subsection}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 (1), any regulations as aforesaid may confer or impose on a responsible Minister} {\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 or any Department of State, or on any persons in the service of the Crown or}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 acting on behalf of the }{\f0\insrsid13375056\charrsid3298499 (3) Cabinet may make such provisions incidental to the powers aforesaid}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 as may be required for making the exercise of those powers effective. \par }{\f0\insrsid3298499 \par }{\f0\insrsid13375056\charrsid3298499 (4) Any regulations made under the authority of this section may apply}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 throughout Niue, notwithstanding that a Proclamation of Emergency may have}{ \f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 been issued only in respect of a limited area or of limited areas, or may, according}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 to the tenor of such regulations, apply only within the area or areas specified or}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 defined in the Proclamation of Emergency. \par }{\f0\insrsid3298499 \par }{\f0\insrsid13375056\charrsid3298499 (5) Any regulations so made shall be laid before the Assembly as soon }{\f0\insrsid3298499\charrsid3298499 as}{\f0\insrsid3298499 they}{\f0\insrsid13375056\charrsid3298499 are made, and shall not continue in force after the expiration of 14 days from}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 the time they are laid before the Assembly unless a resolution is passed by the}{\f0\insrsid3298499 }{ \f0\insrsid13375056\charrsid3298499 Assembly providing for their continuance. \par }{\f0\insrsid3298499 \par }{\f0\insrsid13375056\charrsid3298499 (6)}{\f0\insrsid3298499 \par \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3298499 {\f0\insrsid13375056\charrsid3298499 (a) Every person who commits, or attempts to commit any act with}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 intent to commit, or counsels, procures, aids, abets, or incites any}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 other person to commit, or conspires with any other person (whether}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 in Niue or elsewhere) to commit, any offence against any such}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 regulation shall be liable on conviction before the Court to}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 imprisonment for a term of 3 months or a fine of 2 penalty units or}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 both such imprisonment and fine, together with the forfeiture of}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 any goods or money in respect of which the offence has been}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 committed.}{\f0\insrsid13375056 \par }\pard if enacted, in this Act,}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 bu t may be added to, altered, or revoked by resolution of the}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 Assembly or by regulations made in the like manner and subject to}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 the like provisions as the originals. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3298499 {\f0\insrsid3298499 \par }\pard \ql \li720\ri0\nowidctlpar\faauto\rin0\lin720\itap0\pararsid3298499 {\f0\insrsid13375056\charrsid3298499 (b) All regulations made under this section and not earlier revoked}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 shall expire on the expiration of the Proclamation of Emergency by}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 virtue of which they were made, but may be revived either in whole}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 or in part by any subsequent Proclamation of Emergency. \par }\pard \ql \li0\ri0\nowidctlpar\faauto\rin0\lin0\itap0\pararsid3298499 {\f0\insrsid3298499 \par }{\f0\insrsid13375056\charrsid3298499 (8) The expiry or revocation of any regulations so made shall not be deemed}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 to have affe cted their previous operation or the validity of any action taken under}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 them or any penalty or punishment incurred in respect of any contravention or}{\f0\insrsid3298499 }{ \f0\insrsid13375056\charrsid3298499 failure to comply with them or any proceeding or remedy in respect of any such}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 punishment or penalty. \par }{\f0\insrsid3298499 \par }{\f0\insrsid13375056\charrsid3298499 (9) No regulations under this Act shall be deemed invalid because they}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 deal with any matter already provided for by any Act or because of any repugnancy}{ \f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 to any such Act. \par }{\f0\insrsid3298499 \par }{\f0\insrsid13375056\charrsid3298499 (10) Nothing in this Act or in any regulation under this Act shall be so}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 construed or shall so operate as to take away or restrict the liability of any person }{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 for any offence punishable independently of this Act. \par }{\b\f0\insrsid3298499 \par }{\b\f0\insrsid13375056\charrsid3298499 4 Special provisions applicable pending issue of Proclamation \par }{\f0\insrsid3298499 \par any other cause, sections 1 to 3 cannot be put}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 into operation immediately, the senior officer of the Police present}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 in the locality shall assume responsibility for the issuing of all orders}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 and instructions necessary in his opinion for the preservation of}{\f0\insrsid3298499 }{ \f0\insrsid13375056\charrsid3298499 life, the protection of property, and the maintenance of order. \par }\pard \ql The authority conferred by this section shall cease on the issue of a}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 Proclamation of Emergency under section 2. \par }\pard \ql }{\b\f0\insrsid13375056\charrsid3298499 5 Protection of person acting under authority of this Act \par }{\f0\insrsid3298499 \par }{\f0\insrsid13375056\charrsid3298499 No action, claim, or demand whatsoever shall be made or allowed by or in}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 favour of any officer or person acting in the execution or intended execution of}{ \f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 this Act or of any regulations under it, for or in respect of any damage, loss or}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 injury sustained or alleged to have been sustained by reason of anything done or}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 purporting to be done under the authority of this Act or of regulations as aforesaid,}{\f0\insrsid3298499 }{ \f0\insrsid13375056\charrsid3298499 save only in respect of reasonable compensation for any property used or taken}{\f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 for or on behalf of the Crown under any powers conferred by this Act or by}{ \f0\insrsid3298499 }{\f0\insrsid13375056\charrsid3298499 regulations under this
