\insrsid229124\charrsid795759  was a write-off result of the collision. It was an old vessel and suffered }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1668941\charrsid795759 extensively}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
. It would be completely }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1668941\charrsid795759 impracticable}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  to repair it.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid1668941 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 The issues between the parties are the basis for the }{

\insrsid229124\charrsid795759 ould place the plaintiffs in the same position that they have been had they suffered no wrong. Counsel submitted the way to achieve this was for the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15287766 p}{\rtlch\fcs1 \af0

Both the plaintiffs and the defendants called expert evidence as to the pre-accident value of the boat, the cost of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3299901\charrsid795759 repairs}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
 and the cost of replacement. But unfortunately there}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3299901  was}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  little common ground between the two sets of valuation }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid3299901\charrsid795759 provided}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 .
\par The plaintiffs}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  witnesses variously maintained that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12262336 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 e vessel was worth about $30,000 and about $35,000 before the collision but that that valuation was inclusive of the engine. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12262336 The }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 engine itself was valued at between $5,000 and $7,000. The nett worth of the vessel without the engine, which was not damaged, was therefore according to the plaintiffs}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  witnesses, between $23,000 and $30,000, a very wide diversion of value in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12262336\charrsid795759 itself}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid229124\charrsid795759 .
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3858 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Defence witness No. 1 was a consultant marine engineer }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3858 and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 he expressed a very different view. In his estimation the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3858 p}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 re-accident value of the boat was only $11,750 (exclusive of the engine).
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid13727625 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 On the question of the cost of repairing the boat the }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11892408 e}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 xperts were also divided. PW.1 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11892408 old me that the estimated cost of }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 repairs (in 1980) woul}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11892408 d be $35,220 after which the boa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11892408  (without}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  an engine) would be worth about $35,000 i.e. less than the cost of the repairs. That it 
would cost more to repair the vessel than it would end up being worth was not disputed by the defence. The defence expert did not give a figure for the cost}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13727625  o}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 f repairing the boat although he did claim that plaintiffs}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  estimates were exaggerated, but in his
 view the cost of replacement would only be $29 400, a much lower figure than that claimed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9897208  by}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  the plaintiffs.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid481288 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 The problem of the conflicting evidence of experts}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid9897208  is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 not a new one. It has been observed (Phipson on Evidence, 12th Edn}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9897208 . }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 para. 1227) that the testimony of experts "is often considered to be of slight value since they are proverbially, though perhaps unwittingly, biased in favour of the side that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11882346 
 calls}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  them". Be that as it may, a court in a case such as this}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11882346  cannot }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
do without their evidence and must }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11882346\charrsid795759 endeavor}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  to arrive}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11882346  at }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid229124\charrsid795759 a valuation which accurately reflects the balance of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid481288  probabilities}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 .

\insrsid229124\charrsid795759  was only 42.17 ft. long) they only paid $10,000 for he }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Ramada}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  which it was admitted by the plaintiffs was}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4130397  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
extremely cheap. The }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Ramada}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 , like the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Jubilee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid229124\charrsid795759  is a wooden passenger and cargo vessel. It was much newer at the time of purchase than the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 Jubilee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  was at the time of the collision. It seems to me that the price paid for the }{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Ramada}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
 must affect my opinion of the worth of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Jubilee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid229124\charrsid795759  before the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4130397  co}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 llision. On the other hand, the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4130397 defence}{

nsurance value of similar vessel may be a helpful indicator }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5587883 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 f value, it is by no means conclusive. Although the }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2053417 defence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15280105  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2053417 wit}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 ness had given a detailed account of how he had arrived at }{

\par The two remaining issues to be decided are the value the lifeboat which was also destroyed and the question of the loss of operating profit.

replacement cost would be $1,500. Again, it was agreed that the lifeboat was a write-off but again the evidence of the defence expert was quite different from that of the plaintiffs. The defence expert valued the boat prior to i
ts destruction at $280 with its replacement cost put at $700. In view of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
principles of assessment already set out above I find that the market value of the boat prior to its destruction is the relevant figure I have to consider. Although the evidence was somewhat }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16061025 s}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid229124\charrsid795759 c}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16061025 an}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 ty, I accept the only evidence of pre-accident value given }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid16061025 to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  me namely, $280 and fix that sum as the damages recoverable }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16061025 by }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
the plaintiffs under this head.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid6690961 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 The next matter for consideration is the question of }{

\insrsid229124\charrsid795759 Exhibit B lodged by the plaintiffs. Defence counsel pointed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid263955  out }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
that the plaintiffs did not attempt to buy a replacement}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid263955  vessel }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 and that the vessels hired in its place were, it was }{\rtlch\fcs1 \af0 \ltrch\fcs0

vessels is an additional cost which the plaintiffs have }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1583307 been }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 forced to bear because of the loss of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Jubilee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1583307  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 However, I had no}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid1583307  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
evidence on this point. I can find no authority for the proposition that the plaintiffs are automatically entitled to claim the profit on 6 months loss of operations. As defence counsel pointed out, loss which is }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid16022772 r}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
ecoverable, if it is proved, is that unavoidable loss which resulted despite all reasonable efforts to mitigate on the part plaintiffs. I do not find any evidence of attempted successful mitigation before me at all. On the other hand,}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid6690961  it}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  seems reasonable to allow the plaintiffs some time to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6690961  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
arrange a replacement for their lost vessel. I was told that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6690961  the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Ramada}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  was purchased one month after the collision. I}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6690961  take }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid229124\charrsid795759 the view that although it was not a precise replacement,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15168884  being}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 
 a rather larger vessel, nevertheless it effectively took the place o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15168884 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759  the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 Jubilee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid795759\charrsid795759 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid229124\charrsid795759 . I see nothing wrong with, the basis }{\rtlch\fcs1 \af0
