beam Transport Limited and Pacific Transport Limited, for judicial review of a decision of the thir\hich\af0\dbch\af31505\loch\f0 
d respondent, the Transport Control Board of Fiji, on 27th April 1983 to grant to the appellant a road service licence pursuant to section 65 of the Traffic Ordinance of Fiji (Cap. 152).
\par \hich\af0\dbch\af31505\loch\f0 The third respondent, which has not taken any part in the appeal befo\hich\af0\dbch\af31505\loch\f0 
re their Lordships' Board, is a statutory body which was constituted by legislation which preceded the current Ordinance and which has been }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16331970 \hich\af0\dbch\af31505\loch\f0 continued by it. It will be con}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 venient to refer to it as "the Board". It consists of a chairman and four members and\hich\af0\dbch\af31505\loch\f0 
 among its functions is the grant or refusal of applicat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11613058 \hich\af0\dbch\af31505\loch\f0 ions for licences under the pro}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 
\hich\af0\dbch\af31505\loch\f0 visions of the Ordinance for the operation of public service vehicles. Section 63 of the Ordinance provides that no person shall use or permit the use of a stage carriag\hich\af0\dbch\af31505\loch\f0 
e or express carriage except under a licence granted by the Board (referred to as a "road service licence"). Application for such a licence is required by section 64 to he made in a prescribed form and sent to the Board with the appropriate fee.
\par \hich\af0\dbch\af31505\loch\f0 The proced\hich\af0\dbch\af31505\loch\f0 
ure to be followed by the Board once an application has been received is regulated by section 65 the terms of which, in the context of the matters complained of by the first and second respondents, are of some importance. The relevant provisions of that s

In considering applications and objections the Board is not given an entirely free hand. Section 66 subsection (2) prescribes a number of matters \hich\af0\dbch\af31505\loch\f0 
which it is mandatory for the Board to consider. It is so far as material in the following terms:

The appellant and the first and second respondent are all public transport operators providing public \hich\af0\dbch\af31505\loch\f0 
bus services on the island of Viti Levu Fiji and it will be helpful at this stage to say a few words about the geography of the island.
\par \hich\af0\dbch\af31505\loch\f0 The island is broadly oval in shape, the principal towns being Ba, Lautoka and Nadi in the north-west and Suva, Nausori \hich\af0\dbch\af31505\loch\f0 
and Navua in the south-east. They are connected by two principal roads which together circle the island. Starting in the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 north-west and proceeding clockwise (i.e. travelling north-east from Ba) is the King's Road which runs through Tavua and Vaileka on the\hich\af0\dbch\af31505\loch\f0 
 north coast and then turns south to Suva via Nausori. It is, their Lordships have been told, a very poor road which is not tarmacadamed and is recommended only for hardy travellers. Running south and anti-clockwise from Ba is the Queen's Road which also 
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0 uns to Suva, skirting the coast via Lautoka, Nadi, Sigatoka and Navua. This is now a much better road than the King's Road and has been surfaced with tarmacadam}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid6842833 \hich\af0\dbch\af31505\loch\f0 ed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 . That}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 process was completed in 1982 and on 2nd December of that year the Board invited applic\hich\af0\dbch\af31505\loch\f0 ations from bus operators for a round island }{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid6842833 \hich\af0\dbch\af31505\loch\f0 service. That resulted in a num}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
ber of applications, the first of which was that of City Transport Limited which applied for a licence to operate a single service from Suva to Lautoka via the Queen's Road and fro\hich\af0\dbch\af31505\loch\f0 
m Lautoka to Suva via the King's Road. That application was opposed by the first and second respondents who on 17th and 15th December 1982 respectively, lodged competing applications for identical services.
\par \hich\af0\dbch\af31505\loch\f0 On 10th January 1983 a competing application for}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
a double circular service over the same route (that is, a service involving two buses circling the island in opposite directions) was made by Victory Transport and on 17th January}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6842833 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 the appellant lodged an identical application. The Board also received a num\hich\af0\dbch\af31505\loch\f0 
ber of applications for licences for other services. The only ones material to be mentioned, since they form the ground of one of Mr Newman's submiss}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0 
ions on behalf of the appellant,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  are}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 an application by Adi Nanise on 2nd December 1982 for an express servi\hich\af0\dbch\af31505\loch\f0 
ce Ba/ Lautoka/Suva and return via Queen's Road only and an identical competing application by the first respondent (reference RSL/16/15) on 23rd December 1982. In March 1983 the Board proceeded to hear these and other applications together and it is out 
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 f those hearings that the present proceedings arise. The hearings occupied}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0  three days, that is to say, 9th, }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 10}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid15169377\charrsid1843194 \hich\af0\dbch\af31505\loch\f0 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 
\hich\af0\dbch\af31505\loch\f0  and 1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 lth March 1983 at the conclusion of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0  }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 which the outstanding applications for circular service were deferred for decision on notice. On 27th \hich\af0\dbch\af31505\loch\f0 
April 1983 the Board gave its decision granting the licence applied for by the appellant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 
\par \hich\af0\dbch\af31505\loch\f0 On the 27th May 1983 the fi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0 rst and second respondents applied }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid1843194\charrsid1843194 
\hich\af0\dbch\af31505\loch\f0 expart}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15169377\charrsid1843194 \hich\af0\dbch\af31505\loch\f0 e}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  for }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid1843194 \hich\af0\dbch\af31505\loch\f0 leave to apply}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  for judicial review of the Board's decision and such leave was granted on 6th
\hich\af0\dbch\af31505\loch\f0  June. The motion for j}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0 udicial review was heard by Kerm}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 
\hich\af0\dbch\af31505\loch\f0 ode J. on 3rd, 4th and 11th August 1983 and on 9th September 1983 he made an order quashing the decision and ordering the Board to pay the first and second respondents' costs of the motion. The appella
\hich\af0\dbch\af31505\loch\f0 
nt appealed to the Court of Appeal enumerating some twenty-three grounds of appeal. After a hearing lasting three days the Court of Appeal (Speight V. P., Mishra and O'Regan J. J. A.) dismised the appeal with costs and ordered that the applications for ro
\hich\af0\dbch\af31505\loch\f0 a\hich\af0\dbch\af31505\loch\f0 d service licences be remitted to the Board for re-hearing. On 16th April 1984 final leave to appeal to Her Majesty in Council was granted by the Court of Appeal.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2759890 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
In his judgment in the Supreme Court Kennode J. had been extremely critical of various aspect\hich\af0\dbch\af31505\loch\f0 
s of the conduct of the Board and its Chairman, Mr Lala, and his decision was based in part on matters which, in the judgment of the Court of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0  Appeal, were not sustained as }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 grounds upon which a judicial review ought to be ordered. Although, in their printed\hich\af0\dbch\af31505\loch\f0 
 case, the respondents rely upon these matters in supporting the decision of the Court of Appeal, their Lordships have not, in the event, found it necessary to consider them. There were, however, two substantial matters upon which Kermode J. relied in rea

grounds for quashing the decision of the Board. Both involve some consideration of the course which the hearing of the objections and the various\hich\af0\dbch\af31505\loch\f0  competing applications took before the Board.

\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 tions on the grounds envisaged by sect}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0 ion 66 of\hich\af0\dbch\af31505\loch\f0  the Ordinance, namely, that no }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 necessity for such a service in the public interest had been established and that the needs of the area were adequately met by }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2759890 \hich\af0\dbch\af31505\loch\f0 the existing services. Mr Koya. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 who was appearing at the time for the first respondent }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0 alone, sou\hich\af0\dbch\af31505\loch\f0 ght to urge these con}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
siderations on the Board, tendered some written submissions as regards the matters referred to in section 66 and indicated that he wished to produce evidence from Mr Jalil. The Managing Director of the first respondent. He was told tha
\hich\af0\dbch\af31505\loch\f0 t there was an established ruling that an objector who was also an }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0 applicant would not be allowed}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  to argue his objections on these grounds unless he first withdrew his application. Mr Koya wished to proceed with his objections to the application then bei}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2759890 \hich\af0\dbch\af31505\loch\f0 ng\hich\af0\dbch\af31505\loch\f0  heard and. in order to do so,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  having }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid2759890 \hich\af0\dbch\af31505\loch\f0 regard to the Chairman's ruling, then withdrew the first res}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 pondent's competing applicatio}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0 n under protest. The result was, of course,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
 that when the Board determined subsequently to defer decision on the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0  pending applica\hich\af0\dbch\af31505\loch\f0 tions on notice,}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  it had no longer before it any application by the first respondent, which was thus effectively eliminated by the Board as a competitor for a licence.
\par \hich\af0\dbch\af31505\loch\f0 Kermode J. had no hesitation in saying that a ruling which compelled operators to elect e\hich\af0\dbch\af31505\loch\f0 ither to proceed with their applications or to oppose a competing one was a breac}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid7949600 \hich\af0\dbch\af31505\loch\f0 h of the Board's statutory duty n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 under section 65 referred to above to hear all proper}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 applications and to consider all objections. The Court of Appeal agreed fully with that c
\hich\af0\dbch\af31505\loch\f0 onclusion. So do their Lordships. Mr Newman, on behalf of the appellant, h}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2759890 \hich\af0\dbch\af31505\loch\f0 as submitted to their Lordships,}{\rtlch\fcs1 \af0 \ltrch\fcs0

\af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  its own procedure as to the stage at which objection wa\hich\af0\dbch\af31505\loch\f0 
s to be heard and that there was nothing to prevent a competing applicant from pursuing his objection to an earlier heard application at the stage when his own application came to he heard. The short answer to that is in the Chairman's own evidence which 
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0 uns as follows:

" ... it has been the established procedure of the Board that where an applicant lodges a competing or similar application to an existing application then before the matter is heard he's given a choice either to proceed with his competing a
\hich\af0\dbch\af31505\loch\f0 pplication or to object to the existing application but he is not allowed to do both."

Mr Newman's alternative submission is that even if the Chairman's ruling was a bread\hich\af0\dbch\af31505\loch\f0  of the Board's statutory duty, it caused no prejudice to the first respondent. That\hich\af0\dbch\af31505\loch\f0 
, it is said, can be sustained on two grounds. First, it is said that the application withdrawn was a precise copy of the City Transport application which was a defective application as a result of certain errors in the time-table, so that all that Mr Koy
\hich\af0\dbch\af31505\loch\f0 a\hich\af0\dbch\af31505\loch\f0 
 was doing was withdrawing an application which he believed in any event to be defective. Secondly, it is said that, having regard to the existence of another application of the first respondent (RSU16/15) which was proceeded with (although it failed), Mr
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 Koya still had, on that application, the opportunity to ventilate any objections on lack of necessity for further services and absence of local need.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3540646 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
In their Lordships' judgment neither of these submissions has any substance. There is no ground whatever f\hich\af0\dbch\af31505\loch\f0 
or supposing that Mr Koya regarded his clients' application as defective and. even if it was, it is clear from section 65(5) that any defects in time-tabling could be perfectly easily cured. The plain fact is that, on the Chairman's own evidence, Mr Koya 
\hich\af0\dbch\af31505\loch\f0 w\hich\af0\dbch\af31505\loch\f0 as put under }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3540646 \hich\af0\dbch\af31505\loch\f0 pressure to withdraw an applica}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 
\hich\af0\dbch\af31505\loch\f0 tion which competed with that of the appellant and which must be presumed at least to have merited consideration. It is idle to speculate as to what might have been the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3540646 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 result if the application had been proceede\hich\af0\dbch\af31505\loch\f0 
d with and it is quite impossible to say that the first respondent's position was not prejudiced by the withdrawal. That in itself is s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3540646 \hich\af0\dbch\af31505\loch\f0 ufficient to dispose of the sugg}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 estion that there was no prejudice and the second of Mr Newman's submissions becomes simp\hich\af0\dbch\af31505\loch\f0 ly irrelevant.

The other matter relied upon by Kermode J. and the Court of Appeal as equally if not even more conclusively demanding that the Board's decision be quashed arose}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3540646 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 in the following way. After the Board}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3540646 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 had heard the applications of City Transpo\hich\af0\dbch\af31505\loch\f0 
rt, Victory and the appellant and having regard to the objections raised by Mr Koya on the absence of local need for additional services. Mr L}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3951464 \hich\af0\dbch\af31505\loch\f0 
ala, the Chairman, undertook that before reaching a decision,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  the Board would obtain evidence for itself by way of\hich\af0\dbch\af31505\loch\f0 
 a report from its Transport Officers as to the need }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3951464 \hich\af0\dbch\af31505\loch\f0 for the introduction of the pro}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 
\hich\af0\dbch\af31505\loch\f0 posed serv}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3951464 \hich\af0\dbch\af31505\loch\f0 ices. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8481884 \hich\af0\dbch\af31505\loch\f0 That report,}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid3951464 \hich\af0\dbch\af31505\loch\f0  Mr Lala said,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
 would be made available to all interested parties before the decision was given. And indeed the Board did obtain such a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3951464 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 report. I\hich\af0\dbch\af31505\loch\f0 
nspectors were instructed to carry out load checks on the existing services and they did so on four days in April. It is unnecessary to refer to the results of those checks in any detail. They showed substantial underloading on existing services and the r
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 porting Inspector, in a letter to the Transport Officer, opined:

to give its decisio}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8481884 \hich\af0\dbch\af31505\loch\f0 n on 27th April 1983, Mr Mustaq,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 
 a Transport Officer, was present.
\par \hich\af0\dbch\af31505\loch\f0 The report was\hich\af0\dbch\af31505\loch\f0 , however, not made available to the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8481884 \hich\af0\dbch\af31505\loch\f0 interested parties as had been}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  promised. All that the minutes record is that:

's evidence on the consideration of the report is jejune and consists simply of a statement that:

 relevant by the Board and as they were rejected they were not distributed as ea\hich\af0\dbch\af31505\loch\f0 rlier indicated."

As the learned trial judge observed, if the reports were inadequate that was the fault of the Board itself in not directing the Transport Officers to obtain further}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8481884 \hich\af0\dbch\af31505\loch\f0  }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 whatever why the Board should not adjourn for the compilation of more ade\hich\af0\dbch\af31505\loch\f0 
quate information. In any event if they were considered inadequate there was no reason material. And as to the suggestion that they were "irrelevant" it is}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8481884 \hich\af0\dbch\af31505\loch\f0 
 difficult to imagine anything m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 ore pertinent to the inquiry which the Board was under a statutory du\hich\af0\dbch\af31505\loch\f0 
ty to conduct in acordance with the section of the Act already quoted. Their Lordships can do no better than quote from the relevant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16331970 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0

\hich\af0\dbch\af31505\loch\f0 relevant is really no more than a clumsy way of saying that the Bo}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10385512 \hich\af0\dbch\af31505\loch\f0 ard, within its proper province,}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0  regarded the evidence presented by the reports as of little weight. But that realty will n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10385512 \hich\af0\dbch\af31505\loch\f0 
ot do in the light of the Chair}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 man's own quite clear evidence; nor \hich\af0\dbch\af31505\loch\f0 
does it explain the failure to live up to an express promise to disclose the reports prior to making a decision and to give the parties an opportunity to address the Board on them. This alone is quite sufficient to involve an inevitable conclusion that th
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0  appeal must fail.
\par \hich\af0\dbch\af31505\loch\f0 As an alternative way of putting the case Mr Newman has sought to persuade their Lordships that the Court of Appeal in some way e}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10385512 \hich\af0\dbch\af31505\loch\f0 
rred in the exercise of its dis}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 cretion which he now invites their Lordships' Board to exercise afresh in his\hich\af0\dbch\af31505\loch\f0 
 favour. No foundation whatever has been laid for that submission and their Lordships are entirely unpersuaded that it is even arguably capable of being supported.
\par \hich\af0\dbch\af31505\loch\f0 Finally, the appellant seeks to raise the question of costs in the courts below. First, it i\hich\af0\dbch\af31505\loch\f0 
s said that the trial judge should not, as he did, have left the appellant to pay its own costs but should have made an order for their payment by the Board. The short answer to that is that that was not something which was even hinted at in the notice of
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 appeal from the Supreme Court and it is far }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10385512 \hich\af0\dbch\af31505\loch\f0 too late to raise it now. Secon}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 dly, it is said that the Court of Appeal gave its decision on costs without inviting argument on the question and that, if it had been argued, whilst it might have been 
\hich\af0\dbch\af31505\loch\f0 right that\hich\af0\dbch\af31505\loch\f0 
 the appellant should pay the respondents' costs, the Board should have been ordered to indemnify the appellant against the costs which the appellant was ordered to pay to the first and second respondents. Their Lordships are accordingly}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid10385512 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15169377\charrsid15169377 \hich\af0\dbch\af31505\loch\f0 now asked either t\hich\af0\dbch\af31505\loch\f0 
o make an order for payment by the Board of the appellant's costs in the Court of Appeal or to remit the question of costs to the Court of Appeal for reconsideration. Their Lordships do not regard either course as appropriate. It is apparent that the orde
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0

s not practicable, to seek to have the drawing up and passing of the order suspended until an appointment could be made for further argument. It is, in their Lordships' view, too late now to seek to upset the order when there is nothing in the material be

ore their Lordships to indicate in what respect (if at all) the Court of Appeal could be said to have exercised its discretion as to costs wrongly and when the matter was not even sought to be argued before it.
