and a stoppage would do him considerable damage. He pointed out that the offence had been hanging over the respondent's heads for over a year, and had doubtless caused them considerable mental strain, and that the injured man might be able to claim damage

sons are convicted of assault with intent to cause grievious harm, the need for a deterrent sentence out-weighs all other considerations. In my view the learned magistrate erred in principle in suspending the sentence and I set aside the learned magistrat

the judge in the passage just quoted of the opinion that a deterrent\hich\af0\dbch\af31505\loch\f0 
 sentence out-weighed all other considerations. Such an expression of opinion by a judge of the Supreme Court might mislead magistrates into thinking that in any offence of the nature mentioned, the deterrent aspect of sentence was all that he }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9777833 \hich\af0\dbch\af31505\loch\f0 needed to co\hich\af0\dbch\af31505\loch\f0 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 
sider. We do not ourselves on a fair reading of the whole of the judgment consider that it should be interpreted in this way and we think that the danger of magistrates}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9777833 \hich\af0\dbch\af31505\loch\f0  }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 being mislead would be minimal. He had earlier, in his judgment, related the facts and\hich\af0\dbch\af31505\loch\f0 
 considered matters personal to the appellants}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11365863 \hich\af0\dbch\af31505\loch\f0  in relation to the alleged pro}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 
vocation and he mentioned the possibility of the appellants having been under some mental strain.

Mr Koya also submitted that as far as practicable there should be uniformity or c\hich\af0\dbch\af31505\loch\f0 
onsistency between sentences passed by the various courts for like offences. He was not however able to demonstrate from other judgments relating to the area in which this offence took place that the sentence passed by the learned judge in the Supreme Cou
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0 t was in fact out of line with those passed for other like offences. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10378121\charrsid412142 \hich\af0\dbch\af31505\loch\f0 R v Chanan Singh }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 in which a suspended sentence of two years' imprisonment was passed for the crime of manslaughter, was obviously a case of very special circumstances.
\par \hich\af0\dbch\af31505\loch\f0 Counsel for the res\hich\af0\dbch\af31505\loch\f0 pondent submitted that the sentence was consistent with }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0 those in recent cases such as }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid412142\charrsid412142 \hich\af0\dbch\af31505\loch\f0 R}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10378121\charrsid412142 \hich\af0\dbch\af31505\loch\f0  v Shaukat Ali}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0  22 FLR 85 and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10378121\charrsid412142 \hich\af0\dbch\af31505\loch\f0 Jagdishwar Singh v R}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 
\hich\af0\dbch\af31505\loch\f0  22 F}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 LR 115, and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10378121\charrsid412142 \hich\af0\dbch\af31505\loch\f0 R v Masla Mani}
{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0  SCA 13/76 which indicated the concern with which the judges in the area viewed the use o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 
\hich\af0\dbch\af31505\loch\f0 f cane knives as weapons in that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 
part of Fiji. If judges in a certain area come to the conclusion that cases of crimes of violence of a particular type are so prevalent that great prominance must be given to the deterrent aspect of punishment that is a mat\hich\af0\dbch\af31505\loch\f0 
ter within their province. Therefore while we think that the learned judge might well have qualified his reference to a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0 eterrent sentence by some such }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 
\hich\af0\dbch\af31505\loch\f0 words as "except in very unusual circumstances" we do not think that he misdirected himself in coming to\hich\af0\dbch\af31505\loch\f0  his decision in the particular case. We would not therefore, on appeal, come to the }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 conclusion}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0  that his finding was wrong in law.

It is provided by subsections 3 and 4 of that section that an appeal to the Supreme Court may be on a matter of fact as well as a matter of law, and that for t\hich\af0\dbch\af31505\loch\f0 
he purposes of the particular part of the Code the extent of the se}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0 ntence shall be deemed to a mat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 
\hich\af0\dbch\af31505\loch\f0 ter of law. The last mentioned provision has no application to the second appeal to this court.
\par \hich\af0\dbch\af31505\loch\f0 It is Mr Koya's submission that the appeal to this court }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0 does \hich\af0\dbch\af31505\loch\f0 not involve a matter of th}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 
e severity of sentence. He submits that when section 22 above quoted, came into being there was no such thing as a suspended sentence, the right to order which, was enacted by amendment of the Penal Code in 1969. With respect this
\hich\af0\dbch\af31505\loch\f0  fact does not prevent the operation of section 22 in relation to a su}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid667064 \hich\af0\dbch\af31505\loch\f0 spended sentence if it is other}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 wise applicable. But it is argued further that the appeal to the Supreme Court by the present respondent was against, not the sentence of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 
\hich\af0\dbch\af31505\loch\f0 two years, but t\hich\af0\dbch\af31505\loch\f0 he order sus}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 
pending that sentence; the appeal did not touch on the sentence, which remained unchanged. Section 28(A) of the Penal Code, which authorises suspended sentences opens with the words "a Court which passes a sentence of imprisonmen}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid12256700 \hich\af0\dbch\af31505\loch\f0 t }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 for a term}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0  }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 of\hich\af0\dbch\af31505\loch\f0  not more than two years for an offence, may order that the sentence shall not take}{\rtlch\fcs1 \af0 \ltrch\fcs0

\ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 " during a period specified in the order. Mr Koya argued therefore that the appeal to this court lay from a "decision" of the Supreme Court "sitting on appeal from a
\hich\af0\dbch\af31505\loch\f0 n order" and that the length of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0 period of imprisonment was not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 
\hich\af0\dbch\af31505\loch\f0  touched.
\par \hich\af0\dbch\af31505\loch\f0 This is a persuasive argument though in fact the appeal to the Supreme Court was worded as an appeal against "the sentence" and the order of the learned judge was that he set aside\hich\af0\dbch\af31505\loch\f0 
 the sentence in each case and imposed a sentence of two years' imprisonment. The difficulty concerning this argumen}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0 t is that it is open to the Sup}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 reme Court to vary the term of imprisonment imposed by the magistrate and this has, we were informed by couns\hich\af0\dbch\af31505\loch\f0 
el for the respondent, been done in the two cases abovementioned }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10378121\charrsid412142 \hich\af0\dbch\af31505\loch\f0 R v Shaukat Ali}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 
\hich\af0\dbch\af31505\loch\f0  and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid10378121\charrsid412142 \hich\af0\dbch\af31505\loch\f0 R v Jagdishwar Singh}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 
. It is no doubt only incidental that the learned judge in the present case did not find it necessary to vary the term of years.

t is possible to restrict the meaning of the phrase "severity of sentence" in section 22(1) of the Court of Appeal Ordinance to questions of the actual length of term imposed. The difference between the severity of a suspended sentence of two years' impri
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0 
onment and one which is not so suspended, is manifest. Other instances where a similar principle would be involved, readily come to mind. If the magistrate for example imposed a fine and the Supreme Court on appeal replaced the fine by a prison sentence w
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 
uld not an appeal to this court raise the question of severity? If a magistrate admitted a person to probation, and again a term of imprisonment was substituted by the Supreme Court there is no escape from the fact that an appeal to this court would invol
\hich\af0\dbch\af31505\loch\f0 v\hich\af0\dbch\af31505\loch\f0 
e severity of sentence. It may seem an apparent injustice that where the first appeal to the Supreme Court is brought by the Director of Public Prosecutions and he is successful, that no further appeal will lie at the suit of the prisoner. This, however, 
\hich\af0\dbch\af31505\loch\f0 i\hich\af0\dbch\af31505\loch\f0 
s a matter for the legislature to remedy, if it is considered a defect. But it is undoubtedly the position in a straightforward appeal where the original sentence is (say one year) and the Director o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 
\hich\af0\dbch\af31505\loch\f0 f Public Pro}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 secutions is successful in having that senten\hich\af0\dbch\af31505\loch\f0 ce increased in the Supreme}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid412142 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 Court. It is not possible, the terms of section 22(1}{\rtlch\fcs1 \af0 \ltrch\fcs0

 any way hinge on the question, which party to the magisterial\hich\af0\dbch\af31505\loch\f0  proceedings brought the first appeal.
\par \hich\af0\dbch\af31505\loch\f0 We read section 22(1) as meaning that there is no jurisdiction to entertain an appeal against sentence which goes to the quantum or extent of a sentence even if a question of law is}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid12256700 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 involved. In our opinion the questi\hich\af0\dbch\af31505\loch\f0 
on of severity is not eliminated by the substitution of one category of punishment for another. It might seem that such an argument would prevent an appeal even if the sentence were beyond the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12256700 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10378121\charrsid10378121 \hich\af0\dbch\af31505\loch\f0 powers of the Magistrate's Court or the Supreme Court. We do no\hich\af0\dbch\af31505\loch\f0 
t think so. Such a sentence would be illegal and without jurisdiction; as such it would be a nullity and could impose no degree of severity at all, which would result in there being a question of law to be resolved on the second appeal the result of which
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 would determine the existence or otherwise of the sentence.
\par \hich\af0\dbch\af31505\loch\f0 For these reasons we consider that the present appeal involves severity of sentence and we have no jurisdiction to entertain it. In case we should be wrong in this respect, we have considered the
