\par \hich\af0\dbch\af31505\loch\f0 On 14.6.77 the plaintiff took delivery of a rice hulling machine from the defendants, a large firm with \hich\af0\dbch\af31505\loch\f0 
branches thoughout Fiji engaged in the sale and supply of motor/vehicles, and other machinery. The agreed price was $1700.00 and the plaintiff paid $818.00 cash and the balance was covered by a bill of sale.

machine broke down in that the screen broke. The defendant explains that the cylinder shaft wa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7175667 \hich\af0\dbch\af31505\loch\f0 s }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5574086 \hich\af0\dbch\af31505\loch\f0 
bent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1142525\charrsid12272219 \hich\af0\dbch\af31505\loch\f0  and was replaced by a new shaft.

The screen broke again. The plaintiff complained 9 times by \hich\af0\dbch\af31505\loch\f0 phone and 3 times in person. Two new screens were fitted but broke.

e was properly repaired. No one came to effect repairs for 4 months. On the 4th month the defendants re-possessed it for non-payment of the instalments under the Bill of Sale. By that time the plaintiff had told the defendants that he did not want it and 
\hich\af0\dbch\af31505\loch\f0 p\hich\af0\dbch\af31505\loch\f0 urchased another elsewhere.

to fulfill the conditions under S.17(a)}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12272219\charrsid12272219 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1142525\charrsid12272219 \hich\af0\dbch\af31505\loch\f0 (b) which they}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12350606 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1142525\charrsid12272219 \hich\af0\dbch\af31505\loch\f0 
failed to do. When on October 14th 1977 they came to try and remedy the defects the machine had already been rejected.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid8918640 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1142525\charrsid12272219 \hich\af0\dbch\af31505\loch\f0 Acceptance was conditiona
\hich\af0\dbch\af31505\loch\f0 l on the machine being workable and the plaintiff was entitled to reject it within a reasonable time and he did so.
\par \hich\af0\dbch\af31505\loch\f0 It is immaterial whether the conditions under S.17(a) & (b) had sunk to the level of warranties because the appellants have re-possessed the\hich\af0\dbch\af31505\loch\f0 
 machine. Consequently the only issue is whether the plaintiff had received what he was entitled to under the contract. He had not and h}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8918640 \hich\af0\dbch\af31505\loch\f0 e}{\rtlch\fcs1 \af0 \ltrch\fcs0
