\hich\af0\dbch\af37\loch\f0 The comparison showing the reduction }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3491497 \hich\af0\dbch\af37\loch\f0 in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9463717 \hich\af0\dbch\af37\loch\f0 the numbers}{\rtlch\fcs1 \af0

\hich\af0\dbch\af37\loch\f0 .  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3541802 \hich\af0\dbch\af37\loch\f0 As the trial Judge noted, all the information relevant to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6834751 \hich\af0\dbch\af37\loch\f0 its}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3541802 \hich\af0\dbch\af37\loch\f0  loss was in the control of Honeymoon.  How could such evidence as to \hich\af0\dbch\af37\loch\f0 
loss be challenged in cross-examination?  The onus was on Honeymoon to adduce that evidence to establish the loss.  This was not a case where the Court could be expected or even should be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4733117 
\hich\af0\dbch\af37\loch\f0 expected to do that which Honeymoon had failed to do.  Honeymoon\hich\f0 \rquote \loch\f0 s s\hich\af0\dbch\af37\loch\f0 \hich\f0 ubmission amounts to an attempt to force the Court to \'93}{\rtlch\fcs1 \af0 \ltrch\fcs0

\af0 \ltrch\fcs0 \insrsid12272827 \loch\af0\dbch\af37\hich\f0 \'94\loch\f0  Mociu Island.  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6834751 \hich\af0\dbch\af37\loch\f0 
At page 1242 of the Record, Mr Gock stated that as at 18 June 2018 Plantation Island Resort, Muske\hich\af0\dbch\af37\loch\f0 \hich\f0 
t Cove Island Resort, Malolo Island Resort, Likuliku Island Resort, Castaway Island Resort and Mana Island Resort were all \'93}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6834751\charrsid6834751 \hich\af0\dbch\af37\loch\f0 using}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid6834751 \loch\af0\dbch\af37\hich\f0 \'94\loch\f0  Mociu Island as part of their day trip activities.  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12272827 \hich\af0\dbch\af37\loch\f0 
This has obviously been made possible by negotiating with Follies }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16666433 \hich\af0\dbch\af37\loch\f0 and/or \hich\af0\dbch\af37\loch\f0 subsequent owners}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12272827 
\hich\af0\dbch\af37\loch\f0  of a registered lease over the Island.  There was no evidence at the trial to conclude that Honeymoon could not have reached the same arrangement.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8346992 \hich\af0\dbch\af37\loch\f0

osed to conduct}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15363469 \hich\af0\dbch\af37\loch\f0 , }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12272827 \hich\af0\dbch\af37\loch\f0 
indicate that there is no merit in this appeal.  Furthermore the trial Judge has indicated that even if }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15363469 \hich\af0\dbch\af37\loch\f0 it had been possible}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12272827
