 prosecution witness in the identification of the appellant. He rejected the unsworn evidence of the first prosecution witness, a child of tender years. He should never have admitted it, at least not without conducting a }{\rtlch\fcs1 \af0 \ltrch\fcs0

\hich\af0\dbch\af31505\loch\f0 the other for dangerous driving, in April 1982, and faced serious consequences if found driving }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7030147 \hich\af0\dbch\af31505\loch\f0 by the police. Under the circumstance }{

\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10033662 \hich\af0\dbch\af31505\loch\f0 The fourth prosecution witness failed to attend court. He was eventually punished for non-attendance. He at first testified that he ha\hich\af0\dbch\af31505\loch\f0 
d part-observed the accident. "I saw the driver Suresh," he said, "I recognized motor cyclist it must have been him, it was very far. I did not pay much attention." }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14843436 \hich\af0\dbch\af31505\loch\f0 
Then he said that "I have known the accused for 5-6 years I recognized motor bike not perso\hich\af0\dbch\af31505\loch\f0 n driving." Thereafter the witness was declared hostile on the basis of a previous inconsistent statement }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid6965488 \hich\af0\dbch\af31505\loch\f0 to the police. On that basis the learned trial magistrate rejected his evidence.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10033662

a pre-conceived notion of the manner in which the fourth prosecution witness might give his evidence, due no doubt to the unreliability of the evidence of some of the witnesses, and the fact that the particular witness had failed to attend court. T
\hich\af0\dbch\af31505\loch\f0 hat may well be. The point is however that the magistrate's prediction turned out to be an accurate one: the witness was declared }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12413521 \hich\af0\dbch\af31505\loch\f0 
hostile. No doubt the learned trial magistrate should have resisted any pre-conceived notion and should certainly not have giv\hich\af0\dbch\af31505\loch\f0 en expression thereto. Nonetheless, I do not see that any miscarriage of justice arose thereby.}{

Thereafter further questions on such relationship were asked. Even if it is the case that the witn\hich\af0\dbch\af31505\loch\f0 ess did tell a lie, the nature of any such lie }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16255202 \hich\af0\dbch\af31505\loch\f0 
was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13311077\charrsid11369986 \hich\af0\dbch\af31505\loch\f0 
not determined, so I do not see that his whole evidence was thereby undermined. Apart from the police officers, he was easily the most impressive witness at the trial and the learned trial magistrate clearly f\hich\af0\dbch\af31505\loch\f0 
ound him so. The judgment reads:

\ltrch\fcs0 \insrsid9903661 \hich\af0\dbch\af31505\loch\f0 he record whether the witness sa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13311077\charrsid11369986 \hich\af0\dbch\af31505\loch\f0 w the appellant at the scene of the accident. He did however, }{

ed him, "Saw him first, where were you?" it appears then that the witness saw the appellant not once, but twice, either twice on the roadway as he passed, or once on the roadway and again at the scene of the accident. In any event, despite the fact that t

rake and slow down to offer a complete stranger a lift on his cycle. Again, the learned trial magistrate was fully conscious of the \hich\af0\dbch\af31505\loch\f0 possibility of mistake}{\rtlch\fcs1 \af0 \ltrch\fcs0

\insrsid7222241 \hich\af0\dbch\af31505\loch\f0 th alacrity. Any such evidence s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13311077\charrsid11369986 \hich\af0\dbch\af31505\loch\f0 hould have been immediately available on the}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid12720951 \hich\af0\dbch\af31505\loch\f0  date when the application was m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7222241 \hich\af0\dbch\af31505\loch\f0 ade and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13311077\charrsid11369986 
\hich\af0\dbch\af31505\loch\f0 at the further adjourned hearing. There was in any event a failure }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7222241 \hich\af0\dbch\af31505\loch\f0 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7605663 \hich\af0\dbch\af31505\loch\f0

\hich\af0\dbch\af31505\loch\f0  judgment falls far short of being a model of perfection. It is in places couched in terms which, in my view, have no place in the judgment\hich\af0\dbch\af31505\loch\f0  of any court. Again the learned trial magistrate ind}

hich did not serve his purpose and in observations which were largely irrelevant. In the circumstances}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7222241 \hich\af0\dbch\af31505\loch\f0  of the case h}{\rtlch\fcs1 \af0 \ltrch\fcs0

\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13311077\charrsid11369986 \hich\af0\dbch\af31505\loch\f0 difficulties there is very much in evidence his d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7431584 \hich\af0\dbch\af31505\loch\f0 
esire to establish the truth. H}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13311077\charrsid11369986 \hich\af0\dbch\af31505\loch\f0 aving been presented with prosecution evidence whi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7431584 \hich\af0\dbch\af31505\loch\f0 
ch was contradictory a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13311077\charrsid11369986 \hich\af0\dbch\af31505\loch\f0 nd vague in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7431584 \hich\af0\dbch\af31505\loch\f0  places and hostile in another, }{\rtlch\fcs1
