nd listed both the respondent and the Mining Appeals Board as respondents. In my view the Board was not a respondent and the parties to this appeal are the appellant and the respondent.
\par \hich\af0\dbch\af31505\loch\f0 At the hearing Mr Scott appeared for the appellant and Mr Johnson for \hich\af0\dbch\af31505\loch\f0 
the respondent. Mr Johnson advised the court that the respondent did not oppose the appeal and was prepared in any event to surrender the prospecting licence.

\hich\af0\dbch\af31505\loch\f0  1974. Application for renewal was dated the 18th day of December 1974.
\par \hich\af0\dbch\af31505\loch\f0 Regulation 27 of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 the Mining Regulations deals w
\hich\af0\dbch\af31505\loch\f0 ith issue of and renewal of prospecting licences. Prospecting}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\hich\af0\dbch\af31505\loch\f0 licence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
991 had expired before application for renewal was made by the respondent but }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6751420 \hich\af0\dbch\af31505\loch\f0 the application was made within 14 days }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 after expiry of the licence. Under subsection 5 of regulation 27 t\hich\af0\dbch\af31505\loch\f0 he appellant as Director of Mines had a discretion to extend the licence.
\par \hich\af0\dbch\af31505\loch\f0 In considering the application the appellant could quite properly consider whether the respondent had complied with the provisions of the Mining Ordinance and whether the conditions \hich\af0\dbch\af31505\loch\f0 
of the licence had been observed and performed by the respondent to the appellant's satisfaction. Due performance by an applicant for renewal of a licence of the provisions of the Ordinance and conditions of the licence to the satisfaction of the Director
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 of Mines is required under subsection 4 of regulation 27 and if the Director is satisfied on payment of prescribed fees within a stated}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid395013 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 period a renewal is mandatory although the Director has a discretion as to the period of renewal.
\par \hich\af0\dbch\af31505\loch\f0 The discretion of the \hich\af0\dbch\af31505\loch\f0 
Director in subsection 5 is a wide one and is expressly not limited in any way by subsection 4. Notwithstanding breaches by an applicant the Director may grant an extension, as the appellant had done in respect of a prior application by the respondent.

\par \hich\af0\dbch\af31505\loch\f0 The\hich\af0\dbch\af31505\loch\f0 
 Mining Appeals Board found as a fact that the respondent failed to comply with the conditions of its licence in 1974. There is also ample evidence in the record of the proceedings to indicate that the respondent }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid395013 \hich\af0\dbch\af31505\loch\f0 had not complied with the condi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 tion set out\hich\af0\dbch\af31505\loch\f0  in regulation 30(1) (}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \i\insrsid15417373\charrsid7109811 \hich\af0\dbch\af31505\loch\f0 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
) and had been in breach of this condition from sometime in 1972 up to the date of its application for renewal. The appellant, despite prior breaches by the respondent, was prepared to renew the licence on condition that the responde
\hich\af0\dbch\af31505\loch\f0 nt, put up a substantial bond for due performance and if it submitted a better work programme, which the respondent was not prepared to do.
\par \hich\af0\dbch\af31505\loch\f0 The appellant refused to renew the licence due to the appellant's past failures to comply with the conditions of the\hich\af0\dbch\af31505\loch\f0 
 licence and in particular its failure in 1974 to carry out work incurring expenditure of up}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14878321 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\hich\af0\dbch\af31505\loch\f0 to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 \hich\af0\dbch\af31505\loch\f0 $}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
68,000.00, a figure which the respondent had itself suggest\hich\af0\dbch\af31505\loch\f0 ed in a prior application for renewal and was an express condition of the prior renewal. The Board in considering the appeal by the respondent stated}{\rtlch\fcs1

\ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 sion is based mainly\hich\af0\dbch\af31505\loch\f0  on the following reasons:\hich\f0 \emdash

\hich\af0\dbch\af31505\loch\f0 tions of their licence in 1974, the company}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0  has given staisfactory explana}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\hich\af0\dbch\af31505\loch\f0 tion as to why the amount specified was not spent and why it failed to carry \hich\af0\dbch\af31505\loch\f0 out its programme of works. Furthermore, it is clear from the evidence from}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid14448712 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
both sides that the figure of $68,000 was in fact fixed by the Director of Mines from the programme of works whic}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid395013 \hich\af0\dbch\af31505\loch\f0 h the appellant company had sub}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 mitted.

pecting licence. The company intends to make a final effort to decide on the viability of this venture, and we feel that it would be unfair and unreasonable in view of the extent of the \hich\af0\dbch\af31505\loch\f0 
large expenditure already incurred by them so far to refuse a final opportunity.

{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14688255\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 future prospector. We consider that it is in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14688255 \hich\af0\dbch\af31505\loch\f0  the national interest that
\hich\af0\dbch\af31505\loch\f0  an}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 opportunity should be
\hich\af0\dbch\af31505\loch\f0  given to the company which has done so much work \hich\af0\dbch\af31505\loch\f0 on the land to arrive at a definite conclusion on the viability of the venture. Any new prospector would, in all probabil}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0 ity, have \hich\af0\dbch\af31505\loch\f0 to make a fresh begin}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
ning and would not have all the information which the appellant company possesses in respect of this licence, the subject matter of this appeal.

cal with the conditions the appellant had sought}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0  to impose and which the respon}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
dent was not prepared to accept. Mr Scott argued (inter alia) before the Board and before this court tha\hich\af0\dbch\af31505\loch\f0 
t the Board could not legally override the proper exercise by the appellant of his discretion. This is the main issue in this appeal.
\par \hich\af0\dbch\af31505\loch\f0 Section 10 of the Mining Ordinance created th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 \hich\af0\dbch\af31505\loch\f0 e Board. Apart from the powers}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\hich\af0\dbch\af31505\loch\f0  specified in subsections (4) and (6) the secti\hich\af0\dbch\af31505\loch\f0 on is si}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 \hich\af0\dbch\af31505\loch\f0 lent as to any other powers con}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
ferred on the Board. Subsection (3) permits a person aggrieved by any decision of the Director to appeal to the Board. The provision of a right of appeal must carry with it a corresponding obligation or power by the B\hich\af0\dbch\af31505\loch\f0 
oard to hear the appeal and sub-section (7) referring to the decision of the Board indicates that the Board is empowered to make a decision}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0  on the hearing of the appeal. }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\par \hich\af0\dbch\af31505\loch\f0 It is clear from the wording of subsection (3) referring to "any decision of the Dire\hich\af0\dbch\af31505\loch\f0 ctor" that a decision arrived at by the Director }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 
\hich\af0\dbch\af31505\loch\f0 in exercise of a discretion con}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 ferred on him by the Ordinance or failure to ex}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14688255 
\hich\af0\dbch\af31505\loch\f0 ercise his discretion is appeal}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 able.
\par \hich\af0\dbch\af31505\loch\f0 It must also be assumed that the legislature in not spelling out the Board's powers in more\hich\af0\dbch\af31505\loch\f0  detail intended that the full scope of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7109811 
\hich\af0\dbch\af31505\loch\f0  the Board's powers should not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0  be detailed but conversely}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14688255 
\hich\af0\dbch\af31505\loch\f0  there is nothing in section 10}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
 which expressly or by inference empowers the Board to ignore established legal principles when hearing an appeal.
\par \hich\af0\dbch\af31505\loch\f0 The mandatory\hich\af0\dbch\af31505\loch\f0  requirement that one member of the Board shall be a barrister and solicitor indicates clearly that in hearing an appeal the Board should be guided}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid10178585 \hich\af0\dbch\af31505\loch\f0  by such legal principles. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\par \hich\af0\dbch\af31505\loch\f0 In considering the exercise of powers of the Board the objects of the Ordinance m\hich\af0\dbch\af31505\loch\f0 ust be considered and in this case where the powers}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13723762 
\hich\af0\dbch\af31505\loch\f0  are exercised for a public pur}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
pose section 10 must be construed more liberally than would be the case of powers given to a private corporation for objects of gain. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15417373\charrsid7109811 \hich\af0\dbch\af31505\loch\f0 Th}{\rtlch\fcs1 \af0

\hich\af0\dbch\af31505\loch\f0 ny person aggrieved by any deci}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 sion of the Director of Mines. It must}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14878321 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 be inferred that the Board has powers either to give or recommend re\hich\af0\dbch\af31505\loch\f0 dress to such gri}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14878321 \hich\af0\dbch\af31505\loch\f0 evance if section 10 is to have }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 any operative effect in righting grievances.

\par \hich\af0\dbch\af31505\loch\f0 The extent of such inferred powers is what is in issue here. The duty to hear an appeal from any decision of the Director includes an appeal from a decision invol\hich\af0\dbch\af31505\loch\f0 
ving an exercise of the Director's discretion or failure to exercise it. Being of the view that the Board has power to hear an appeal on a matter involving the exercise of or failure to exercise a discretion by the Director specifically provided by regula
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 
ion 27(5) the next question to resolve is whether the Board has a discretion to ignore the Director's decision and itself consider the merits of the respondent's application for renewal or whether it should confine itself to the question whether the Direc
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 or}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
acted properly in refusing to exercise his discretion.
\par \hich\af0\dbch\af31505\loch\f0 Section 10 of the Mining}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
Ordinance does not specifically provide a discretion for the Board or power to substitute its own discretion for the discretion of the Director such as is specifically provi\hich\af0\dbch\af31505\loch\f0 
ded by section 69(9) of the Income Tax Act 1974 which reads:\hich\f0 \emdash

Its duty under section 10 is, I consider, to determine whether the Director acted properly in refusing to renew the licence to the respondent. The Director has a d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0 is}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
cretion specifically conferred on him by law either to renew or refuse the renewal. If the facts adduced by the respondent indicated the Director had not acted properly then there is no doubt in my mind the Board was empowered to so decide and allow the a
\hich\af0\dbch\af31505\loch\f0 p\hich\af0\dbch\af31505\loch\f0 peal. As to the effect of su}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14878321 \hich\af0\dbch\af31505\loch\f0 ch a decision}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13830338 \hich\af0\dbch\af31505\loch\f0 I }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
cannot read into section 10 a power by the Board to grant a renewal of the licence which by law is vested in the Director. There would in my view have to be an express power. In practice I have no doubt a Director \hich\af0\dbch\af31505\loch\f0 
would follow the opinion or recommendation of the Board. In this instance the Board expressed its opinion that the licence should be renewed on terms. While the Board clearly understood its function namely, as it stated in its decision "to consider whethe
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0  the decision of the Director of Mines was fair and reasonable" it appears to me from a perusal of its decision that it lost sight of this}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 function and substituted its own views on the merits of the respondent's application thus ignoring well established p
\hich\af0\dbch\af31505\loch\f0 rinciples when considering the exercise of a statutory discretion.
\par \hich\af0\dbch\af31505\loch\f0 Before considering the legal principles which the Board should have considered the main facts should first be stated.
\par \hich\af0\dbch\af31505\loch\f0 There was no dispute that until the end of the first quarter of 1972 th\hich\af0\dbch\af31505\loch\f0 ere was active}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 prospecting by the respondent but from that date onward there was a continued }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7109811 \hich\af0\dbch\af31505\loch\f0 
breach of the condition of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 licence implied by regulation 30(1) (a) which provides:\hich\f0 \emdash

\par \hich\af0\dbch\af31505\loch\f0 It is common ground that no such application was made by the respondent to the Director and had the difficulties faced by the res}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14878321 \hich\af0\dbch\af31505\loch\f0 
pondent been placed before the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0  Director suspension of the conditions might have been granted.
\par \hich\af0\dbch\af31505\loch\f0 In December 1973 the resp\hich\af0\dbch\af31505\loch\f0 ondent applied for a rene}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14878321 \hich\af0\dbch\af31505\loch\f0 wal of the licence and sub}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 mitted a proposed work programme involvi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13830338 \hich\af0\dbch\af31505\loch\f0 ng an expenditure of $68,000.00.}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0  The Director approved the renewal conditionally on a sum of $68,000.00 being spent on a works programme. The respondent in 1974 spen\hich\af0\dbch\af31505\loch\f0 
t $7,517.00 prospecting and, if work done by another company is taken into account, the total expenditure on the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 licensed area was close to $15,000.00 a sum far short o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0 f the $68,000.00. }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15417373\charrsid15417373 
\par \hich\af0\dbch\af31505\loch\f0 The respondent did not seek suspension of the conditions of the licen\hich\af0\dbch\af31505\loch\f0 ce in 1974 but when applying in December 1974 for a ren}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 
\hich\af0\dbch\af31505\loch\f0 ewal again submitted a work pro}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
gramme indicating an estimated expenditure of $60,000.00. The Director although dissatisfied with the respondent's past failures would have favourably considered a furthe\hich\af0\dbch\af31505\loch\f0 r renewal if he could have been satisfied that }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585 \hich\af0\dbch\af31505\loch\f0 the respondent intended expen}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 diture of up to $60,000.00.
\par \hich\af0\dbch\af31505\loch\f0 The respondent was unable to so sa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0 tisfy the Director. The evidence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\hich\af0\dbch\af31505\loch\f0  given by the respondent before the Board indicated clearly that the respondent was no\hich\af0\dbch\af31505\loch\f0 t prepared to spend the whole of the $60,000.00 itself but soug}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid14448712 \hich\af0\dbch\af31505\loch\f0 ht participation by another com}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
pany to spread the risk. Evidence indicated prior failures by the respondent to interest other parties in a joint venture and there was no evidence before the Boa\hich\af0\dbch\af31505\loch\f0 
rd of any firm prospect of so interesting another party during the term of any further renewal of the licence.
\par \hich\af0\dbch\af31505\loch\f0 These were the basic facts within the knowledge of the Director when considering the last application for a renewal and were facts l}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0 aid before}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0  th\hich\af0\dbch\af31505\loch\f0 e Board.
\par \hich\af0\dbch\af31505\loch\f0 Being of the opinion that the Board is empowered under section 10 of the Mining Ordinance to determine whether the exercise by the Director was prop}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10178585

n view of the extent of the large expenditure already incurred by the respondent to refuse the respondent "a final opportunity", and allowed the appeal.
\par \hich\af0\dbch\af31505\loch\f0 It is from this decision that the appellant appeals to this court.

the Board was empowered to ignore the app}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0 ellant's exercise of his discre}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
tion and was itself invested with a discretionary power to consider the application for renewal these further grounds would have to be consid\hich\af0\dbch\af31505\loch\f0 
ered. In my view section 10 in this instance empowered the Board only to consider whether the appellant had properly exercised his discretion.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14448712 \hich\af0\dbch\af31505\loch\f0 A discretion specifically prov}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
ided by the legislature in regulation 27(5) of the Mining Regulations to be exercis\hich\af0\dbch\af31505\loch\f0 
ed by a person holding the position held by the appellant, an expert in his field, is not to be lightly disregarded. Had the legislature intended the Board to come to a decision by ignoring the appellant's decision and giving the Board a discretion of its

o renew a licence such a power would have to be specifically provided as was provided for example in section 69(9) of the Income Tax Act 1974 to which I have already referred.

\par \hich\af0\dbch\af31505\loch\f0 The Board considered the respondent had given satisfactory explanations as to why it had not incurred the expenditure specified}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6258500 \hich\af0\dbch\af31505\loch\f0 
. The main reason for not incur}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 ring the expenditure specified wa\hich\af0\dbch\af31505\loch\f0 
s the respondent's efforts to interest other parties to enter into a joint venture in order to spread the financial risk. Reports during the period in question were pessimistic and the re}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14878321

spending its own money in carrying out the work required of it, notwithstanding the express conditions of its licence unless it c}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1848403 \hich\af0\dbch\af31505\loch\f0 ould interest another person in }{\rtlch\fcs1

In that case the Mining Board held that no reasonable cause had been shown for the breach.

g period of time and on my consideration of the explanation given by the respondent I would not hold that such explanation was a reasonable one and particularly where the regulations gave the respondent an opportunity, which it did not take, of obtaining 
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0 elief from the conditions imposed. I cannot find in the evidence any reasonable or legitimate excuse for the continued breach.
\par \hich\af0\dbch\af31505\loch\f0 So far as the large sum expended by the respondent is concerned such expenditure was incurred in the main }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12256423 \hich\af0\dbch\af31505\loch\f0 before the first quarte
\hich\af0\dbch\af31505\loch\f0 r in 197}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
2. After that date the expenditure was neglible in relation to the ceiling figure of $60,000.00 which in two successive years the respondent in its own applications stated it would be spending.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1848403 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 I do not consider it would be unfair or unreasonable t\hich\af0\dbch\af31505\loch\f0 o refuse a renewal in the cir}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1848403 \hich\af0\dbch\af31505\loch\f0 cumstances then pertaining, be}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 
cause the respondent had already spent a lot of money. The Board's opinion that it would be unfair or unreasonable not to give the respondent a last chance,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid1848403 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0

\insrsid15417373\charrsid15417373 \hich\af0\dbch\af31505\loch\f0 were properly furnished the appellant would be in possession of a considerable amount of information, although not necessarily all such information, and in the interest of the nation he co
\hich\af0\dbch\af31505\loch\f0 uld make such informa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9440229 \hich\af0\dbch\af31505\loch\f0 tion available to other prospec}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15417373\charrsid15417373 
\hich\af0\dbch\af31505\loch\f0 tors. It is also in the national interest that an area with potential mineral wealth should be vigorously prospected and if a prospector fails and continues to fail to abide by the conditions of his licen
\hich\af0\dbch\af31505\loch\f0 ce it is reasonable that the area should be given to someone prepared to properly prospect the area.
\par \hich\af0\dbch\af31505\loch\f0 It still falls to this court to consider whether the appellant properly exercised his discretion.
\par \hich\af0\dbch\af31505\loch\f0 
Applying the principles referred to earlier I can find no evidence that the appellant did not exercise his discretion in a proper and reasonable manner. If anything the evidence indicates considerable latitude on the part of the appellant which he was leg
\hich\af0\dbch\af31505\loch\f0 a\hich\af0\dbch\af31505\loch\f0 lly entitled to grant.
\par \hich\af0\dbch\af31505\loch\f0 I would allow the appeal and set aside the decision of the Mining Appeals Board. The result will be that the licence expired on the 17th day of December 1974.
\par \hich\af0\dbch\af31505\loch\f0 As Mr Scott indicated he was not seeking costs there will be no order as t\hich\af0\dbch\af31505\loch\f0 o costs. Appeal is allowed with no order as to costs.
