\par \hich\af0\dbch\af31505\loch\f0 The prosecution evidence established that on the evening of the 16th July 1978 The appellant was driving a truck along Kings Road in the direction of Suva in a zig-zag manner, o\hich\af0\dbch\af31505\loch\f0 
n and off the footpath, and other road users had to take avoiding}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4148709 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid4148709\charrsid4148709

\hich\af0\dbch\af31505\loch\f0  he was unsteady on his feet and had to be assisted into the police vehicle. At the police station the appellant refused to be examined by a doctor \hich\af0\dbch\af31505\loch\f0 
hut agreed to carry out some tests in the presence of the detective senior inspector on duty. On standing \hich\af0\dbch\af31505\loch\f0 
up he nearly fell over and had to grasp the table for support. He was unable to walk straight, and on being asked to turn round he lost his balance and had to hold on to the wall. With his eyes closed he was unable to touch his nose with his lingers or to
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 place his fingertips together. He admitted having taken gin but could not remember how much he had drunk. The detective senior inspector was of\hich\af0\dbch\af31505\loch\f0 
 the opinion that the appellant was drunk, and he was detained overnight and on the following morning he was ch\hich\af0\dbch\af31505\loch\f0 
arged by the police with drunken driving and with dangerous driving. On the same morning he was taken before Suva Magistrates Court on a charge of drunken driving and dangerous driving to which he pleaded not guilty.}{\rtlch\fcs1 \af0 \ltrch\fcs0

\par \hich\af0\dbch\af31505\loch\f0 At his trial the appellant admitted hav\hich\af0\dbch\af31505\loch\f0 
ing drunk three or four "nips" of gin but denied that he was drunk and called a witness to that effect who had been drinking with him. The appellant also claimed that the reason he was unable to walk in a straight line at the police station was a leg inju
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0 y.
\par \hich\af0\dbch\af31505\loch\f0 The trial Magistrate did not believe the defence and accepted the prosecution evidence, which was sufficient to ground a conviction not only for drunken driving but also for dangerous driving.
\par \hich\af0\dbch\af31505\loch\f0 In his petition of appeal the appellant claims that there wa\hich\af0\dbch\af31505\loch\f0 
s a conflict between the evidence of some of the prosecution witnesses, but having perused the record I am satisfied that there was no material discrepancy. The appellant also maintains that the detective senior inspector, not being an expert witness, was
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 not entitled to say that the appellant was so drunk as to be unfit to drive. That is so, but the detective senior inspector did not presume to testify that th}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid4148709 \hich\af0\dbch\af31505\loch\f0 e appellant was so drunk as to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4148709\charrsid4148709 \hich\af0\dbch\af31505\loch\f0  be unfit to drive. What he did say was that after examining the }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid4148709 \hich\af0\dbch\af31505\loch\f0 app\hich\af0\dbch\af31505\loch\f0 ellant,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4148709\charrsid4148709 \hich\af0\dbch\af31505\loch\f0 
 at Central Police Station he informed him that in his opinion he was drunk to such }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4148709 \hich\af0\dbch\af31505\loch\f0 an extent as to b}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4148709\charrsid4148709 
\hich\af0\dbch\af31505\loch\f0 e incapable of having proper control of a motor vehicle, which was simply a recital of a conversation that had taken place between him and the appel\hich\af0\dbch\af31505\loch\f0 
lant, not evidence of the appellant's incapacity. The appellant also claims that he was not involved in an accident which is irrelevant; and that there was insufficient evidence to convict him of drunken driving}{\rtlch\fcs1 \af0 \ltrch\fcs0

cise incident which have rise to the charge, and even if he is able to recall it the lapse of time may render it difficult or impossible for him to prepare a proper def}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1381779 \hich\af0\dbch\af31505\loch\f0 ence. }{
