{\f0\insrsid8731966\charrsid9510065 (c) To treat any person who is seeking to acquire or has acquired such}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 an estate or interest or such accommodation differently from other}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 persons in the same circumstances; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (d) To deny any person, directly or indirectly, the right to occupy any}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 land or any residential or business accommodation; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (e) To terminate any estate or interest in land or the right of any person}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 to occupy any land or any residential or business accommodation \endash }{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 by reason of the colour, race, or ethnic or national origins of that person or of any}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 relative of that person as defined in section 3 or of any associate of that person. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) It shall be unlawful for any person, on his own behalf or on behalf or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 purported behalf of any principal, to impose or seek to impose on any other person}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 any term or condition which limits, by reference to colour, dispose}{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 includes sell, assign, lease, let, sublease, sublet, license, or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 mortgage, and agree to dispose; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 residential accommodation}{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 includes accommodation in dwelling-house,}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 flat, hotel, motel, boarding house, or camping ground. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 7 Advertisements}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 It shall be unlawful for any person to publish or display or to cause or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 allow to be published or displayed, any advertisement or notice which indicates,}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 or could reasonably be understood as indicating, an intention to commit a breach}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 of any of the provisions of sections 3 to 6. \par }{\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 8 Liability of principals and employers \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 Anything which is done or omitted in contravention of sections 3 to 7 by a}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 person as the agent or employee of another person shall be treated for the purposes}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 of sections 3 to 7 as done or omitted by that other person as well as by him, unless}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 it is done or omitted without that other person\rquote s express or implied authority,}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 precedent or subsequent. \par }{\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 9 Measures to ensure equality \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 Anything done or omitted which would otherwise constitute a breach of}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 sections 4 to 7 shall not constitute such a breach if \endash \par }{\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) It is done or omitted in good faith for the purposes of assisting or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 advancing particular persons or groups of persons or persons of a}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 particular colour, race, or ethnic or national origin; and \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) Those groups or persons need or may reasonably be supposed to}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 need assistance or advancement in order to achieve an equal place}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 with other members of the community. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 10 Civil proceedings \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 Any person who considers himself aggrieved by a breach of any of the}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 provisions of sections 3 to 7 (the aggrieved person) may bring civil proceedings in}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 the Court against any person alleged to have committed the breach, and in those}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 proceedings the aggrieved person may seek such of the remedies described in}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 section 15 as he thinks fit. \par }{\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 11 Investigation and conciliation where proceedings commenced \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (1) Where proceedings are commenced under section 10 the Court shall}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 refer the case to a conciliator appointed by the Court and shall adjourn the}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 proceedings accordingly. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) The conciliator appointed under subsection (1) shall investigate the case}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 referred to him and carry out the functions described in section 14. \par }{\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 12 Proceedings of the conciliator}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) Every investigation by a conciliator appointed under section 11 shall}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 be conducted in private. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) The conciliator may hear or obtain information from such persons as}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 he thinks fit. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (3) Subject to this Act, the conciliator may regulate his procedure in such a}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 manner as he thinks fit.}{\f0\insrsid8731966 \par }{\f0\insrsid3027889\charrsid9510065 \par }{\b\f0\insrsid8731966\charrsid9510065 13 Evidence}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) The conciliator appointed under section 11 may require any person}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 who in his opinion is able to give any information relating to the matter which is}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 being investigated by the conciliator to furnish to him any such information and}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 to produce any docum ents or papers or things which in the conciliator\rquote s opinion}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 relate to any such matter as aforesaid and which may be in the possession or}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 under the control of that person.}{\f0\insrsid8731966 \par }{\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid3027889 (2) \par \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) The conciliator may summon before him and examine on oath any}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 person who in the conciliator\rquote s opinion is able to give any such}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 information as aforesaid and for that purpose may administer an}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 oath. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) Every such investigation by the conciliator shall be deemed to be a}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 judicial proceedings within the meaning of section 181 of the Niue}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Act 1966. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (3) Every such person shall be obliged to answer any questions put to him}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 by the conciliator but shall have the same privilege in relation to the production of} {\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 documents and papers and things as witnesses have in any Court. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (4) Except on the trial of any person for perjury within the meaning of the}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Niue Act 1966 in respect of his sworn testimony, no statement made or answer}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 given by that or any other person in the course of the inquiry by or any proceedings}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 before the conciliator shall be admissible in evidence against any person in any}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Court or at any inquiry or in any other proceedings, and no evidence in respect of}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 proceedings before the conciliator shall be given against any person. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (5) No person shall commit an offence against section 228A of the Niue}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Act 1966 or any enactment, other than this Act, by reason of compliance with any}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 requirement of the conciliator under this section. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (6) Where any person is required by the conciliator to attend before him}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 for the purposes of this section, the person shall be entitled to the same fees,}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 allowances, and expenses as if he were a witness in civil proceedings in the Court}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 and the amounts payable shall be fixed by the Court and paid out of the Niue}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Government Account. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (7) Every person appointed a conciliator under section 11 who, except}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 insofar as it is necessary for him to do so for the proper discharge of his functions}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 under this Act discloses to any person any information received by him or any}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 statement or adm ission made to him in the course of an investigation under section}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 11 or an endeavour to bring about a settlement under section 14 commits an offence}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 and is liable on conviction to a fine not exceeding 2 penalty units.}{\f0\insrsid8731966 \par }{\f0\insrsid3027889\charrsid9510065 \par }{\b\f0\insrsid8731966\charrsid9510065 14 Procedure after investigation}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) After investigating a case referred to him under section 11, the conciliator}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 shall use his best endeavours to secure a settlement acceptable to the parties and,}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 if he considers it appropriate in a case where he is of the opinion that a breach of}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 any of the provisions of sections 3 to 7 has occurred, a satisfactory assurance against}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 the repetition of the act or omission constituting the breach or the doing of further}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 acts or omissions of a similar kind by the person considered to have committed}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 the breach. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) As soon as reasonably practicable and in any event not later than 60}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 days after the matter has been referred to him or within such further time as the}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Court may allow the conciliator shall furnish a report to the Court which shall}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 state whether or no t the endeavour to secure a settlement between the parties or,}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 as the case may be, a settlement and an assurance of the kind referred to in}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 subsection (1), has been successful. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (3) A copy of every such report shall be made available to each party or to}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 his solicitor or counsel. \par }{\f0\insrsid3027889 \par (4) \par \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) If the conciliator reports that he has secured a settlement, or a}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 settlement and such an assurance as aforesaid, the proceedings shall}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 lapse but without prejudice to the right of the aggrieved person to}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 commence fresh proceedings at any time in respect of the same}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 cause of action if there has been a breach of any term of the}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 settlement or of the assurance. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) In this event, the Court, if it is satisfied that such a breach has}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 occurred, shall proceed to hear the case and section 11 (1) shall have}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 no application. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (c) The Court shall otherwise dismiss the case. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 15 Remedies}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) If in any proceedings under section 10 the Court is satisfied on the}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 balance of probabilities that the defendant has committed a breach of any of the}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 provisions of sections 3 to 7, it may grant one or more of the following remedies \endash \par }{\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) A declaration that the defendant has committed a breach of this}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Act; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) An injunction restraining the defendant from continuing or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 repeating the breach or from engaging in, or causing or permitting}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 others to engage in conduct of the same kind as that constituting}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 the breach, or conduct of any similar kind specified in the injunction; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (c) Damages under section 16; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (d) A declaration that any contract entered into or performed in}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 contravention of any of the provisions of sections 3 to 7 is an illegal}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 contract; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (e) Such other relief as the Court thinks just. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) It shall not be a defence to proceedings under this section that the breach}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 was unintentional or without negligence on the part of the defendant, but the}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 Court may take the conduct of the defendant into account in granting a remedy. \par }{\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 16 Damages}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) In any proceedings under section 10 the Court may award damages}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 against the defendant for a breach of any of the provisions of sections 3 to 7 in}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 respect of any one or and expenses reasonably incurred by the}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 aggrieved person for the purpose of the transaction or activity out}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 of which the breach arose; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) Loss of any benefit which the aggrieved person might reasonably}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 have been expected to obtain but for the breach; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (c) Humiliation, loss of dignity, and injury to the feelings of the}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 aggrieved person. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) Damages awarded under subsection (1)(c) shall not exceed 200 dollars. \par }{\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 17 Licences and registration}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) Where any person is licensed or registered under any enactment to}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 carry on any occupation or activity or where any premises or vehicle are registered}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 or licensed for any purpose under any enactment, and where the person or other}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 authority authorised to renew, revoke, cancel, or review any such licence or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 registration is satisfied \endash \par }{\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) That in the carrying on of its occupation or activity; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) That in the use of the premises or vehicle \endash }{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 there has been a breach of any of the provisions of sections 3 to 7 the person or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 authority, in addition to any other powers which that person or authority has, but}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 subject to subsection (2), may refuse to renew or may revoke or cancel any such}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 licence or registration, as the case may require, or may impose any other penalty} {\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 authorised by the enactment, whether by way of censure, fine, or otherwise.}{\f0\insrsid8731966 \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (2) Any procedural requirements of the enactment, including any whereby}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 a complaint is a prerequisite to the exercise by the person or authority of its powers}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 under the enactment, shall be observed. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (3) In any case in which any of the powers conferred by subsection (1) are}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 exercised \endash \par }{\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) The person or authority shall in giving its decision state that the}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 decision is being made under subsection (1); and \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) Any person who would have been entitled to appeal against that}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 decision if it had been made on other grounds shall be entitled to}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 appeal against the decision made under subsection (1). \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 18 Access by the public to places, vehicles and facilities}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) Every person commits an offence who \endash }{\f0\insrsid8731966 \par }{\f0\insrsid3027889\charrsid9510065 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) Refuses to allow any other person access to or use of any place or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 vehicle which members of the public are entitled or allowed to enter}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 or use; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) Refuses any other person the use of any facilities in that place or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 vehicle which are available to members of the public; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (c) Requires any other person to leave or to cease to use that place or}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 vehicle or those facilities \endash }{\f0\insrsid3027889 \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 by reason of the colour, race, or ethnic or national origins of that person or of any}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 relative of that person as defined in section 3 or of any associat e of that person. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) Every person who commits an offence against this section is liable to a}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 fine not exceeding 1 penalty unit. \par }{\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (3) In this section, }{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 vehicle}{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 includes a }{\b\f0\insrsid3027889\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) Every person commits an offence and is liable to imprisonment for a}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 term not exceeding 3 months or to a fine not exceeding 2 penalty units who with}{ \f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 intent to incite hostility or ill-will against, or bring into contempt or ridicule, }{\f0\insrsid8340352\charrsid9510065 any group}{\f0\insrsid8731966\charrsid9510065 of persons in Niue on the ground of the colour, race, or ethnic or national}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 origins of that group of persons \endash \par }{\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (a) Publishes or distributes written matter which is threatening,}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 abusive, or insulting, or broadcasts by means of radio or television}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 words which are threatening, abusive, or insulting; or \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid8731966\charrsid9510065 (b) Uses in any public place or within the hearing of persons in any}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 such public place, or at any meeting to which the public are invited}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 or have access, words which are threatening, abusive, or insulting,}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 be ing matter or words likely to excite hostility, or ill-will against, or bring into}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 contempt or ridicule, any such group of persons in Niue on the ground of the}{\f0\insrsid3027889 }{ \f0\insrsid8731966\charrsid9510065 colour, race, or ethnic or national origins of that group of persons. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\f0\insrsid3027889 \par }{\f0\insrsid8731966\charrsid9510065 (2) For the purposes of this section \endash \par }{\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 publishes}{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 or }{\f0\insrsid9510065 "}{ \f0\insrsid8731966\charrsid9510065 distributes}{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 mean publishes or distributes to the public at}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 large or to any member or members of the public; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3027889 {\f0\insrsid3027889 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3027889 {\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 written matter}{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 includes any writing, sign, visible representation, or sound}{\f0\insrsid3027889 }{\f0\insrsid8731966\charrsid9510065 recording. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\b\f0\insrsid3027889 \par }{\b\f0\insrsid8731966\charrsid9510065 20 No prosecution without consent}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid8340352\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 No prosecution for an offence under section 18 or 19 shall be instituted}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 without the consent of Cabinet.}{\f0\insrsid8731966 \par }{\f0\insrsid8340352\charrsid9510065 \par }{\b\f0\insrsid8731966\charrsid9510065 21 Condition in restraint of marriage}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid8340352\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) A condition, whether oral or contained in a deed, will, or other}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 instrument, which restrains or has the effect of restraining marriage shall be void}{ \f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 if the person or class of person whom the person subject to the condition may or}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 may not marry is identified or defined, expressly or by implication, by reference}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 to the colour, race, or ethnic or national origins of the person or class of person. \par }{\f0\insrsid8340352 \par }{\f0\insrsid8731966\charrsid9510065 (2) Nothing in this section shall affect the construction of any deed, will,}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 or other instrument executed before the commencement of this Act. \par }{\f0\insrsid8340352 \par }{\f0\insrsid8731966\charrsid9510065 (3) For the purposes of this section, the will of any testator who dies after}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 31 December 1973 shall (notwithstanding the actual date of the execution of it), be}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 deemed to have been executed after the commencement of this Act. \par }{\b\f0\insrsid8340352 \par }{\b\f0\insrsid8731966\charrsid9510065 22 Offences}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid8340352\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 Every person commits an offence against the Act and is liable to a fine not}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 exceeding 1 penalty unit who \endash }{\f0\insrsid8731966 \par }{\f0\insrsid8340352\charrsid9510065 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid8340352 {\f0\insrsid8731966\charrsid9510065 (a) Without lawful justification or excuse, wilfully obstructs, hinders,}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 or resists any person appointed as conciliator under section 11 in}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 the exercise of his powers under this Act; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid8340352 {\f0\insrsid8340352 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid8340352 {\f0\insrsid8731966\charrsid9510065 (b) Without lawful justification or excuse, refuses or wilfully fails to}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 comply with any lawful requirement of any person appointed as}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 conciliator under section 11; \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid8340352 {\f0\insrsid8340352 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid8340352 {\f0\insrsid8731966\charrsid9510065 (c) Wilfully makes any false statement to or misleads or attempts to}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 mislead any person appointed as conciliator under section 11 in}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 the exercise of his powers under this Act. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid9510065 {\b\f0\insrsid8340352 \par }{\b\f0\insrsid8731966\charrsid9510065 23 Other enactments not affected}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid8340352\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 Except as expressly provided in this Act nothing in this Act shall limit or}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 affect any other enactment.}{\f0\insrsid8731966 \par }{\f0\insrsid8340352\charrsid9510065 \par }{\b\f0\insrsid8731966\charrsid9510065 24 Charitable instruments}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid8340352\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) Nothing in this Act shall apply to any provision contained in an existing}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 or future charitable instrument which confers benefits, or enables benefits to }{ \f0\insrsid8340352\charrsid9510065 be conferred}{\f0\insrsid8731966\charrsid9510065 , on persons of a particular colour, race, or ethnic or national origin, or to}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 any act done in order to comply with any such provision. \par }{\f0\insrsid8340352 \par }{\f0\insrsid8731966\charrsid9510065 (2) In this section }{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 instrument}{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 means an instrument the purposes of which}{\f0\insrsid8340352 }{ \f0\insrsid8731966\charrsid9510065 are exclusively charitable.}{\f0\insrsid8731966 \par }{\f0\insrsid8340352\charrsid9510065 \par }{\b\f0\insrsid8731966\charrsid9510065 25 Savings}{\b\f0\insrsid8731966 \par }{\b\f0\insrsid8340352\charrsid9510065 \par }{\f0\insrsid8731966\charrsid9510065 (1) Nothing in this Act shall affect the right to bring any proceedings, either}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 ci vil or criminal, which might have been brought if this Act had not been passed,}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 but, in assessing any damages to be awarded to or on behalf of any person under}{\f0\insrsid8340352 }{ \f0\insrsid8731966\charrsid9510065 this Act or otherwise, a court shall take account of any damages already awarded}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 to or on behalf of that person in respect of the same cause of action. \par }{\f0\insrsid8340352 \par }{\f0\insrsid8731966\charrsid9510065 (2) No proceedings, civil or criminal, shall lie against any person, except}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 as provided by this Act, in respect of any act or omission, which is unlawful by}{ \f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 virtue only of sections 3 to 7. \par }{\f0\insrsid8340352 \par }{\f0\insrsid8731966\charrsid9510065 (3) Nothing in this Act shall affect any enactment or law, or any}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 administrative practice, which distinguishes between New Zealand citizens and}{ \f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 other persons, or between British subjects or Commonwealth citizens (including}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 citizens of the Republic of Ireland) and a liens, or between Niueans and other}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 persons. \par }{\f0\insrsid8340352 \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid8340352 {\f0\insrsid8731966\charrsid9510065 (4) For the purposes of subsection (3) }{\f0\insrsid9510065 "}{\f0\insrsid8731966\charrsid9510065 enactment}{\f0\insrsid9510065 "}{ \f0\insrsid8731966\charrsid9510065 includes any provision}{\f0\insrsid8340352 }{\f0\insrsid8731966\charrsid9510065 of any notice, consent, approval, or direction which is given by any person pursuant}{\f0\insrsid8340352 }{ \f0\insrsid8731966\charrsid9510065 to a power conferred by any enactment.}{\f0\insrsid11087364\charrsid9510065 \par }}
