On the return trip in the evening of 15th May 1977, the accident occurred. The learned Magistrate found and the learned Judge upheld the finding that Ram Asre had a general permission t\hich\af0\dbch\af31505\loch\f0 
o use the van when he wished and that Ganesh his son knew that the celebrations were to take pla}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid419143 \hich\af0\dbch\af31505\loch\f0 ce on Sunday 15th May 1977. Pro}{\rtlch\fcs1 \af0 \ltrch\fcs0

But in fact there is no authority for it. The decisions will be examined by others of your Lordships and I do not find it necessary to make my own review. For I regard it as clear that in order to fix}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12796013

nal concern of the appellant. A finding that there is no evidence of any particular fact is, as we have already pointed out, a matter of law and therefore one open to us to decide. It is abundantly plain that the courts below went as far as they possibly
