\par It is in my view significant for reasons which will appear later that no objection was received from the Airline Management Staff Association (AMSA), an Association }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11091044 w}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid599637\charrsid15605673 hich was registered on the 10th April, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3418212 1980, despite strong }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 
objections from the said Air Pacific Employees Association and the Federated Airline Staff Association.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3418212 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 
The Registrar in compliance with section 3(5) of the Act consulted the Trade Unions Advisory Committee on the 1st July, 1980, and received advice from that Committee that the Association}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15605673\charrsid15605673 '}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 s application should be refused for the same reasons as the Registrar gave to the appellant association in his letter dated the 2nd July, 1980, which states as follows:

\insrsid3418212 on has some 13 alleged grounds o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 f appeal. As Mr. Gardiner, the Registrar, has pointed out in his affidavit, a large number of the statements by}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid3418212  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid3418212 Mr}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 . L.H. Morris, the Appellant Association}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15605673\charrsid15605673 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 s President,}{\rtlch\fcs1 \af0 \ltrch\fcs0

\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 Seeking to find the Appellant Association}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15605673\charrsid15605673 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 s main ground of a
ppeal is not easy as many of the alleged grounds are arguments. There is one ground and that is the ground provided by section 16(1) of the Act.
\par The Appellant Association is aggrieved by the Registrar}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15605673\charrsid15605673 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 s refusal to register the Association and it is contended that he }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4276379 erred in so doing on the ground}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 s that the Airline}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4276379  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid599637\charrsid15605673 Management Staff Association}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4276379  "is adequately representative o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 f the whole }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15605673\charrsid15605673 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 or a substantial proportion of the interests respect of which the applicant seeks registration".
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2649227 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 In Action 196 of 1980 bet
ween the Federated Airline Staff Association and Registrar of Trade Unions and Another, the plaintiff in that action unsuccessfully sought to restrain the Registrar from registering AMSA. In that action I considered section 13 of the Act and expressed my 
view, to which I still adhere that the word }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15605673\charrsid15605673 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 may" in subsection 1 of that section was not permissive}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid2649227  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 but an enabling expression.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15605673  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2649227 I further expressed the view }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 
that, if the facts are such as to satisfy the Registrar that any of paragraphs (a) to (g) both inclusive of section}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid2649227  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 13 have application, he is obligated to refuse registration. I do not therefore have to consider the exercise by the}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid2649227  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 Registrar of any discretion but only whether his refusal to register the Union was justified.}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid599637\charrsid2649227 
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12976989 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 The issue I consider is not 
a difficult one to resolve. Either ANSA, which is presently registered under the Act, is adequatel}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2649227 y representative of the whole }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 
or a substantial proportion of the interests in respect of which the appellant Association seeks registration or}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12976989  it }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 is not.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15605673  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 
If it is, the R}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8270259 egistrar acted properly but if i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 t is not he erred.}{\rtlch\fcs1

Before considering the facts on this issue I would state that I have perused the authorities referred to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8270259  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 
by Mr. Lela and Mr. Rabo. Both counsel have done quite a lot}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8270259  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 of}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8270259  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8270259  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 research but the issue I have to consider is as}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8270259  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid3167227 I have s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673 tated not a difficult one. Many of the Australian cases. 
Mr.-Lala referred to dealing with appeals from the refusal of a Registrar to register an association are not of very much -assistance because the wording of section 59 of the Australian Commonwealth Constitution and Arbitration Act 1904 \emdash 
1934 differs from s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8270259 ection 13(1)(9) of our Act very }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid599637\charrsid15605673

\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14880188 There are som}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 e 51 senior airline staff all employed by Air Pacific Ltd. who could be but are not members of A.}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid14880188 M}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673 .S.A. because they have no desire to join A.M.S.A.
\par Those simple facts disclose that A.M.S.A. is quite capable of but is not presently adequately representative}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14880188  of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid599637\charrsid15605673
