e provisions of Section 65(5) shows that such a requirement is necessary. With that argument I cannot agree. In fact, on the contrary it can be argued that since the proviso to Section 65(5) only makes provision for representations from existing licencees
 
where there is a substantial alteration, no representations are necessary in other circumstances or from other parties. It might have been wiser and fairer for the Board to have given an indication of what it was proposing to do and have given the other a
p
plicants an opportunity of making oral submissions, but there was no obligation on it to have done so, and its omission to do so is no ground for setting aside its decision, or granting the applicant the order asked for. Thus in respect of Civil Action 35
7 of 1982 the applicatio}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9204475 n }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1643448\charrsid10969696 is dismissed with costs to be taxed if not agreed.

\par The applicant is a competing operator and claims to be seriously affected by the decision of the Board, which it asks the court to declare null and void.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4065297 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1643448\charrsid10969696

authorised, the improvement of the timetable or frequency of service, or in any other manner, as the Board considers desirable in the public interest.

\par However the Board seems to have taken the view and still takes the view }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4075472 -}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1643448\charrsid10969696  that it}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4285174 
 could act entirely on its own mo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1643448\charrsid10969696 
tion without notifying anyone, and without hearing objections. And it bases its opinion on its own interpretation of Section 72. Section 72 certainly gives the Board power to seek to amend a licence by its own motion,
 but I cannot agree that this means anymore than that the Board does not have to await an application by any other party, but may itself initiate proceedings.

There is lastly a matter on which I wish to comment. At first the Attorney General appeared on behalf of the Board. But following a case heard in the Supreme Court, Suva the Attorney General sought leave to withdraw as counsel for the Board but }{
