\par The Supreme Court quashed the conviction stating that the "Proper Authority" (P.A.) constituted under the Act was charged with the responsibility of inspecting the construction works of the Fiji Sugar Co. Mill; its written opinion
 that the work was dangerous and unsuitable for young persons should have been communicated to the respondents before the accident occurred. S.61(1), (2), (4) and s.82 and 84 and 85 were the only sections which imposed duties and conferred powers upon the
 (P.A.). The court said s.61(1) was declaratory, authorising prohibition of employment but without having an offence provision. S.61(2) empowers the P.A. to issue a prohibition in any particular case. The second limb of s.61(}{\f0\fs24\insrsid12281541 4}{

 ninety feet in diameter and about sixty feet in depth and had a flat }{\f0\fs24\insrsid6433074\charrsid4665801 roof which}{\f0\fs24\insrsid14567864\charrsid4665801  had }{\f0\fs24\insrsid6433074 been}{\f0\fs24\insrsid14567864\charrsid4665801  complete}{

\par Mohammed Haroon Buksh (hereafter called the deceased) was employed by appellants; he was aged 15 years and 10 months at the time }{\f0\fs24\insrsid6433074 of his}{\f0\fs24\insrsid14567864\charrsid4665801  death. A subcontractor}{\f0\fs24\insrsid490527 ,}{
\f0\fs24\insrsid14567864\charrsid4665801  employed }{\f0\fs24\insrsid490527 by}{\f0\fs24\insrsid14567864\charrsid4665801  respondents was engaged in placing sprinkler pipes under the }{\f0\fs24\insrsid490527 roof of}{\f0\fs24\insrsid6433074  the}{
\f0\fs24\insrsid14567864\charrsid4665801  bin which was effected by removing the sheets }{\f0\fs24\insrsid6433074 of the}{\f0\fs24\insrsid14567864\charrsid4665801 
 roofing iron; fitting the sprinkler pipes and replacing the iron sheets. The deceased and a fellow worker, Sita Ram}{\f0\fs24\insrsid490527 ,}{\f0\fs24\insrsid14567864\charrsid4665801  were employed in removing these sheets }{\f0\fs24\insrsid490527

sheets of iron were removed large gaps were left in the roof; electric screw drivers were used by the deceased and his fellow employee to remove the sheets }{\f0\fs24\insrsid490527\charrsid4665801 of roofing}{\f0\fs24\insrsid14567864\charrsid4665801

 Act it is the proper authority who are charged with the responsibility to inspect construction works amongst other types of work and to decide }{\f0\fs24\insrsid490527\charrsid4665801 whether it}{\f0\fs24\insrsid14567864\charrsid4665801 
 would be dangerous for young persons to work in them or no}{\f0\fs24\insrsid490527 t}{\f0\fs24\insrsid14567864\charrsid4665801 
... For the reasons I have given I am of the opinion that before any charges could be laid and prosecuted under section 61(4) it must first be shown that the proper authority had declared and notified the employers concerned that a particular wor
k or class of work was dangerous for the purpose of employing young persons."
