oken into and a number of watches amongst other duty free items were stolen. On 20th July 1979 acting on information received, Sergeant Abdul Hassan (P.W.4) accompanied by Mohammed Janif s/o Sarajan Mohammed (P.W.1) one of the owners of the shop travelled
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 to Suva in a private car in pursuit of the appellant who had earlier on travelled in a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9717317 \hich\af0\dbch\af31505\loch\f0  v}{\rtlch\fcs1 \af0

319 to Suva with one Abid Ali from Nausori. P.W.4 as stopped along the way by a police highway patrol who was told of the purpose of the pursuit and was instructed\hich\af0\dbch\af31505\loch\f0  to go}{\rtlch\fcs1 \af0 \ltrch\fcs0

ppellant saw P.W.4 he got out }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 of the van and started running away. P.W.4 ran and got hold of him. \hich\af0\dbch\af31505\loch\f0 
Following a search of the vehicle a number of watches}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15826222 \hich\af0\dbch\af31505\loch\f0  w}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 hich were wrapped up in a piece of cloth inside a bag and covered over with a sack was foun}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid8258389 \hich\af0\dbch\af31505\loch\f0 d under the spare wheel of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 
van. The watches were identified to be part of those missing from P.W.1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid11816708\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 s shop\hich\af0\dbch\af31505\loch\f0 
 on the morning of the break-in. Appellant we interviewed under caution by P.W.4 at Nausori Police Station the same day at which appellant said he bought the watches from Saiki for $600 that same morning. When he was asked "Do you know that it was all sto
\hich\af0\dbch\af31505\loch\f0 l\hich\af0\dbch\af31505\loch\f0 en watches" appellant replied "Yes}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15826222 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 Saiki told me that they broke the \hich\af0\dbch\af31505\loch\f0 store of Razak". Appellant also said at the interview tha}{\rtlch\fcs1 \af0 \ltrch\fcs0

 Kasavu and with whom Abid Ali }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 had travelled to Suva when P.W.4 and his party came upon them at Greene Street was not ca}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid3677377 \hich\af0\dbch\af31505\loch\f0 lled as a witness by the prosecution n\hich\af0\dbch\af31505\loch\f0 or by the Court}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 
 even though Abid Ali in these circumstances would appear to be an}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11430408 \hich\af0\dbch\af31505\loch\f0  important potential witness in the prosecution case. It is said }{\rtlch\fcs1 \af0 \ltrch\fcs0

witness could be properly impugned. Surely if appellant had wanted to call Abid Al}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid12811341 \hich\af0\dbch\af31505\loch\f0 i}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0  as a witness at the trial he would have been perfectly entitled to do so and \hich\af0\dbch\af31505\loch\f0 he could not have been}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid13377090 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 
prevented from doing so. The Court of course has a right to call \hich\af0\dbch\af31505\loch\f0 
a witness not called either by the prosecution or the defence if in its opinion this course is necessary in the interests of justice. However, the power should be used\hich\af0\dbch\af31505\loch\f0 
 sparingly end rarely exercised (see Archbold (40th Edition) par. graph 592). As I pointed out above Abid Al}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid12811341 \hich\af0\dbch\af31505\loch\f0 i}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0  could have been called either by the prosecution or defence but}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid10113764

 from Nausori that day. In other words}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7232102 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 
his case is than he was framed by the police and Abid Ali and that claim as I pointed out earlier in this judgment was rej\hich\af0\dbch\af31505\loch\f0 
ected by the learned Magistrate who found the confessions made to the two police officers concerned and at two different occasions as}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid7232102 \hich\af0\dbch\af31505\loch\f0  }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 representing the truth of how the stolen watches came to be in the possession of appellant.}{\rtlch\fcs1 \af0 \ltrch\fcs0

\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid12391693 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 This ground of appeal fails.

\par \hich\af0\dbch\af31505\loch\f0 I\hich\af0\dbch\af31505\loch\f0 
n the final ground of appeal against conviction it was claimed that the learned Magistrate on the facts before him could not have been satisfied beyond reasonable doubt that the appellant knowingly received the stolen property.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid9192803 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 The main contention made und
\hich\af0\dbch\af31505\loch\f0 er this ground was that the evidence between P.W.1 and P.W.4 was in direct contradiction. P.W.4 had said in evidence, and here I quote from page 20 of the record:

standing with Sergeant. Sergeant went and asked "Where are the things?" as he got there. I was this distance}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4549638 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid4549638 
\hich\af0\dbch\af31505\loch\f0 (about one yard) from Sergeant. I was there five to six minutes."
\par }\pard\plain \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid9920279 \rtlch\fcs1 \af0\afs20\alang1025 \ltrch\fcs0 
\fs24\lang1033\langfe1033\loch\af0\hich\af0\dbch\af31505\cgrid\langnp1033\langfenp1033 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 It is said that it was rather curio\hich\af0\dbch\af31505\loch\f0 
us that only}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9920279 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 
P.W.4 stated that appellant had run away from the van and no other witness claimed to have seen that alleged occurrence.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9920279 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 P.W.1 who was there at Greene Street with P.W.4 made no mention of it. It is submitted that in these circumstances the lea
\hich\af0\dbch\af31505\loch\f0 rned}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9920279 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid9977208\charrsid11816708 
\hich\af0\dbch\af31505\loch\f0 Magistrate could not possibly in the light of such contradictory and unsatisfactory evidence have satisfied himself beyond reasonable doubt of the guilt of the appellant.}{\rtlch\fcs1 \af0 \ltrch\fcs0

\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 It is true that P.W.1 made no reference to appellant running away from th\hich\af0\dbch\af31505\loch\f0 
e van. However, it cannot in my view be inferred from that that P.W.4 was untruthful about that particular piece of evidence. It is clear from the record that at no time was P.W.l interrogated directly on the point. So it is not possible to say one way or
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 
the other whether there was a material contradiction in the evidence given by P.W.4 and 10.W.1 on the matter. Apart from that apparent lacuna their evidence where it really mattered, e.g. as to the evidence of discovery of the stolen watches in appellant}

 van and what was said by the appellant at the time of discovery was consistent with each other.

Accordingly this ground of appeal fails.
\par \hich\af0\dbch\af31505\loch\f0 For the reasons I have given when dealing with each ground of appeal against conviction I am satisfied that the appeal\hich\af0\dbch\af31505\loch\f0  must be dismissed.
\par \hich\af0\dbch\af31505\loch\f0 I turn now to the appeal against sentence.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid10892313 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0

 imprisonment. It is said that the sentence was harsh and excessive having regard to the whole of the circumstances of the case. Appellant has no .prev\hich\af0\dbch\af31505\loch\f0 
ious convictions and until this incident was a man of good character. It appears that the appellant succumbe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8996252 \hich\af0\dbch\af31505\loch\f0 d to strong temptation when pres}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid9977208\charrsid11816708 \hich\af0\dbch\af31505\loch\f0 ented with an opportunity to make some quick}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8996252 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0

 for shopbreakers and thieves nor was he shown to be a professional receiver. Furthermore it appears that all the watches which the appellant had received have been recovered and }{\rtlch\fcs1 \af0 \ltrch\fcs0

ince been restored to the original owners. Appellant did not derive any personal g}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid10892313 \hich\af0\dbch\af31505\loch\f0 ain from his criminal escapade}{\rtlch\fcs1 \af0 \ltrch\fcs0
