Except as above mentioned there is nothing to limit or restrict the Commission in the }{ \fs24\lang2057\langfe1033\langnp2057\insrsid9205410\charrsid2757435 matter}{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 whic}{\fs24\lang2057\langfe1033\langnp2057\insrsid9205410 h it may broadcast. It is common g}{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 round that the Minister has not }{\fs24\lang2057\langfe1033\langnp2057\insrsid9205410 p}{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 rohibited the broadcasting of the matter }{\fs24\lang2057\langfe1033\langnp2057\insrsid9205410 wh}{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 ich the plaintiff desires to broadcast.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435 \par }{\fs24\lang2057\langfe1033\langnp2057\insrsid9205410\charrsid2757435 \par }{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 Although it would appear that the Commission (for so I will refer to the defendant throughout this judgment) is not restricted in any way as to }{ \fs24\lang2057\langfe1033\langnp2057\insrsid732512 w}{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 hat it will broadcast or refuse to }{\fs24\lang2057\langfe1033\langnp2057\insrsid732512 b}{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 roadcast plaintiff says that it must not infringe the Fiji Constitution by restricting his right of expression or by discriminating }{\fs24\lang2057\langfe1033\langnp2057\insrsid732512 a} {\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 gainst him by affording; him different treatment by reason of his political opinions. He seeks to substantia}{\fs24\lang2057\langfe1033\langnp2057\insrsid4997869 te }{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 to this point by saying that he is an independent candidate. But surely to say }{\fs24\lang2057\langfe1033\langnp2057\insrsid4997869 h}{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 e is an independent candidate is not to say that he has different political opinions from those of the parties to whom the Commission has afforded time,}{ \fs24\lang2057\langfe1033\langnp2057\insrsid4997869 nor is it, as it seems to me, to say th}{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 at he is discriminated against by reason of his political opinions. He is being discriminated against }{\fs24\lang2057\langfe1033\langnp2057\insrsid6707451 because he is not a member of a}{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 recognised political party. The plaintiff indeed has not told the Court what his political opin}{\fs24\lang2057\langfe1033\langnp2057\insrsid6707451 ions are, and I think that I mus}{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 t ass}{\fs24\lang2057\langfe1033\langnp2057\insrsid4997869 ume}{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 that}{ \fs24\lang2057\langfe1033\langnp2057\insrsid4997869 }{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 he did not tell t}{\fs24\lang2057\langfe1033\langnp2057\insrsid6707451 he Commission. The plaintiff did not impress me as a witness. I have no doubt that he knew that defendant was not going on with the sale transaction,}{ \fs24\lang2057\langfe1033\langnp2057\insrsid4679462 al}{\fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 though he swears that he did not. On the other hand, the defendant had already evinced an intention to resile from the transaction, and there is no doubt that Mr}{\fs24\lang2057\langfe1033\langnp2057\insrsid4679462 .}{ \fs24\lang2057\langfe1033\langnp2057\insrsid2757435\charrsid2757435 R.D.
