\par \hich\af0\dbch\af31505\loch\f0 In the first place who said that the Fijian Hotel was \hich\af0\dbch\af31505\loch\f0 not a legal body? The resp}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958 \hich\af0\dbch\af31505\loch\f0 on\-dent certainly didn't say so}{

f to the evidence before him?
\par \hich\af0\dbch\af31505\loch\f0 But then even assuming that the magistrate was ri}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1969309 \hich\af0\dbch\af31505\loch\f0 g}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958 \hich\af0\dbch\af31505\loch\f0

cted or even correct it himself? He could have corrected it }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958 \hich\af0\dbch\af31505\loch\f0 or had it corrected at any time}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681

\insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 ducive to the proper administration of justice to knowingly allow a \hich\af0\dbch\af31505\loch\f0 
prosecution to proceed with a technical fault in the charge which could easily be corrected and then to acquit because of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 that fault. It is not as if anybody could he misled by the reference to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958\charrsid216681 \hich\af0\dbch\af31505\loch\f0 Fijian}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0  Hotel\hich\f0 \emdash \loch\f0 e}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958 \hich\af0\dbch\af31505\loch\f0 ven if it is not a legal body. I}{\rtlch\fcs1 \af0 \ltrch\fcs0

\insrsid14163958 \hich\af0\dbch\af31505\loch\f0  other name than "Fijian Hotel".}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 
\par \hich\af0\dbch\af31505\loch\f0 Another point arising from the judgement is that the magistrate wa\hich\af0\dbch\af31505\loch\f0 
s somewhat confused when he proceeded to consider the definition of "owner" in relation to embezzlement. Section 306(a) (ii) does not refer to the ownership of money. It refers to money received by the offender "for or in the name or on the account of his
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 master or employer". So the section is more concerned with the identity of the master or employer }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958 \hich\af0\dbch\af31505\loch\f0 
of the offender than with the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 ownership of the money. Who w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14163958 \hich\af0\dbch\af31505\loch\f0 
as the respondent's employer? I'm}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0  sure he himself would say he was employed by the Fijian Hotel, an\hich\af0\dbch\af31505\loch\f0 
d since from all, the evidence given it seemed to be accepted that he had received $5 from a customer for a plate of sandwiches I'm sure he would also say that he received the money on behalf of his employer the Fijian Hotel.
\par \hich\af0\dbch\af31505\loch\f0 But I think the best answer to\hich\af0\dbch\af31505\loch\f0  the query by the magistrate as to the correctness of the charge is to he found in section 123(}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid216681\charrsid14707442 
\hich\af0\dbch\af31505\loch\f0 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 ) of the C.P.C. It is a pity that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14707442 \hich\af0\dbch\af31505\loch\f0 he}{\rtlch\fcs1

 of course includes any body of persons corporate or unincorporate. If "Fijian Hotel is not an accurate description of the respondent's employer and the person on whose behalf he received t\hich\af0\dbch\af31505\loch\f0 
he money it is without doubt such as is reasonably sufficient to identify him. I'm sure everybody knows exactly who is meant even though they may not know the actual name of the body of persons or}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9641478 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 association that owns the hotel. There could not be any pre\hich\af0\dbch\af31505\loch\f0 
judice to the respondent because of the use of the name Fijian Hotel.
\par \hich\af0\dbch\af31505\loch\f0 The judgment does not give or suggest any other reason for acquitting the respondent so that when I reject what the magistrate has said as a valid reason for acquitting the respondent wh\hich\af0\dbch\af31505\loch\f0 
at powers can be exercised by this Court to put the matter right? The C.P.C. (Section 289(}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid216681\charrsid9641478 \hich\af0\dbch\af31505\loch\f0 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 
\hich\af0\dbch\af31505\loch\f0 )) specifically gives a right of appeal against an}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9641478 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0

So that save with the exception that I cannot order retrial I can exercise any of the powers of the Supreme Court in respect of any other appeal as ma\hich\af0\dbch\af31505\loch\f0 
y be appropriate. I could remit the case to the magistrate's court with my opinion thereon. But is seems most undesirable to return the case to a magistrate who already seems to have made up his mind albeit on erroneous grounds}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid9641478 \hich\af0\dbch\af31505\loch\f0  and i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9641478 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 it possible I think i\hich\af0\dbch\af31505\loch\f0 t would }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9641478\charrsid216681 \hich\af0\dbch\af31505\loch\f0 be}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid15481295 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 
far more satisfactory to dispose of the case here and now. I can certainly set aside the acquittal of the respondent on the grounds that the reasons given by the magistrate are erroneous, but could I substitute a conviction for the acquittal (wh
\hich\af0\dbch\af31505\loch\f0 
ich would seem to follow naturally from setting aside the acquittal). The magistrate certainly has not helped matters by not dealing properly with the evidence given before him and in most cases it would be impossible to come to any decision without a pro
\hich\af0\dbch\af31505\loch\f0 p\hich\af0\dbch\af31505\loch\f0 er evaluation of the witnesses called and the evidence they gave.
\par \hich\af0\dbch\af31505\loch\f0 But in this case the appeal court seems to me to be in just as good a position as the ma}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6711353 \hich\af0\dbch\af31505\loch\f0 g}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 istrate's court to decide the case. There is vir}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6711353 \hich\af0\dbch\af31505\loch\f0 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid216681\charrsid216681 
\hich\af0\dbch\af31505\loch\f0 ually uncontradicted evidence on oath given for the \hich\af0\dbch\af31505\loch\f0 
prosecution on the one hand and on the other hand at least unsworn evidence amounting only answers by the respondent to questions put to him by the police, answers contradicted by prosecution witnesses on some important points. It was not in dispute that 
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 
he respondent was a wine waiter, who although it was not his job to do so, took an order for sandwiches from the kitchen and took $5.00 from a tourist. He got the sandwiches from the kitchen and took $5.00 from the tourist in payment. It was beyond disput
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 
 that the respondent received the $5.00 not from himself but on behalf of his employer (whether named Fijian Hotel or some other name). It was not disputed that the respondent did not take the money to the cashier as he should have done and the money neve
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0  reached the respondent's employer.
\par \hich\af0\dbch\af31505\loch\f0 The respondent's answer to questions put to him by the police was that he had taken the money to the cook. The cook gave evidence denying receiving any money from the respondent. or that the respondent had shown him the 
\hich\af0\dbch\af31505\loch\f0 money and then left the money on the table. There was also uncontradi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6711353 \hich\af0\dbch\af31505\loch\f0 cted evidence that when the res}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid216681\charrsid216681 \hich\af0\dbch\af31505\loch\f0 pondent was confronted with the fact of the missing $5.00 he offered to repay the money by 50 cents per week. I do not think there can be any serious questi\hich\af0\dbch\af31505\loch\f0 
on of the prosecution witnesses being untruthful witnesses. It can be inferred that if there had been any doubt about this the magistrate would have referred to it in his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16390120\charrsid216681
