\insrsid11228065 . It was a glancing blow. The P.W}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9921187 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11228065 's claimed to be on their correct side and that the taxi veered to their side and its }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid2181340 rear bumper scraped along the side of their car and carried on without stopping. The taxi was not driving at a high speed. P.W.1 turned and pursued it and noted its number as AB}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14887255  }
{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2181340 336}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14887255  and that it contained children.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5837620 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9003409 P.W.2 noted the number AB 336, the make and colour of the taxi describing it as a white Ford Falcon; he also observed that the passengers included an Indian women and
 children. In cross examination he stated that the words "Tavolea Cabs" appeared on the door.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14887255 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9003409 P.W.1 tried to get the taxi to stop put he did not succeed and overtook it and reported to the police at Ba.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2324307 The defence evidence was an alibi in which the accused admitted being the driver of a white }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11354982 Falcon}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2324307 
 Taxi AB 336 on the day in question; that he}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11354982  had been }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2895350 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11354982 o Tavu}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15539626 a}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11354982  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15539626 and returned from Tavua to Lautoka }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10373154 therefore}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15539626 
 following the same route as the offending }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10373154 vehicle}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15539626 , and that the taxi bore the name}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10373154  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid15539626 Tovolea Cab. He also had his Indian wife and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10373154 children in the taxi. In all those respects the defence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11354982  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid10373154 evidence was not in conflict with the prosecution. However, the accused said that he left Tavua}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12218232  about 6.30 p.m. arriving at Lautoka at 8.00 p.m., }{\rtlch\fcs1 \af0 \ltrch\fcs0

 when the alleged incident occurred. D.W. 2 stated that he was with the accused in Lautoka drinking the evening}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14160506 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9003409

he learned magistrate arrived at a finding of careless driving on the fats he had found proved and I would hesitate to express the view that he was in error.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13633817

 it also sets out the action he must take when he stops}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5275181 . One cannot say }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15542875 that subsection one which imposes a duty, the 
contravention of which constitutes an offence, does}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13201979  not help to create the offence. If no duty were impose}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8672439 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13201979 
 by subsection one then it could not be contravened.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8527946 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8672439 
Section 43(4)(b) does indicate that an offence is created by failing to comply with section 43(1) and it sets out the penalty. But I cannot accept that an omission to refer to subsection (4) (b) makes the charge a nullity. Indeed it is incorrect to say th
at the count refers to the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5592863 wrong section because the offence does come under section 43.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8672439  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7023787  The offence}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5592863 s that the accused, contrary to the requirement of section 43(1), failed to stop, and that is what is alleged in Count III}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid409031 . Section 43(4)(b) does not create
 any duty therefore one cannot contravene it.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8672439 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid409031 Mr. Sahu Khan}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid865800  contended that Section 43(1) created 2 offences as set out in (a) & (b) there \endash  of one being referable to }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2044178 personal injury and the other (b) referring to damage}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5602816  where there is no personal injury. But (a) and (b) are not drafted as separate paragraphs, they are not even separate }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid12877454 sentences}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5602816 ;}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12877454  in fact the whole of subsection one is contained in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5657851 
a single sentence. It imposes the same duty on a car driver whether }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9116877 he caused personal injury or material damag
e, which is to stop and give certain particulars if required. Subsection 4(a) imposes $400 fine or 2 years imprisonment }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12869957 
for filing to stop after causing personal injury and subsection 4(b) imposes $200 or 6 months imprisonment where there is no personal injury.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12209468  The }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid12209468\charrsid8149764 gravemen}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12209468  is a failure to stop but the consequences of that failure are more serious}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14045026
