\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3172539 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8934025\charrsid6847196 \hich\af0\dbch\af31505\loch\f0 
The defendant who is 86 years of age has been living on the land since about 1907. Contrary to his pleading\hich\af0\dbch\af31505\loch\f0 
s the defendant in his evidence claims to be the sole rightful owner of the land. According to him the land was desolate and uninhabited and covered with thick bush when he moved in after obtaining permission to do so from a Ratu Aporosa, a high chief of 
\hich\af0\dbch\af31505\loch\f0 S\hich\af0\dbch\af31505\loch\f0 uvavou. The defendant and his family have for a good many years had their own houses built and food crops grown on the land.
\par \hich\af0\dbch\af31505\loch\f0 Since the plaintiff became the owner of the property there has been continual friction between the parties arising from the plainti\hich\af0\dbch\af31505\loch\f0 
ffs attempts to get the defendant and his family out of the land. The defendant has shown no inclination to leave the land. He thinks he has every right to remain on the land in which he has lived for the best part of his life.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8934025\charrsid3172539 \hich\af0\dbch\af31505\loch\f0 On the material before me, i\hich\af0\dbch\af31505\loch\f0 
t is clear that the ownership of the land cannot now be seriously disputed. Whatever its earlier history might have been, the property has since been made subject to the provisions of the Land (Transfer and Registration) Ordinance (Cap. 136) which though 
\hich\af0\dbch\af31505\loch\f0 l\hich\af0\dbch\af31505\loch\f0 
ater repealed, have been re-enacted and replaced by the Land Transfer Act, 1971. Since then the only legally acceptable method of obtaining title to the land was by registration under the provisions of the Ordinance or Act, as the case maybe. As noted abo
\hich\af0\dbch\af31505\loch\f0 v\hich\af0\dbch\af31505\loch\f0 e the title to the property in this case was transferred and registered in the name of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3172539\charrsid3172539 \hich\af0\dbch\af31505\loch\f0 
plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8934025\charrsid3172539 \hich\af0\dbch\af31505\loch\f0  in 1955 from which time he became the legal owner thereof. Counsel for the defendant concedes the position so far as the }{\rtlch\fcs1 \af0

s Court. However, these proceedings were compromised and withdrawn in both cases after a settlement was reached between the parties. The terms of settlement were recorded by the presiding magistrate and as noted above, are not disputed on either side.

\par \hich\af0\dbch\af31505\loch\f0 O\hich\af0\dbch\af31505\loch\f0 
n behalf of the plaintiff it is contended that the settlement had never been signed by either party nor its terms complied with by the defendant. It is therefore claimed that the settlement has no binding force and the defendant is precluded from relying 
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 
n its terms as creating a life tenancy in the land in favour of the defendant. According to the plaintiff, the defendant has never paid any rent on the land which he has been occupying as a squatter. According to the plaintiff a notice dated}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid3172539 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8934025\charrsid6847196 \hich\af0\dbch\af31505\loch\f0 28th June 1972\hich\af0\dbch\af31505\loch\f0 
 (Ex. 19) to quit the land was duly served on the defendant but the defendant has failed or omitted to comply with such notice.
\par \hich\af0\dbch\af31505\loch\f0 On behalf of the defendant it is contended that the said settlement gave the defendant a life tenancy in the land which is irrev\hich\af0\dbch\af31505\loch\f0

 to draw any legal conclusions from them. In any event the conditions were apparently not considered important enough by the plaintiff because despite certain alleged breaches thereof no legal action was taken concerning the matter when it might have been
