The parties are all cane farmers. The Begg Family live a little beyond the farm of the plaintiff. The Begg Family contend that their only access to get to their farm from the Governmen

\par The Begg Family say there is no other road they can use to get from their farm to Labasa Town or to a mosque where the family worship.

The precise position of the strip of land used as a road alleged by the plaintiff to be within the bounda
ries of his lease is in doubt and I will refer to the evidence on this later. At this stage I can state that the strip of the road is not in the position shown by the plaintiff in the plan annexed to his Statement of Claim. The Surveyor, Mr. David East, c

\par In February 1974 the plaintiff commenced a Supreme Court Action No. 53 of 1974 against 9 defendants claiming damages for trespass
. The said Jahur Begg was one of the defendants and defendants Nos. 2 to 5 inclusive in this action were four of the 9 defendants.

to Court by taking the proper steps to resume the area for}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8195495  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 the use of the public as a public road.
\par The evidence before me indicates that the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8195495  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 strip of land has been used by the general public for many years and is now used by vehicular traffic.

\ltrch\fcs0 \insrsid4611266\charrsid14754468 survey was in 1978 by the Lands Department.

\insrsid4611266\charrsid14754468 Lots 22, 23 and 24.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14754468\charrsid14754468  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 If Mr. East made these marks on the}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid5528219  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 photo he should have been asked about them.
\par The only use I can find for the photo is confirmation of Mr. East}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14754468\charrsid14754468 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 s statement that the road does not run across the plaintif}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14754468\charrsid14754468 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1654874 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 
s land as the plaintiff pleaded but runs along the boundary. That however was in 1974.

\par Under cross examination he denied that there was a road on his land before he first moved onto the land. He alleged that previously road went through his neighbour Binessari}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14754468\charrsid14754468 '}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 s land and when Binessari fenced his land the Begg Family used his land.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid6303959 Salim Begg, the second defendant said his deceased brother, Jahur Begg, was the first Indian}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 
 to take up land in that area. The witness used to visit his brother and the road he used was the one in dispute. The plaintiff was not then living on the land he now occupies but on Binessari}{\rtlch\fcs1 \af0 \ltrch\fcs0

\par Mr. Maharaj also confirmed that the road had been in use long before the plaintiff obtained his lease.

evidence as to the number of times they have trespassed but it was on more than one occasion. The 2nd to 4th defendants have trespassed notwithstanding the injunction affecting them.

ali and the Native Land Trust Board.

As to the first allegation the "landowners" are not owners of the land in the legal sense and cannot purport to deal with alienated native land.

attempt to resume part of the leasehold but no evidence of any other moves by the Board to provide proper access for its tenants.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid7687112 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 
The situation is a potentially explosive one which could lead to bloodshed. The plaintiff has singled out the Begg Family while apparently permitting the public}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7687112  }{\rtlch\fcs1 \af0 \ltrch\fcs0

\insrsid7687112  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 the strip is the only access for the Begg Family and if he succeeds that access will be blocked in addition to access to their mosque.
\par The remedy lies in the hands of the Board. They have power to resume land for the road and should do so urgently to avoid trouble in the area escalating.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5116980 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 
The plaintiff was not an impressive witness and I do not consider he was truthful about the origins of the road which I am satisfied was in existence long before he}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5116980  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid4611266\charrsid14754468 came on the land.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14754468\charrsid14754468  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 Whatever the nature of the dispute he}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid5116980  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 has shown he is a stubborn man and determined to enforce his legal rights come what may.
\par The defendants pleaded also that the road is now a public road within the provisions of the Road Act and is known as Nabekavu No. 1.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid9378104 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 Road }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9378104 C}{

this sense is not a formal dedication but the person who has capacity to dedicate has either said by so many words or so conducted himself as to lead the public to infer that he meant to say, that he was intending that 
the public should have the right of passage. From the moment the public have accepted the dedicated way, by user, there is a right of passage by the public.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10581753 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 
A lessee cannot however dedicate land as a public road without the consent of the owner of the freehold}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10581753  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4611266\charrsid14754468 (}{\rtlch\fcs1 \af0 \ltrch\fcs0

\par Their conduct justifies a higher award than that fixed by the Magistrate in 1976 of $10 damages.
\par I award the plaintiff damages of $50 each as against each of the seven defendants (Nos. 2 to 8). I do not accept that the plaintiff suffered any other loss or damage and in particular the alleged special damages for 
loss of use of the land. He has not used more than half the area of his land and has clearly permitted others to use the road without protest.
