\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 person present in Niue authorised to protect the interests of the owners, the receiver}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 shall make known to the owners in New Zea
land, if the ship or aircraft is registered}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 there, or to a trade or other representative in New Zealand of the Commonwealth}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 
country, or, as the case may be a consular representative in New Zealand of a}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 foreign country, in which that ship or aircraft may have been registered or to which}{\f0\insrsid730742  }{
\f0\insrsid12549309\charrsid730742 that ship or aircraft may have belonged, the facts of the wreck, stranding or}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 abandonment, and shall act under instructions received from the owners or trade}{

persons resident in Niue or in New Zealand, a trade or other representative in}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 New Zealand of the Commonwealth country, or as the case may be, a consular}{\f0\insrsid730742  }{

\par }{\f0\insrsid12549309\charrsid730742 (1) If any ship or aircraft is sunk stranded or abandoned on or near the}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 coasts of Niue, and there is no authority in any other Act or rule or regulation to}{
\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 remove or destroy that ship or aircraft, Cabinet may, and shall, if in his opinion}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 the ship or
 aircraft is, or is likely to become an obstruction to navigation (or danger}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 to property, life or limb) direct the receiver to cause that ship or aircraft to be}{\f0\insrsid730742  }{
\f0\insrsid12549309\charrsid730742 removed.

\par }{\f0\insrsid12549309\charrsid730742 (2) On receiving such a direction, the receiver, by notice in writing given}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 to the owner or master of the ship or any agent of the owner or, as the case may be,}

\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 any part of the cargo or equipment of it, or anything belonging to it, or any wreck}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 
found within those limits, and there sells the same, commits an offence against}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 this Act and shall be liable on conviction or indictment to imprisonment for a}{\f0\insrsid730742  }{
\f0\insrsid12549309\charrsid730742 term not exceeding 5 years or to a fine not exceeding 20 penalty units.

of it or any part of it, or

\par }{\f0\insrsid12549309\charrsid730742 (1) Disputes as to the amount of salvage, whether of life or property, arising}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 between the salvor and the owners of any ship or aircraft or cargo or equipments}{
\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 or wreck shall, if not settled by agreement, arbitration or otherwise, be determined}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 by the Court.

\par }{\f0\insrsid12549309\charrsid730742 (2) Disputes relating to salvage may be determined on the application either}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 of the salvor or of the owner of the property saved, or of their respective agents.

\par }{\f0\insrsid12549309\charrsid730742 (3) The Court may, for the purpose of determining any dispute relating to}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 salvage, call to its assistance as assessor any person conversant with maritime or}{
\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 aeronautical affairs; and there shall be paid, as part of the cost of the proceedings,}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 
to every such assessor in respect of his services such sum as Cabinet directs.

\par }{\f0\insrsid12549309\charrsid730742 (4) Any party aggrieved by the decision of the Court may, if the sum in}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 dispute exceeds $400, appeal to the Court of Appeal.

\par }{\b\f0\insrsid12549309\charrsid730742 21 Foreign wreck subject to duties as an importation

\par }{\f0\insrsid12549309\charrsid730742 (1) All wreck, being goods brought or coming into Niue from parts beyond}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 the seas shall be subject to the same duties as if the same was imported into Niue,}{

produce of such country as Cabinet may on investigation determine.

\par }{\f0\insrsid12549309\charrsid730742 (2) Cabinet may permit all goods saved from any ship or aircraft stranded}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 or wrecked on her homeward voyage to be forwarded to the port of her original}{
\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 destination, and all goods saved from any ship or aircraft stranded or wrecked on}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 
her outward voyage to be returned to the port at which they were laden; but}{\f0\insrsid730742  }{\f0\insrsid12549309\charrsid730742 Cabinet shall take security for the revenue in respect of those goods.
