 Only the first plaintiff is mentioned by name and his position in the Club and that is only to advise readers that he was not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2980654 available}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9197893 
 for comment. The five meanings the plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8271572 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9197893  allege the photographs and words}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2980654  bear all refer t

\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid150537 I do not consider}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16273364  that any reasonable person, if he considered t
he publication bore any meaning other than the plain meaning it bears, would understand it to refer to any one or more of the plaintiffs personally. He would certainly understand it to refer}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2048294 
 to some irresponsible members of the Club.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9073194  He would also understand that the Club was accused of supplying }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6031008 liquor}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9073194

\ltrch\fcs0 \insrsid2782202  told him that if the article was true something had to be done by the Committee.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9389090

 Education Officer and brother of the fifth plaintiff and now a member}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15217776  of the Club. When he saw and read the article he }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8481856 was}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15217776  not a member. He knew some of the Committee members. To the Court he said he did not believe the story and th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3227336 at he checked with the 
President and Secretary. He was of the opinion that if the story was true it reflected on the Secretary as he had the day to day running if the Club. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10431108 
In answer to Mr. Pillai he said the story reflected on the Club's management.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid275083 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5395670 Another witness for the plaintiff, Mr. Narayan Kurup of Suva testified that he knew 3 or 4 committee members of the Navua Club of which he was not a member}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1013417 
. He had read the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid409761  article and considered that if it was true that the Committee was not fit to run the Club.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5395670

 imputed either unbecoming conduct by a member or members of the Club and/or indicated laxity primarily by the Secretary and probably the Committee responsible for the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8603648 management of the Club}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid7279320  if it is assumed the plaintiffs must have been aware of the situation.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid409761

\insrsid8406512  referred to any specific }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5253399 plaintiff }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8406512 or the very rea}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5253399 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8406512 on, I believe, that the article did not refer to any plaintiff and was not capable of exposing any of them }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5253399 personally to "hatred, contempt or ridicule"}{\rtlch\fcs1 \af0 \ltrch\fcs0

rs before the article appeared in the 'Sun' the Club sold liquor to non-members. I accept the evidence of Leone Mataitini, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3567956 a villager from Lobau 4 miles}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15222252 
 from Navua. He has never been a member of the Club. He testified that for more than six years he used to go into }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7566718 
the Club with his football mates every Saturday. He said they used to just walk in and go upstairs and drink. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3815477 He said if there were a lot of members there they drank downstairs but it was usually upstairs.}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4857572  He said there were no toilets downstairs and they used to relieve themselves outside. He admitted he was the person on the first page of the 'Sunday Sun' urinating from the bottom terrace of the Club premise.}

\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8795775 Nacanieli Lino was another }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1512311 Fijian villager who was not a member of the Club. He confirmed Leone Mataitini's evidence that}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid13772870  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1512311 non-members drank upstairs and would drink downstai}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13772870 rs if the Club was full upstairs. He
 said there was no toilet downstairs and people drinking downstairs would}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7234717  relieve}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13772870  themselves in the open area. Under cross-examination he }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid7234717 said}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13772870  that on 23rd June}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7234717  (it would be 1979) he had himself urinated in broad daylight where public could see him. He }{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid14107737 just turned his back on the public and went about his business of urinating.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14287031 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8391080 I find as a fact that the Club had for some time prior to the 24th June, 1979 been selling liquor to non-members who drank o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13332382 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8391080  the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13332382 Cl}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8391080 ub premises. I also find as a fact that people 
drinking downstairs, in view of the public were seen urinating and in doing so they would have to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13332382 expose}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8391080  themselves}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid13332382 . I have considered, but reject, the evidence of the plaintiffs that because of fences and the area where people were said to urinate it was not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4540830 
 possible for the public to see people urinating on the Club premises.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14107737

\insrsid9468939 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16464494 o have a right to be on the premises drinking are members of the Cl}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4025808 ub.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1198051
