\par \hich\af0\dbch\af31505\loch\f0 The facts briefly are as follows. The appellant was charged that on the 24th April}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8205932 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8608365\charrsid1471957 
\hich\af0\dbch\af31505\loch\f0 1976 he committed the following crimes namely arson, contrary to section 353(a) of the Penal Code, attempting to commit arson cont\hich\af0\dbch\af31505\loch\f0 rar}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8205932 
\hich\af0\dbch\af31505\loch\f0 y to section 354(a), shop breaki}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 
ng and larceny contrary to section 353(a), and larceny in a dwelling house contrary to section 302(a). The appellant appeared before the senior magistrate at Nadi on the 26th April 1976 and consented to being tried before\hich\af0\dbch\af31505\loch\f0 
 that court. The appellant was unrepresented by counsel, and after the charges were read and explained he}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8205932 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8608365\charrsid1471957 
\hich\af0\dbch\af31505\loch\f0 pleaded guilty to all charges, except the last charge which was withdrawn, and the appellant discharged thereon. The facts were outlined to the court \hich\af0\dbch\af31505\loch\f0 and admitted by the appellant.
\par \hich\af0\dbch\af31505\loch\f0 
The learned magistrate thereupon convicted the apellant on the 3 counts. Before passing sentence the appellant was asked if there were any matters in mitigation which he wished to place before the court. In the course of his 
\hich\af0\dbch\af31505\loch\f0 remarks the appellant stated that he committed the offences under the influence of liquor; he said:

"While after taking drinks and being under the influence thereof I was compelled to do this. I believe that if I had not taken liquor to soothe my feelings \hich\af0\dbch\af31505\loch\f0 
I would not have done this. I took more than enough. I have been drinking for about 6 hours that day."

The learned magistrate thereupon ordered that a plea of "not guilty" to the 3 counts be entered in order "that a full hearing of the matter is conducted"\hich\af0\dbch\af31505\loch\f0 
. The police inspector who was prosecuting asked that "in view of this change the prosecution would be asking for a preliminary inquiry under section 210 of the Criminal Procedure Code."
\par \hich\af0\dbch\af31505\loch\f0 The appellant was remanded in custody pending trial; the matter was a\hich\af0\dbch\af31505\loch\f0 djourned}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8205932 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0

from time to time until the 3rd June 1976 when the prosecution informed the court that it was not asking for a preliminary inquiry. On 28th June 1976 the matter came before another magistrate and the appellant remained unrepresented; Crown counsel
\hich\af0\dbch\af31505\loch\f0 
 appeared for the prosecution and outlined the evidence that it proposed to adduce at the trial of the appellant. For some inexplicable reason the magistrate proceeded to review the action taken by the senior magistrate in ordering that pleas of not guilt
\hich\af0\dbch\af31505\loch\f0 y\hich\af0\dbch\af31505\loch\f0  be entered to the 3 counts. At the conclusion of the opening remarks by}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8205932 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 the Crown and after the appellant had addressed the court the magistrate ruled that the court should deal with the appellant on the original pleas of guilty entered by him on the 26th
\hich\af0\dbch\af31505\loch\f0 
 April 1976; however, the magistrate decided that in view of this limited jurisdiction the appellant should be sent to the Supreme Court for sentence. On 22nd July 1976 the appellant appeared, unrepresented by counsel, before the Supreme Court at Lautoka 
\hich\af0\dbch\af31505\loch\f0 f\hich\af0\dbch\af31505\loch\f0 or sentence.
\par \hich\af0\dbch\af31505\loch\f0 
The learned judge ruled, quite properly in our view, that the action taken by the second magistrate in attempting to review the proceedings of the senior magistrate lacked jurisdiction, and in law was a nullity. At the stage that the appellant
\hich\af0\dbch\af31505\loch\f0  appeared before the Supreme Court the only pleas extant before the Magistrate}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1471957\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 s Court on the 3 counts were pleas of "not guilty". The learned judge in the Supreme Court proceeded to consider at length the defence of drunkenness in so far as it affected cr
\hich\af0\dbch\af31505\loch\f0 imes committed in Fiji. At the conclusion thereof the learned judge stated that in exercise}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8205932 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 of his powers of review under Section 306 of the Criminal Procedure Code he would strike out the "erroneously entered" pleas of not guilty and restore the original

\insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 s fresh election and plea. Failure to do so has rendered the proceedings a nullity.

th the first ground of appeal; it is clear that when the magistrate ordered pleas of "not guilty" be entered to the three counts the pleas of guilty previously entered by the appellant were withdrawn, if not expressly, at least impliedly. In }{

5] 2 QB 409 the facts were as follows: On a count charging malicious damage to a number of chattels the accused pleaded guilty in respect of one glass only. The plea was not accepted and the trial proceeded on the whole count and the accused was acquitted
.\hich\af0\dbch\af31505\loch\f0  He was then sentenced, however, on the plea recorded in respect of the glass. It was held that there had been an implied withdrawal of the plea of guilty.
\par \hich\af0\dbch\af31505\loch\f0 Lord Parker C.J. at p. 411 said:

ly entered when the appellant stated to the magistrae that at the time of the alleged offences the appellant was under the influence of liquor. There is a consistent line of authority, however, which establishes that if an accused person}{\rtlch\fcs1

\insrsid1471957\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 s order had already expunged\hich\f0 \emdash \loch\f0 
that is the pleas of guilty and the convictions thereon.
\par \hich\af0\dbch\af31505\loch\f0 When the appellant appeared in the Supreme Court he appeared or sentence\hich\f0 \emdash \loch\f0 although as we h\hich\af0\dbch\af31505\loch\f0 ave stated there were no convictions extant on which he could be sentenced
\hich\f0 \emdash \loch\f0 and the only pleas which were properly before the court were pleas of "not guilty".
\par \hich\af0\dbch\af31505\loch\f0 In these circumstances it would not be competent for a judge using his powers of review, to subst\hich\af0\dbch\af31505\loch\f0 
itute pleas of guilty for pleas of not guilty. In fact the learned judge reminded himself of this fact when he said:

The learned judge believed that when he struck out the plea of not guilty, which he said had been entered erroneously, he was able to restore the original pleas of guilt\hich\af0\dbch\af31505\loch\f0 
y and the convictions thereon. In our view, he could not restore the pleas of guilty nor the convictions as they had been expunged from the record for all purposes.
\par \hich\af0\dbch\af31505\loch\f0 The conclusion is inescapable that there were no effect}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8721433 \hich\af0\dbch\af31505\loch\f0 ive pleas in respect of counts I}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0  and\hich\af0\dbch\af31505\loch\f0  II, nor were there any convictions upon which the judge could sentence the appellant. The only effective pleas to counts I an}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid6572680 \hich\af0\dbch\af31505\loch\f0 d II were those of not guilty.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8608365\charrsid1471957 \hich\af0\dbch\af31505\loch\f0 
 Therefore, for the reasons given, we are satisfied that the appeal should be allowed.
\par \hich\af0\dbch\af31505\loch\f0 Accordingly, \hich\af0\dbch\af31505\loch\f0 the convictions are a nullity and we set them aside; we quash the sentences: we order that the informations against the appellant be remitted to the Magistrate}{\rtlch\fcs1 \af0
