rate on the 30th March, 1981. The Labasa Police were enquiring about the matter at the request of the Registrar of the Supreme Court. This request followed the forwarding by the Chief Magistrate of the Labasa Magistrate Court file in Maintenance Case No.

\par \hich\af0\dbch\af31505\loch\f0 There is no suggestion that there has been any failure by the Chief Registrar or the Commission to follow the disciplinary pro\hich\af0\dbch\af31505\loch\f0 cedure provided by the regulations.
\par \hich\af0\dbch\af31505\loch\f0 The sole issue before me is a legal one and that is whether disciplinary proceedings can lawfully be brought against an employee who has been charged with and acquitted of criminal offences relating to or arising out fai
\hich\af0\dbch\af31505\loch\f0 lure by the applicant to execute two warrants.

\par \hich\af0\dbch\af31505\loch\f0 What the Commission should not }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 do, after an acquittal, is to frame charges against the}{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 
\insrsid2177423 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 employee based on the same facts which gave rise to his prosecution.
\par \hich\af0\dbch\af31505\loch\f0 The applicant in the instant case was acquitted of }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid4542419\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 perjury that}{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 
\insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0  is an offence in \hich\af0\dbch\af31505\loch\f0 
laymans language of telling lies on oath. Two of the four charges preferred against the applicant by the Registrar appear to be framed so as to allege similar untrue facts to those which the applicant may have stated to the Magistrate.
\par \hich\af0\dbch\af31505\loch\f0 Basically what the a\hich\af0\dbch\af31505\loch\f0 pplicant was alleged to have done was to wilfully fail to execute Warrants 18/78 and 178/78. The Registrar should not have been concerned about any lies he may have told the
}{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid1340906 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 Magistrate but whether the facts established the}{\rtlch\fcs1 
\af0\afs25 \ltrch\fcs0 \insrsid1340906 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 charges. This involved the Commis\hich\af0\dbch\af31505\loch\f0 
sion being satisfied }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 he did }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 not execute t}{\rtlch\fcs1

\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 that the applicant ha\hich\af0\dbch\af31505\loch\f0 
d lied to the Magistrate because the Magistrate found as a fact that he had done so.
\par \hich\af0\dbch\af31505\loch\f0 I do not consider the charges were based on the same facts giving rise to the charges of perjury but references on those charges to dishonest statements by the applicant a\hich\af0\dbch\af31505\loch\f0 
re highly prejudicial and were quite unnecessary to describe the offences. Two separate disciplinary offences are included in each char}{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid7409478 \hich\af0\dbch\af31505\loch\f0 g}{\rtlch\fcs1 \af0\afs25 
\ltrch\fcs0 \insrsid3945542\charrsid12543869 \hich\af0\dbch\af31505\loch\f0 e and are not stated to be in the alternative.

\par \hich\af0\dbch\af31505\loch\f0 One reason, but not the major one, is that the legislature provides a procedure which is intended to be followed. Section 14 of the Act provides for an Appeal in terms which indic\hich\af0\dbch\af31505\loch\f0
