However costs of $2,500 were ordered against the Appellant Service Station because of the late payment to the Receiver, and the failure to notify the Respondent Gas Company prior to the appeal hearing \hich\af0\dbch\af52\loch\f0 of such satisfaction of\hich\af0\dbch\af52\loch\f0 the debt\hich\af0\dbch\af52\loch\f0 . \par \par \hich\af0\dbch\af52\loch\f0 [7]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 The Petitioner Service Station now appeals to the Supreme Court.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 It \hich\af0\dbch\af52\loch\f0 challenges\hich\af0\dbch\af52\loch\f0 the finding that the debt was not \hich\af0\dbch\af52\loch\f0 disputed, the finding \hich\af0\dbch\af52\loch\f0 based \hich\af0\dbch\af52\loch\f0 on conflicting affidavit evidence, the sufficiency of evidence to ascertain the truthfulness or o\hich\af0\dbch\af52\loch\f0 therwise of an affidavit of service, the effect of non-compliance with the Company Rules in relation to windings-up, and \hich\af0\dbch\af52\loch\f0 raises\hich\af0\dbch\af52\loch\f0 \hich\af0\dbch\af52\loch\f0 other grounds\hich\af0\dbch\af52\loch\f0 which it is unnecessary to list\hich\af0\dbch\af52\loch\f0 . \par \par \hich\af0\dbch\af52\loch\f0 [8]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 The Parties proceeded to settle the record\hich\af0\dbch\af52\loch\f0 ,\hich\af0\dbch\af52\loch\f0 the appeal book.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 The Responde\hich\af0\dbch\af52\loch\f0 nt argued that it was unreasonable \hich\af0\dbch\af52\loch\f0 that the Petitioner should not have prosecuted the appeal for over a year.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 In submissions this was said to be 11 months. \par \par \hich\af0\dbch\af52\loch\f0 [9]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Whilst the Supreme Court Rules 1998 [Legal Notice No. 119] do provide certain time scales suc\hich\af0\dbch\af52\loch\f0 h as for filing Notice of Appeal [42 days], for \hich\af0\dbch\af52\loch\f0 the \hich\af0\dbch\af52\loch\f0 registr \hich\af0\dbch\af52\loch\f0 ar\hich\af0\dbch\af52\loch\f0 to notify the appellant or petitioner of the sum to be deposited as security for costs [within one month of lodging of an appeal], the deposit of the security for costs o \hich\af0\dbch\af52\loch\f0 r\hich\af0\dbch\af52\loch\f0 the bond [within 1 mon\hich\af0\dbch\af52\loch\f0 th of the sum being notified to the appellant or petitioner], \hich\af0\dbch\af52\loch\f0 several \hich\af0\dbch\af52\loch\f0 other obligations under the Rules have no such fixed time scale\hich\af0\dbch\af52\loch\f0 , including that of settling the record\hich\af0\dbch\af52\loch\f0 . \par \par \hich\af0\dbch\af52\loch\f0 [10]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 In the absence of a \hich\af0\dbch\af52\loch\f0 specified\hich\af0\dbch\af52\loch\f0 control structure, the matter is to be appr\hich\af0\dbch\af52\loch\f0 oached on the basis of reasonableness. It is in the interests of all parties to a particular action that the matter be concluded within a satisfactory time scale.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Nor\hich\af0\dbch\af52\loch\f0 is \hich\af0\dbch\af52\loch\f0 it \hich\af0\dbch\af52\loch\f0 in the public interest that disputes \hich\af0\dbch\af52\loch\f0 merely \hich\af0\dbch\af52\loch\f0 be par\hich\af0\dbch\af52\loch\f0 k\hich\af0\dbch\af52\loch\f0 ed in the final Court of Appeal\hich\af0\dbch\af52\loch\f0 , the Supreme Court\hich\af0\dbch\af52\loch\f0 with little attempt at prosecution\hich\af0\dbch\af52\loch\f0 . \par \par \hich\af0\dbch\af52\loch\f0 [11]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Though the dismissal of the judiciary in April 2009 had placed unprecedented constraints \hich\af0\dbch\af52\loch\f0 o\hich\af0\dbch\af52\loch\f0 n the operation of the appellate courts, nonetheless litigants must be ready to prosecute their appeals \hich\af0\dbch\af52\loch\f0 to the point where they are ready to press their arguments at the appeal hearing, when a date is given. \par \par \hich\af0\dbch\af52\loch\f0 [12]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Appellants and Petitioners must know their case, know their grounds of appeal.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 At \hich\af0\dbch\af52\loch\f0 th\hich\af0\dbch\af52\loch\f0 e time of preparing those grounds Counsel should know the i\hich\af0\dbch\af52\loch\f0 tems for inclusion in the record that are relevant to the appeal, for and against his or her case.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \par \par documents}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 "}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Before\hich\af0\dbch\af52\loch\f0 arriving at that decision the registrar must first issue a summons requesting the parties and their legal practitioners to appear before the registrar at the time \hich\af0\dbch\af52\loch\f0 and place stated in the summons\hich\af0\dbch\af52\loch\f0 to settle the documents to be included in the record of appeal or of revision.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 [Rule 19(a) and Form 3 First Schedule]. \par \par \hich\af0\dbch\af52\loch\f0 [14]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Of course the Rules exhort the registrar, the parties and their legal practitioners to endeavour \hich\af0\dbch\af52\loch\f0 to exclude from the record all documents \hich\af0\dbch\af52\loch\f0 (\hich\af0\dbch\af52\loch\f0 more particularly such as are merely formal) that are not relevant to the subject matter of the appeal or petition, and generally to reduce the bulk of the record as far as practicable, taking special care to avoid\hich\af0\dbch\af52\loch\f0 the unnecessary repetition of documents and headings and other merely formal parts of the documents [Rule 11(1)]. \par \par \hich\af0\dbch\af52\loch\f0 [15]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 One party may object to an inclusion.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Those documents \hich\af0\dbch\af52\loch\f0 thus \hich\af0\dbch\af52\loch\f0 excluded must be listed by the registrar and a list of excluded documents\hich\af0\dbch\af52\loch\f0 attached to the record Court\hich\af0\dbch\af52\loch\f0 ,\hich\af0\dbch\af52\loch\f0 or the President alone\hich\af0\dbch\af52\loch\f0 ,\hich\af0\dbch\af52\loch\f0 to order that the appeal or petition be struck out for want of prosecution\hich\af0\dbch\af52\loch\f0 [\hich\af0\dbch\af52\loch\f0 Rules 19(3), 20\hich\af0\dbch\af52\loch\f0 ]\hich\af0\dbch\af52\loch\f0 .}{ Supreme Court to exercis\hich\af0\dbch\af52\loch\f0 e any power vested in the Supreme Court }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 "}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 not involving the decision of an appeal or \hich\af0\dbch\af52\loch\f0 reference}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 "}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 ordering the striking out of an appeal is determinative of the appeal and as such beyond the powers of the President\hich\af0\dbch\af52\loch\f0 . \par \par \hich\af0\dbch\af52\loch\f0 appropriate case \hich\af0\dbch\af52\loch\f0 the President can properly refer the default to the \hich\af0\dbch\af52\loch\f0 F\hich\af0\dbch\af52\loch\f0 ull \hich\af0\dbch\af52\loch\f0 C\hich\af0\dbch\af52\loch\f0 ourt for its decision.}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 In such a case the Full Court might order the petition to be struck out. \par \par \hich\af0\dbch\af52\loch\f0 [20]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 I have set out in full the procedure contained in the Rules for settling \hich\af0\dbch\af52\loch\f0 the record.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 It is \hich\af0\dbch\af52\loch\f0 clear that the Rules are not being followed.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 It may be efficacious for the registry to write on behalf of the registrar seeking a list of documents from the petitioner.}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 However it is for the registrar to issue the summons as set out in Form 3 in the Firs\hich\af0\dbch\af52\loch\f0 t Schedule requesting the parties}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 '}{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 attendance before the registrar.}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{ \f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 Whether the parties attend or not\hich\af0\dbch\af52\loch\f0 ,\hich\af0\dbch\af52\loch\f0 the duty is cast on the registrar \hich\af0\dbch\af52\loch\f0 alone \hich\af0\dbch\af52\loch\f0 to settle the list of documents [Rule 19(b)].}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 But a\hich\af0\dbch\af52\loch\f0 failure to co-operate by counsel or solicitors to settle th\hich\af0\dbch\af52\loch\f0 e record may result in consequences in costs when the Supreme Court hears and decides \hich\af0\dbch\af52\loch\f0 up\hich\af0\dbch\af52\loch\f0 on the appeal. \par \par \hich\af0\dbch\af52\loch\f0 [21]}{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740 \hich\af0\dbch\af52\loch\f0 }{\f0\fs24\lang2057\langfe1033\langnp2057\insrsid1531740\charrsid1531740 \hich\af0\dbch\af52\loch\f0 I will now discuss with counsel a date of hearing for this appeal. \par
