tional to that contained in his affidavit filed in reply to the affidavits filed by the two plaintiffs in support of their application.
\par The plaintiffs did not call any witnesses and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926754 relied on affidavits already }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9841920\charrsid2122769 filed by them.
\par One issue which must first be decided, is whether the second plaintiff, Mr. Koresi Matatolu, was at the relevant time General Secretary of the National Union of Electricity Workers which I will hereinafter refer to as }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid4021210\charrsid2122769 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9841920\charrsid2122769 the Union}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4021210\charrsid2122769 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9841920\charrsid2122769 .

\insrsid871519\charrsid2122769 evidence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9841920\charrsid2122769  in chief Mr. Deo Ram said Mr. Matatolu was an adviser of the Union. Under cross\_
examination he at first said Mr. Matatalu was acting secretary on the 19th August, 1980 but later had to admit that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid871519  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9841920\charrsid2122769 Mr. Matatolu was elected sec
retary unopposed at the meeting held on the 26th April, 1980.

\par It would have assisted the Court if the minutes of the last Annual General Meetin}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3696878 g}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9841920\charrsid2122769  of the Union held on the 26th }{\rtlch\fcs1 \af0 \ltrch\fcs0

 it is clear that 7 members of the committee did foregather at Lautoka, whether for an executive meeting called by the plaintiffs or to take action to dismiss the plaintiffs is immaterial. They were debarred by the second plaintiff from using th}{
