{\f0\lang2057\langfe3081\langnp2057\insrsid16216081\charrsid3026920 (6) \tab unlawful and unreasonable search of the Plaintiff}{ \f0\lang2057\langfe3081\langnp2057\insrsid3026920 '}{\f0\lang2057\langfe3081\langnp2057\insrsid16216081\charrsid3026920 s baggage without a search warrant to do so; \par }\pard \s18\ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3026920 {\f0\lang2057\langfe3081\langnp2057\insrsid3026920 \par }\pard \s18\ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid3026920 {\f0\lang2057\langfe3081\langnp2057\insrsid16216081\charrsid3026920 (7) \tab Depriving the Plaintiff of his constitutional right of freedom of movement when he was detained at the Nadi International Airport. \par }\pard\plain \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3026920 \fs20\lang1033\langfe1033\cgrid\langnp1033\langfenp1033 {\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 \par }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 As a result of these alleged breaches the Plaintiff claims he sustained severe shock, stress and mental anguish and has suffered loss and damage.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He says that these damages occurred as a result of his unlawful detention in broad daylight in public which subjected him to humiliation and disgrace thereby bringing him into ridicule and contempt. \par \par Part of the special damages the Plaintiff claims comprised $300.00 for a taxi fare from Auckland Airport to the dealer in a suburb of Auckland from whom he expected to buy the spare parts.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He conceded in cross-examination that his wife}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 s brother took him from the airport to the dealer so that his claim for special damages must be reduced by $300.00 to $1,153.00. \par \par I am satisfied on the evidence that as a result of the Plaintiff being wrongly detained on the 13th of December 1998 he failed to obtain the spare parts which made his second trip necessary. \par \par The two incidents at the airport have many similarities.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 On the first occasion on the 13th of December after he was taken into Police custody the Plaintiff stated that he was told by the Police who took him from the Immigration Counter to the Police Post that he was under arrest.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He asked them why but they did not reply and began searching all his luggage, brief case and wallet and his trouser pockets.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 When the Police rang Suva they were told that there was a robbery case again him in Suva and they were going to take him there.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 When it transpired there was no such case pending the Plaintiff re-packed his luggage but was very distressed.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 The Police carried his luggage to the airline.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 The Plaintiff stated that while he was at the Police Post he did not think he could walk away and I am satisfied that until clearance was obtained from Suva the Police would not have let him walk away. \par \par On the second occasion on the 6th of January 1999 he was prevented by the Immigration Officer from being admitted into the airport lounge after the officer had spoken to the Police.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 While he was being detained he said he felt }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 really bad}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 . \par \par The Plaintiff stated that at all times on both occasions he was treated courteously by the Police at Nadi.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 They apologised to him but said that they had instructions from Suva and had to obey them. \par \par The Defendants called only one witness, Senior Superintendent Emosi Vunisa who is the Director of Criminal Investigations in Fiji.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He stated that he was responsible to the Immigration Department for what is called a }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Watch-List}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 which has a list of names of people charged with criminal offences and those who are under investigation for criminal offences.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 The Plaintiff}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 s name was on this list and Superintendent Vunisa admitted that it should have been deleted from it.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He apologised to the Plaintiff for the two incidents and said that the Police Force now has a new system for maintaining the register of persons under investigation for criminal and other offences.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He also stated that the Plaintiff had a small criminal record consisting of seven convictions five of them being for assault.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He stated that the last offence for which the Plaintiff was convicted was in 1994 and as at the 18th of April this year he had a clean record. \par \par The Defendants argued that there are many mitigating circumstances in their favour.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 They say that both incidents occurred as a result of an honest mistake in removing the Plaintiff}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 s name from the }{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Watch-List}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 and that they have now apologised to the Plaintiff.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Thus they say this is not a case where Police Officers deliberately flouted the law and their conduct could not be regarded as outrageous and contumelious.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Rather it was an honest error of judgment based on a mistake. \par \par While I accept that an apology can go some way to mitigating damages and that the Plaintiff was at all times treated courteously by the Defendants nevertheless I am satisfied that he was humiliated and his feelings hurt by the actions of the Defendants.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 If there was some excuse for their actions on the first occasion there certainly was none for what they did on the second occasion. }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Where liberty of the subject is concerned the Police and for that matter the Immigration Department cannot be too careful.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 It was the duty of both Departments, particularly the Police, to keep their records up to date and this was not done.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 To me it indicates an attitude of indifference which it is hoped will not occur again.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 While I accept that any country must have some system for monitoring the arrivals and departures of persons in the country in the interests of national security the fact remains that there is nothing in the Police Act or the Criminal Procedure Code which allows the First Defendant to arrest or detain a person simply because his name appears on a }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Watch-List}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 '}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 .}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Likewise nothing in those Acts empowers the First Defendant to determine who will leave the country or not. \par \par Although the Plaintiff claims general damages, in my judgment his proper claim is for aggravated damages.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 In }{ \b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 {\*\bkmkstart G_Lackersteen_v_M_Jones_Mohd_Kasi_Compol}Gary Mark Lackersteen v Melvin Lawrance Jones {\*\bkmkend G_Lackersteen_v_M_Jones_Mohd_Kasi_Compol}and Others }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 (1988) NTSC 60 Asche C.J. described the difference between aggravated and exemplary damages after reviewing various authorities on the subject.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He said, }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 The basis for aggravated damages lies in compensation of a particular kind based not on physical injury or discomfort but on humiliation and injury to feelings}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 .}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 He went on, }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 There can not be any implication that a person of bad reputation cannot be humiliated and insulted}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 .}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 In the instant case the Plaintiff did not have a bad reputation although he had committed some criminal offences for which he had been duly punished.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 I have been referred to a number of authorities on the question including }{\b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 {\*\bkmkstart Josaia_Vakacoko_Compol_Mohd_Kasim_Compol}Josaia Vakacoko v The Commissioner of Police}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 {\*\bkmkend Josaia_Vakacoko_Compol_Mohd_Kasim_Compol}HBC 145 o f 1998S, unreported judgment of Scott J. of the 10th of December 1999, }{\b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 {\*\bkmkstart E_Seniloli_v_Voliti_Mohd_Kasim_v_Compol}Epeli {\*\bkmkstart Seniloli_v_Semi_Voliti_State_v_Serupepel}Seniloli and Another v Semi Voliti}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 {\*\bkmkend E_Seniloli_v_Voliti_Mohd_Kasim_v_Compol} and Other v {\*\bkmkend M_Lawanisavi_v_Kapieni_M_Kasim_v_Compol}Pesamino Kapieni}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 {\*\bkmkend Marika_v_Pesamino_Mohd_Kasim_v_Compol}ABU 0049/98S, unreported judgment of the Court of Appeal of the 13th of August 1999.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Whilst I find these judgments of some assistance the facts in them particularly in }{ \b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Vakacoko}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 and }{\b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Seniloli}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 which were both cases of unlawful imprisonment are different from those in the present case.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Both Judges awarded damages, in the case of }{\b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Vakacoko}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 , $4,000.00 for wrongful detention for six days in a small cell without any mattress, pillow or mosquito coil and in the case of }{ \b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Seniloli}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 , $6,800.00 for four hours detention of a boy aged 14 who was handcuffed to a post for a time.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 \par \par It seems that in neither of these two cases was the question of constitutional rights argued although in }{\b\i\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Seniloli}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 the Plaintiff relied on the United Nations Convention on the Rights of the Child.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Here the Plaintiff makes his claim for exemplary damages on the Constitution to which I shall refer in a moment.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Before doing so however I consider it fair to award the Plaintiff aggravated damages for the humiliation he suffered of $5,000.00.}{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 } {\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 On the question of exemplary damages which are punitive in nature because their function is to punish or mark the disapproval of the Court, it is relevant to consider certain parts of the 1998 Constitution.}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 The preamble to the Constitution contains this penultimate paragraph:}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081 \par }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920\charrsid3026920 \par }\pard \ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid3026920 {\fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 REAFFIRMING our recognition of the human rights and fundamental freedoms of all individuals and groups, safeguarded by adherence to the rule of law, and our respect for human dignity and for the importance of the family ....}{ \fs24\lang2057\langfe1033\langnp2057\insrsid3026920 "}{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 \par }\pard \ql \li0\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3026920 {\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 \par }{\fs24\lang2057\langfe1033\langnp2057\insrsid16216081\charrsid3026920 Then {\*\bkmkstart Const_2_1_Mohd_Kasim_v_Compol}Section 2(1) {\*\bkmkend Const_2_1_Mohd_Kasim_v_Compol}of the Constitution states:}{ \fs24\lang2057\langfe1033\langnp2057\insrsid16216081 \par }{\fs24\lang2057\langfe1033\langnp2057\insrsid3026920\charrsid3026920 \par }\pard \ql \li720\ri0\nowidctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid3026920
