to be forwarded to the port of her original}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 destination, and all goods saved from any ship or aircraft stranded or wrecked on}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 her outward voyage to be returned to the port at which they were laden; but}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 Cabinet shall take security for the revenue in respect of those goods. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (3) In this section }{\f0\insrsid730742 "}{\f0\insrsid12549309\charrsid730742 goods\rquote }{\f0\insrsid730742 "}{\f0\insrsid12549309\charrsid730742 includes any part of any ship or aircraft and}{\f0\insrsid730742 }{ \f0\insrsid12549309\charrsid730742 the cargo, machinery, and equipment and any other property belonging to it. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 22 Offences}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (1) Every person who commits an offence against this Act for which no}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 penalty is provided elsewhere than in this section shall be liable in respect of each}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 offence to a fine not exceeding 2 penalty units. \par }{\f0\insrsid730742 \par }{\f0\insrsid12549309\charrsid730742 (2) Where an offence against this Act is a continuing one, and no penalty is}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 provided for the continuance of it elsewhere than in this section, every person}{ \f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 who commits that offence shall, in addition to any other liability, be liable to a fine}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 not exceeding 0.5 penalty units for every day or part of a day during which the}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 offence continues. \par }{\b\f0\insrsid730742 \par }{\b\f0\insrsid12549309\charrsid730742 23 Limitation of time in proceedings}{\b\f0\insrsid12549309 \par }{\b\f0\insrsid730742\charrsid730742 \par }{\f0\insrsid12549309\charrsid730742 No conviction for an offence shall be made under this Act other than for an}{\f0\insrsid730742 }{\f0\insrsid12549309\charrsid730742 offence under section 15, unless such proceeding is commenced within one year}{
