s required is consideration of and interpretation of the relevant road service licence conditions and a declaration thereon based on the facts before the Court.
\par \hich\af0\dbch\af31505\loch\f0 Counsel agreed to this suggestion.
\par \hich\af0\dbch\af31505\loch\f0 At the time these proceedings commenced, the two plaintiffs \hich\af0\dbch\af31505\loch\f0 
were 11 and 9 years of age respectively. They attend the Gospel Primary School in Dhanji Street, Samabula. They are taken to school in the mornings by one of their parents. In the afternoons after school, the two children walk from their school to a bus s
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 op opposite the }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 Calvary }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12412076\charrsid265096 
\hich\af0\dbch\af31505\loch\f0 Temple near the Samabula Police Station and board the 3.45pm bus owned by the Tacirua Transport Co. Ltd. to travel to Tamavua. This company employs the two defendants. The driver of one of the company}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid265096\charrsid265096 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 s buses, the second defendant, \hich\af0\dbch\af31505\loch\f0 
has despite complaints by Mr. }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 Maharaj, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 
been demanding and collecting 23 cents each from the two plaintiffs for the journey from where they board the bus to where they alight at Tamavua village Wailoku road bus stop.
\par \hich\af0\dbch\af31505\loch\f0 The plaintiffs contend the proper and la\hich\af0\dbch\af31505\loch\f0 wful fare is 14 cents for }{\rtlch\fcs1 \af0\afs25 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 each of }{\rtlch\fcs1 \af0

\par \hich\af0\dbch\af31505\loch\f0 The difficulty I have experienced in this action is to determine what conditions are applicable.
\par \hich\af0\dbch\af31505\loch\f0 There appears to be two sets of conditions.
\par \hich\af0\dbch\af31505\loch\f0 Mr. Maharaj\hich\af0\dbch\af31505\loch\f0 
 in his original affidavit filed in support of the application annexed what purports to be a copy of the relevant road service licence which has conditions stated thereon. The conditions refer to two}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15207718 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 annexures to the licence.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid265096 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0

\par \hich\af0\dbch\af31505\loch\f0 Condition 6 in No. 1 however does not \hich\af0\dbch\af31505\loch\f0 
state what the school fares actually are when children travel to schools not serviced by a school bus. In No.1 condition 5 students in uniform pay half fore.
\par \hich\af0\dbch\af31505\loch\f0 In condition 6 in No.2 school fares are determined by the schedules of fares to which No. 2 it ann\hich\af0\dbch\af31505\loch\f0 exed.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5067215 \hich\af0\dbch\af31505\loch\f0 So fa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 
r as the plaintiffs are concerned, it does not matter which set of conditions is considered. They are entitled to travel to and from school, when in school uniform, for less than the adult fare. The only fare specified is half adult fare.
\par \hich\af0\dbch\af31505\loch\f0 Condit\hich\af0\dbch\af31505\loch\f0 ion 4 can be construed so as not to conflict with the other conditions. All children of or over 5 and under 12 years of age pay }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5067215 
\hich\af0\dbch\af31505\loch\f0 2/3}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0  of adult fare for the journey. Students under 12 and those over 12 if in uniform on school days and travelling to and from s
\hich\af0\dbch\af31505\loch\f0 chool in a school bus pay school bus fares. Where no school bus fares are specified in a schedule the fare is half the adult fare.
\par \hich\af0\dbch\af31505\loch\f0 I am satisfied plaintiffs are unable to catch a school bus operated by the Tacirua Transport Co. Ltd., which departs from Mar\hich\af0\dbch\af31505\loch\f0 
is Brothers High School at 3.15pm on school days as they come out of school at 3.30pm daily.
\par }{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \insrsid12412076\charrsid265096 \hich\af0\dbch\af31505\loch\f0 Condition 7 in No. 2 appears to be in conflict with conditions }{\rtlch\fcs1 \ab\af0\afs21 \ltrch\fcs0 \insrsid12412076\charrsid265096
