Appeal against an order made by the magistrate that appell\hich\af0\dbch\af31505\loch\f0 ant had no right or title to occupy house and a small portion of land going with it being part of a larger area.

\hich\af0\dbch\af31505\loch\f0 Board (Board) by one Sadhu and Kaniamma the mother of the appellant. I\hich\af0\dbch\af31505\loch\f0 n 1973 the respondent has Sadhu's share of the land and in 1976 Kaniarnma's share of the land transferred to him.

\par \hich\af0\dbch\af31505\loch\f0 It was common ground that appellant had no written or registered title to justify his occupation. He claimed that under a family arrangement between himself and his mother Kaniamma\hich\af0\dbch\af31505\loch\f0

 respondent was aware of this licence when Kaniamma transferred her interest to him and was thus bound by it.

only evidence to support his claim that the transfer was subject to the condition above was given by a law clerk who said he took a statement from Kaniamma shortly before her death. Though she spoke only Hindi and was illiterate the statement was taken do
\hich\af0\dbch\af31505\loch\f0 w\hich\af0\dbch\af31505\loch\f0 n in English and in the law clerk's legalistic words.

ansferred to him. At the time and for many years prior to the transfer the appellant lived on the land in a house constructed by him. It is the appellant's occupation of this house and the small portion of land going with it which is the subject of this a

ten or registered title to justify his occupation. What the appellant claimed was that under a family arrangement between himself and his mother Kaniamma he had an equitable licence to occupy the pre\hich\af0\dbch\af31505\loch\f0

his claim that the transfer was effected and the only evidence to support his claim that the transfer was subject to the condition above stated was given by a law clerk who said he took a statement from Kaniamma shortly before her death. The magistrate in
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 the court below was not surprisingly rather sceptical about this statement. It was not an }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 
affidavit}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 \hich\af0\dbch\af31505\loch\f0 ;}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 
 it was not even taken by a notary. It was taken when the old lady was in a very feeble condition and apparently in the presence of the appellant, although \hich\af0\dbch\af31505\loch\f0 the law clerk said otherwise. It was not even in the words or}{

language of Kaniamma who was illiterate and spoke only Hindi. The law clerk took the statement down in English and clearly in his own rather legalistic words\hich\f0 \emdash \loch\f0 as he said it was his own interpreta\hich\af0\dbch\af31505\loch\f0 
tion into English of what she has said}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13113302 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0  he merely produced the statement. Hence }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid13113302\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 its evidential values were}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 
 almost negligible. However there was no evidence from the respondent so it was virtually unchallenged.

t an eviction order against the appellant. Since she had invited the appellant on to the land and allowed him to spend money to build a house and establish a home there the doctrines of equity would no doubt have been sought in the appellant's aid. But th
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0  court could hardly have }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 \hich\af0\dbch\af31505\loch\f0 given}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 
\hich\af0\dbch\af31505\loch\f0  the appellant any right or }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 license}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 
 to the land which would have been in direct conflict with the provisions of section 12 of the Ordinance.

\hich\af0\dbch\af31505\loch\f0 e had considered the position of the family }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 \hich\af0\dbch\af31505\loch\f0 arrangement}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 
\hich\af0\dbch\af31505\loch\f0  he would have come to the same conclusion that I have done}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 
 so that there is no merit in the first ground of appeal.
\par \hich\af0\dbch\af31505\loch\f0 With regard to ground 3\hich\f0 \emdash \loch\f0 it is difficult to see how the appellant could have acquire\hich\af0\dbch\af31505\loch\f0 d an equitable licence to the premises. The respondent was not a parry to the family 
}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 arrangement}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 
 the appellant was not a parry to the transfer to the respondent. The appellant had not acquired any right or licence which would run with the land. It was ple\hich\af0\dbch\af31505\loch\f0 
aded that the respondent was aware when acquired title to the land that it was encumbered with the appellant's equitable licence. There was no evidence to this effect. There were no encumbrances referred to in the transfer deed. As the magistrate pointed 
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 ut}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0 
 the inference was that the land was being transferred to the respondent free from all encumbrances. At the date of transfer there was no caveat lodged on the title. The appellant did lodge a caveat later on 2910/76}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15157075 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0  on what grounds I don't know}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 
\hich\af0\dbch\af31505\loch\f0  but as\hich\af0\dbch\af31505\loch\f0  he said it didn't help. I am not surprised\hich\af0\dbch\af31505\loch\f0  he had no title or right which could be registered}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 ,}{

\par \hich\af0\dbch\af31505\loch\f0 If the respondent knew that the appellant was living on the land}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044 \hich\af0\dbch\af31505\loch\f0  was the
\hich\af0\dbch\af31505\loch\f0 re any reason for him to believe that the appellant's presence there was anything more than the usual Indian family arrangement?

he made it a condition that the appellant should he allowed to remain rent free for his life. Clearly she could not have considered the appellant to have any legal right to remain otherwise the transfer would have referred to such right as an encumbrance.
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 In so far as she may have been purporting to bind the respondent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15157075 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4412044\charrsid4412044
