some time before his death he had been suffering from some sort of kidney ailment. For a period of about 8 days ending about a week before his death he had been an in-patient in hospital. Thereafter he had been confined to bed in his home except for a few
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 
visits to the hospital for out-patient treatment. During his life-time he had engaged with substantial success in farming and business and had fathered 8 sons and 5 daughters all of whom survived him. He died a widower.

nt. That was after the clerk had asked him to "write his name" on the will and the testator had replied that he could not write as his hand was shaky and that he would affix his thumb print instead. The clerk helped the testator to affix his thumb print b
\hich\af0\dbch\af31505\loch\f0 y\hich\af0\dbch\af31505\loch\f0  holding his hand.

, told the court that he had lived with the testator all his life, right up to the time of his death when they were on good terms, "living happily together", although, as he admitted, he had "had an affair with Hari the cobbler}{\rtlch\fcs1 \af0\afs19

ecuted and that "At that time Manbodh did not know what was going on. He could not talk or see and he could hardly drink".
\par \hich\af0\dbch\af31505\loch\f0 He said that he did not believe that Mr. M. T. Khan, the solicitor, had received instructions from the testator to prepare a will as \hich\af0\dbch\af31505\loch\f0 they were not on talking terms.
\par \hich\af0\dbch\af31505\loch\f0 He denied that Shiu Prasad was at the testator}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755

\insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 
s death he noticed that a suitcase in which the testator kept business papers was missing from under his bed (which fact he reported to the police)\hich\af0\dbch\af31505\loch\f0 
 and that when the testator was in hospital the plaintiff Lal Bahadur and others had tried to get the testator to execute a will but had been thwarted by him, Raj Kumar.
\par \hich\af0\dbch\af31505\loch\f0 Maya Wati, one of the plaintiffs}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755

\par \hich\af0\dbch\af31505\loch\f0 She told the court that she was present on an occasion when the testator was an in-patient at the hospital and Lal Bahadur and others called. One of th\hich\af0\dbch\af31505\loch\f0 
em, her uncle Ram Shankar, asked the testator to sign a will. He swore at him, refused to sign and said to Ram Shankar "Why have you brought my son here? You have never come to see me and even when you come you come with documents." Ram Shankar then said 
\hich\af0\dbch\af31505\loch\f0 "\hich\af0\dbch\af31505\loch\f0 Give all your property to your son, whatever you}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 ve got", to which the testator replied "Whatever is left over is for my two younger children Raj Kumar and Dharam Kumar".
\par \hich\af0\dbch\af31505\loch\f0 Maya Wati also said that by the time the testator was discharged from hospital "he wa\hich\af0\dbch\af31505\loch\f0 s sometimes}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid2503552 \hich\af0\dbch\af31505\loch\f0  }{
\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 
intelligible, sometimes barely intelligible" and that the day before his death she had seen him at the hospital (where he had come for out-patient treatment) when he was apparently unable to recognise her.

 also definite, mind you, that she did not first read the will to the testator in English and that she did not say anything at all to him in that language. She remembered that, before she translated the revocation clause, she asked him if he had made a pr
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 
vious will and that he replied that he was revoking whatever wills he had previously made. After she had read out the will in Hindustani, the testator asked her where he should sign it and she then asked}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid291613

s testamentary capacity, the clerk appeared \hich\af0\dbch\af31505\loch\f0 to be in no doubt that he understood and approved of what she read out. After she had read it out to him she asked him if }{\rtlch\fcs1 \af0 \ltrch\fcs0

was correct and he replied that it was. After he had executed it, she asked him if he was happy with the will and he replied that h\hich\af0\dbch\af31505\loch\f0 
e was. In the course of her examination in-chief she said "At the time he executed the will, Manbodh was speaking clearly and rationally and appeared to be quite in possession of his senses. He was sitting in bed". She was impressively unshaken by cross-e
\hich\af0\dbch\af31505\loch\f0 x\hich\af0\dbch\af31505\loch\f0 amination. When it was put to her that the testator was "in his dying moments" when he executed the will she answered, simply, "I don}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 
t know" and when it was put to her that he "did not understand what he was executing" she answered "He definitely appeared\hich\af0\dbch\af31505\loch\f0  to understand - he was saying }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755

\par \hich\af0\dbch\af31505\loch\f0 About 10 minutes after that, the\hich\af0\dbch\af31505\loch\f0 y left the house.
\par \hich\af0\dbch\af31505\loch\f0 She was unable to say whether the defendant, Raj Kumar, or the first witness, Shiu Prasad, were at the testator}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{
\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 s house that day. For that matter, she was unable to identify anyone, apart from herself and the driver, as having been at the\hich\af0\dbch\af31505\loch\f0 
 house that day. However, she remembered that there were 4 or 5 people in the house, some in the sitting room, some in the bedroom, and she thought that there were 2 others present in the bedroom when the will was executed.
\par \hich\af0\dbch\af31505\loch\f0 As I have already remarked, none\hich\af0\dbch\af31505\loch\f0  of Raj Kumar}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 s story of his}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid11481020 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755

\par \hich\af0\dbch\af31505\loch\f0 Nor w\hich\af0\dbch\af31505\loch\f0 as any of that story put to the driver, Ahmed Ali, when he gave evidence.
\par \hich\af0\dbch\af31505\loch\f0 The driver appeared to me to be a mature, stolid and sensible man. He was 46 years of age. He said that the testator was a regular client of the solicitor and that he knew him well.
\par \hich\af0\dbch\af31505\loch\f0 The driver told the court that he and clerk were}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid11481020 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 
\hich\af0\dbch\af31505\loch\f0 driven in a taxi by the plaintiff Shiu Dutt from the solicitor}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0

\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 s face was "bright" and \hich\af0\dbch\af31505\loch\f0 that he smiled. He appeared to recognise the witness. He called for chairs "for the}{\rtlch\fcs1 
\af0\afs19 \ltrch\fcs0 \insrsid11481020 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 solicitor}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755

\hich\af0\dbch\af31505\loch\f0 d and approve of what the clerk read out. The witness said "I}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 m sure Manbodh understood what last witness" (the clerk) "read out to him. He was, in my opinion, in a quite normal state of mind".

\par \hich\af0\dbch\af31505\loch\f0 He was unable to remember whether the clerk had helped the testator to affix his thumb}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid14122573 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 print by holding his hand. However, he was definite that he himself had done no such thing. He said that the clerk had asked \hich\af0\dbch\af31505\loch\f0 
the testator to sign the will whereupon the testator had said he wou}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid14122573 \hich\af0\dbch\af31505\loch\f0 ld affix his thumb print -}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 
\hich\af0\dbch\af31505\loch\f0  the testator did not say anything about his hand being shaky or being unable to sign. (The clerk had said that the testator had said that he could not sign his n\hich\af0\dbch\af31505\loch\f0 ame).
\par \hich\af0\dbch\af31505\loch\f0 Like the clerk, this witness told the court that they remained in the bedroom for a short while after the execution of the will. He said that they conversed with the testator during that period.
\par \hich\af0\dbch\af31505\loch\f0 He remembered the plaintiffs Shiu Dutt and La}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid14122573 \hich\af0\dbch\af31505\loch\f0 l}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 
\hich\af0\dbch\af31505\loch\f0  Bahadur \hich\af0\dbch\af31505\loch\f0 
entering the bedroom before the execution of the will and that they and the first witness Shiu Prasad were present when the will was executed. He was certain that the defendant, Raj Kumar was }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\ul\insrsid289685\charrsid14122573 \hich\af0\dbch\af31505\loch\f0 not}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid14122573 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 
then in the room. That tallies with Shiu Prasad}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 
s evidence. \hich\af0\dbch\af31505\loch\f0 However, Shiu Prasad}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 
\hich\af0\dbch\af31505\loch\f0 
s evidence clashes twice with the testimony of the clerk and the driver. Shiu Prasad said that the clerk read the will in English before explaining it in Hindustani. He also said that the clerk assisted the testator to affix his thumb 
\hich\af0\dbch\af31505\loch\f0 print, by holding his hand, after he had said that he could not sign his name because his hand was shaky. Of course it would not have affected the}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid14122573 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 validity of the will one way or the other if the clerk had in fact first read it out in English or if she had
\hich\af0\dbch\af31505\loch\f0  in fact helped the testator by holding his hand. However, I consi}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid14122573 \hich\af0\dbch\af31505\loch\f0 der it most improbable that she }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 did read the will in English - there was no cause for her to do so.}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid14122573 \hich\af0\dbch\af31505\loch\f0  I }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 suspect that Shiu Prasad was under the impression that wills written in English should f\hich\af0\dbch\af31505\loch\f0 
irst be read out in English and that a convincing explanation was needed as to why the testator affixed his thumb print instead of signing his name and that he tailored his evidence accordingly. I have therefore decided to place no reliance at all upon hi
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0  evidence.
\par \hich\af0\dbch\af31505\loch\f0 I found no such fault in the evidence of 4PW Ram Raju. He appeared to be }{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid1012441\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 independent}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 
\insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0  and objective. His evidence about visiting the testator "at about 12.30 p.m. or 1 p.m." on the day of his death (which must have been after the execution of the\hich\af0\dbch\af31505\loch\f0 
 will) and finding the testator quite alert mentally, capable of conversing sensibly and speaking clearly, was given in a convincing manner and he was unshaken by cross examination.
\par \hich\af0\dbch\af31505\loch\f0 In my view, the driver}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 
s evidence tallied well enough with that of the cle\hich\af0\dbch\af31505\loch\f0 
rk, considering the fact that they were speaking of events which had occured over 5 years previously. Such discrepancies as there were seemed to me to be understandable and also to show that there had not been the putting together of heads by those two wi
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 nesses which one would have expected had they been parties to the outrage recounted by Raj Kumar. They appeared to be quite independant. I was favourably impressed by their demeanour.
\par \hich\af0\dbch\af31505\loch\f0 Their evidence about the testator}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid3431755\charrsid3431755 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs19 \ltrch\fcs0 \insrsid289685\charrsid3431755 
\hich\af0\dbch\af31505\loch\f0 s mental condition was convincingly su\hich\af0\dbch\af31505\loch\f0 pported by that of the fourth witness, Ram Raju, who, as I have said, appeared to be independent and objective.
