 the action was properly instituted.

\ltrch\fcs0 \insrsid6692373\charrsid11360498 nuisance by}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498  the defendant who was stated to be operating a haulage contracting business and as a dealer in second hand trucks from his residenc
e at 15 Amputch Street, Suva. He is alleged to have illegally parked 20 to 25 heavy trucks both derelict and operational on the streets where he carried out repairs and serviced the vehicles. It was also alleged that such operations caused substantial ann
oyance to neighbours by day and night and had caused "excessive damage to the road surface}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid141318  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 of the streets."}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid11360498\charrsid11360498  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 It was also stated that the defendant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid141318  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
on the 9th June, 1977 had been convicted of two offences under the Suva (Control and the use of Street) By Laws 1969 and a further offence under the By Laws on 19th January, 1979. The defendant had also been requested on several occasions}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid11419622  to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 remove the trucks but had neglected to do so.
\par The powers of the Council with regard to streets}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10503071  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 in Suva are specified in the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8731015 
Local Government Act 1972 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 sections 107-118. There are also the By Laws made thereunder}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10503071  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid349804\charrsid11360498 which I have already referred to relating to control of streets.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10503071 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
Section 115 of the Act provides penalties for specified injuries and obstructions to streets. Section 115}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8731015  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
(1)(g) makes it an offence if any person "does or causes or permits to be done any act whatsoever by which any injury is done to any street or any work or thing in, on or under}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10503071  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid349804\charrsid11360498 a street".}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11360498\charrsid11360498  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 This section also specifies a procedure which}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid10503071  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 may be followed to 
deal with encroachment on or obstruction of a street. If the procedure is followed, it enables the Council, if there is non-compliance by the offender with the notice served on him, to remove the encroachment or obstruction and entitles the Council to rec
over the costs and expenses incurred in repairing and making good any injury or damage caused by an encroachment or obstruction.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14304472 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
The usual rule is that where an act creates liabilities and provides procedures to be followed and remedies for enforcing them s
uch procedures and remedies must be followed. A Court will not normally grant relief where such statutory remedies are not pursued.
\par The Council is not empowered in its own name to take action to abate a public nuisance if it seeks to ignore the statutory remedies it has for abating nuisances on}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304472  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid349804\charrsid11360498 streets. It must bring a relator action in the name of the Attorney General.

\par A further Summons was then taken out by Mr. H.M. Patel supported by an affidavit by the defendant in identical terms to his affidavit filed in support of the earlier Summons. No explanation was offered for the non-appearance }{\rtlch\fcs1 \af0

\ltrch\fcs0 \insrsid349804\charrsid11360498  use by the defendant has caused additional and excessive damage.
\par Special damages were not pleaded nor any damage }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2255445 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 pecified or quantified but the defendant}{\rtlch\fcs1 \af0 \ltrch\fcs0

\insrsid349804\charrsid11360498 damage he saw on the road. The only damage he testified to was that there were truck marks reversin}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2778525 g}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
 into the drain and some parts of the drain were damaged so that on some}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2778525  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 parts of the drain water flowed out onto the road. He mentioned that }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2778525\charrsid11360498 there}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498  was a lot of oil and fuel on the road}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2778525  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid349804\charrsid11360498 which he said damages the road seal. He did not say it had damaged the seal but in answer to a question from }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15798488\charrsid11360498 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2255445  Chief}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498  Registrar he said }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15798488 160}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498  square yard}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid15798488 s }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 were }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15798488\charrsid11360498 damaged}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
. This area would have }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15798488 to be paved}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498  and sealed. He said 670 feet of the drain was }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid3031553\charrsid11360498 damaged}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 . He produced a report }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3031553 which}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498  he said h
ad been prepared by him and the Council}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11360498\charrsid11360498 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3031553 s Senior Engineer.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498

s Senior Engineer to its solicitor}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6181391  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 being an estimate of the damaged road seal, head}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6181391 w}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 alls and drainage.
\par The Chief Registrar reduced the Council}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11360498\charrsid11360498 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 s estimate }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6181391 o}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid349804\charrsid11360498 f damage from $1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6181391 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 819.20 to $1,282.20 which the }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid13967838\charrsid11360498 Council}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498  has not challenged.

The Council only pleaded that there was excessive damage to the road surface of the streets and must be confined}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13967838  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
to that damage. The estimate of $2}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13967838 8}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 8 for damaged drains and}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13967838  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid349804\charrsid11360498 $187.80 for damaged headwalls to a driveway should have been ignored by the Chief Registrar. Deducting these figures from his assessment leaves the sum of $806}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10243008 .}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 40. This sum represents the actual alleged damage to the road surface but it was not established that the defendant was responsible for all the damage.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10243008 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid349804\charrsid11360498 
Some of the damage to the road would be done by the concentration of heavy trucks using the streets. Such use is legal use. The only illegal use of the trucks which in my view }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10243008\charrsid11360498 would}{
