n all probability have been paid in full. The position might have been different if $1,000 was all respondent was able to or had raised by a crop lien and he had told appellant before payment was made. That is not this case.
\par \hich\af0\dbch\af31505\loch\f0 The statement by the uncle that\hich\af0\dbch\af31505\loch\f0 
 $1,000 was all the money available (for that is the effect of what he said) was untrue so far as concerns respondent. Respondent had $1,400 and sent his uncle forth with only $1,000. Any representation such as that made by the uncle was false qua respond
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 
nt. Respondent had $1,400 available for the purpose and the existence of $400 was suppressed. No equity can be founded on such a falsehood. One cannot, however, blame respondent for endeavouring to get the best settlement but his agent went too far.

\par \hich\af0\dbch\af31505\loch\f0 Counse\hich\af0\dbch\af31505\loch\f0 l for respondent relied solely on a submission that the bankruptcy notice, extant at the time when $1,000 was paid, should have been set aside on the ground}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid13379225 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6170888\charrsid7803741 \hich\af0\dbch\af31505\loch\f0 that the debt had been compounded to the satisfaction of appellant in terms of the notice itself\hich\f0

 in discharging the obligation to pay. The clear issue here is whether or not promissory estoppel is a shield for respondent. The exercise of the power of the Court to act on the bankruptcy notice once it is proved that the sum is still owing is not a mat
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 er before this Court.
\par \hich\af0\dbch\af31505\loch\f0 I would allow the appeal with an order as to costs as proposed by the learned Vice President.
\par \hich\af0\dbch\af31505\loch\f0 GOULD V.P.:

I have had the opportunity of reading the judgment of Henry J.A. in this case and for the reasons he has given I agree that the \hich\af0\dbch\af31505\loch\f0 
appeal must be allowed. I do so with regret, as the findings of the learned trial judge indicate that the conduct of the appellant in the transaction was very much open to criticism. Also it could be argued on behalf of the respondent that there was an as
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0 umption that he would suffer some detriment, in that he would, after the settlement with the appellant,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13379225\charrsid14571949

have conducted his affairs as a man freed from any threat of bankruptcy. But there was no evidence to support this approach, and as is indicated in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6170888\charrsid14571949 \hich\af0\dbch\af31505\loch\f0 Tool
\hich\af0\dbch\af31505\loch\f0  Metal Co v Tungstan Electric Co.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6170888\charrsid14571949 \hich\af0\dbch\af31505\loch\f0  [1955] 2 All ER 657 it lay upon the respondent to prove his detriment.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6170888\charrsid7803741 \hich\af0\dbch\af31505\loch\f0 The learned judge said that there was no false promise on the part of Chinsami which might have induced the appellant to give }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid14571949 \hich\af0\dbch\af31505\loch\f0 the receipt under a misapprehen}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6170888\charrsid7803741 \hich\af0\dbch\af31505\loch\f0 
sion. That may be strictly so, but there was a false representation that $1,000 was all that was available. This, with the statement that if he did not take the $1,000 he might get it in bits and pieces, brings the facts very
\hich\af0\dbch\af31505\loch\f0  close to those in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6170888\charrsid14571949 \hich\af0\dbch\af31505\loch\f0 D. & C. Builders Ltd. v Rees}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6170888\charrsid7803741 
\hich\af0\dbch\af31505\loch\f0  [1965] 3 All ER 837, which the learned judge relied upon and in which it was held that there was no true accord.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6170888 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14571949\charrsid7803741 \hich\af0\dbch\af31505\loch\f0 I agree that the submission of counsel for th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15607706 \hich\af0\dbch\af31505\loch\f0

t be entertained in these proceedings as it was not an issue in the Supreme Court. I do not however wish to be taken as expressing any opinion on the question whether only a binding agreement can amount to a compounding.
\par \hich\af0\dbch\af31505\loch\f0 All members of the Court being of t\hich\af0\dbch\af31505\loch\f0 he same opinion the appeal is allowed and the order setting aside the bankruptcy notice is quashed. There will be no order for costs in either Court.

 learned brothers, that the appeal must be allowed. The action of the Appellant in issuing a series of four bankruptcy notices since 25th February 1970, and taking no action on the first three, appears on the face of it to amount to a gross abuse of judic
\hich\af0\dbch\af31505\loch\f0 i\hich\af0\dbch\af31505\loch\f0 al process; and this Court should be slow to afford him any assistance in his course of action.
\par \hich\af0\dbch\af31505\loch\f0 The law on the subject is however, well established, that in the absence of a true ac\hich\af0\dbch\af31505\loch\f0 
cord and satisfaction, or of what is referred to by Henry J.A. as promissory estoppel, payment of part of a debt, even if accepted as payment in full, does not debar the creditor from suing for the balance. As is said in Jowitt}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid7803741\charrsid7803741 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6170888\charrsid7803741 \hich\af0\dbch\af31505\loch\f0 s Dictionary of English Law,\hich\af0\dbch\af31505\loch\f0 
 the agreement is the accord, and the satisfaction is the consideration for it. For reasons clearly set out in the judgment of Sir Trevor Henry, there was in this ease no consideration for the acceptance of part of the debt in settlement of the whole debt
\hich\af0\dbch\af31505\loch\f0 ;\hich\af0\dbch\af31505\loch\f0  and so, though there was accord, there was no satisfaction.
\par \hich\af0\dbch\af31505\loch\f0 Accordingly, slightly paraphrasing the words of Winn L.J. in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid6170888\charrsid14571949 \hich\af0\dbch\af31505\loch\f0 D. and C. Builders Limited v Rees}{\rtlch\fcs1 \af0 \ltrch\fcs0
