\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 they were not therefore vicariously liable for his negligence.
\par \hich\af0\dbch\af31505\loch\f0 I note that in the statement of claim, the vicarious liability of the defendants/respondents was based on the allegation that their van was being driven at the material time with their "knowled\hich\af0\dbch\af31505\loch\f0

ship between the owners and driver of the vehicle was made. The plaintiff relied solely on the existence of a relationship of bailor and bailee. The defendant/respondent\hich\af0\dbch\af31505\loch\f0 
s denied any "knowledge, authority and consent" in their defence. The Court below did, however, find against the defendants on this issue. Although the evidence upon which such a finding was based is of an extremely tenuous nature and is based upon infere
\hich\af0\dbch\af31505\loch\f0 n\hich\af0\dbch\af31505\loch\f0 ce only there was, in fact, some evidence upon which this finding could be based. No cross}{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8457960\charrsid8457960

appeal has been lodged and no complaint was made by or on behalf of the defendants against this particular finding and I shall therefore deal with this appeal on the\hich\af0\dbch\af31505\loch\f0 
 basis of the unchallenged findings of the Court below on this issue.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114884\charrsid8457960 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114884\charrsid14114884 \hich\af0\dbch\af31505\loch\f0 I will deal first with the second ground}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8457960 \hich\af0\dbch\af31505\loch\f0  of appeal that there was suffi}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114884\charrsid14114884 \hich\af0\dbch\af31505\loch\f0 cient evidence to hold that the driver of the respondents' vehicle was acting as the servant or agent of the defend\hich\af0\dbch\af31505\loch\f0 
ant/respondents.
\par \hich\af0\dbch\af31505\loch\f0 
I have examined the record and there is no direct evidence on this issue to support such a finding. The only evidence on this issue is all to the effect that at the time of the collision the driver was using the vehicle for his own social 
\hich\af0\dbch\af31505\loch\f0 
purposes. The driver was the son of one of the partners in the defendant firm who was using the firm's car for his own personal social purposes. He was, in fact, out driving with a lady friend whom he had also on many previous occasions taken out for soci
\hich\af0\dbch\af31505\loch\f0 a\hich\af0\dbch\af31505\loch\f0 l purposes in the firm's vehicle.
\par \hich\af0\dbch\af31505\loch\f0 No evidence whatever was given by the witnesses in the Court below upon which a finding of the existence of any relationship of Master and Servant or Principal and Agent could have been based. This disposes of}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid8457960 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid14114884\charrsid14114884 \hich\af0\dbch\af31505\loch\f0 the second g\hich\af0\dbch\af31505\loch\f0 round of appeal.}{

\hich\af0\dbch\af31505\loch\f0 ver was not their servant or agent at that time, and that unless the owners discharged such onus, they were liable}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid137785 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0

\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114884\charrsid14114884 \hich\af0\dbch\af31505\loch\f0 dant's servant or agent. He did therefore withdraw the case from the jury on this ground and entered judgment for the \hich\af0\dbch\af31505\loch\f0 
defendant. The plaintiff appealed.
\par \hich\af0\dbch\af31505\loch\f0 On appeal it was held that it was more usual for a car to be driven by the owner or the servant or the agent of the owner and therefore the fact of ownership was some evidence fit to go to the jury that at the material ti

\par \hich\af0\dbch\af31505\loch\f0 The plaintiff did, in fact, rely on a relationship of bailor and bailee, between the owners and the driver upon which to impute the negligence of the driver to the owners of the vehicle.
\par \hich\af0\dbch\af31505\loch\f0 Furthermore, the evidence in thi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid137785 \hich\af0\dbch\af31505\loch\f0 s case was not, as in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid137785\charrsid137785 
\hich\af0\dbch\af31505\loch\f0 Barnard\hich\af0\dbch\af31505\loch\f0  v}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14114884\charrsid137785 \hich\af0\dbch\af31505\loch\f0  Sully}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114884\charrsid14114884 
\hich\af0\dbch\af31505\loch\f0 
, entirely silent on the issue of the identity of the driver. The evidence showed that the driver was the son of one of the four partners in the defendant firm "Wing Fat Bakery'. There was no allegation in the pleadings that this son was an employe
\hich\af0\dbch\af31505\loch\f0 
e or agent of these partners or of his father and no evidence to support such a finding. On the contrary, from the evidence of the first witness for the defence, it is clear that the driver was out in the van driving his girl friend \hich\f0 \emdash 
\loch\f0  in fact two ladies \hich\f0 \emdash \hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 n a social expedition of his own, as had been the case on a number of previous occasions.
\par \hich\af0\dbch\af31505\loch\f0 This case is therefore distinguishable from }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid14114884\charrsid13176234 \hich\af0\dbch\af31505\loch\f0 Barnard v Sully}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114884\charrsid14114884 
\hich\af0\dbch\af31505\loch\f0  on two grounds. Firstly, because the plaintiff did not in this case, as was done}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid137785 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0

In that case the driver of the car was the daughter of its owner. She was driving a friend who was a guest staying in her parent's home where the daughter resided. It was held that proof of ownership was sufficient prima facie
\hich\af0\dbch\af31505\loch\f0  evidence in these circumstances that the negligence of the daughter driver was imputable to the owner without affirmative proof that the driver was his servant.

ich he sought to establish the liability of the owner for the driver's negligence. At the hearing he relied on proof of this bailment to establish his case. This was not enough. It was necessary both to allege and establish that the driver was the servant

a negligent driver, upon proof of the ownership of the vehicle, the onus of proof passes to the owner to show that at the material time it was not being driven by the owner, his servant or his agent, different considerataions apply when there is direct pr
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 of of the identity of the driver}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12854941 \hich\af0\dbch\af31505\loch\f0  and of the purposes for which h}{\rtlch\fcs1 \af0 \ltrch\fcs0

\par \hich\af0\dbch\af31505\loch\f0 Upon proof that the driver of the vehicle was the son of one of the partners of the firm that owned the vehicle, it was no longer a matter of necessary inference that \hich\af0\dbch\af31505\loch\f0 
this son must have been the servant of the firm or its agent at the material time. The evidence before the Court below was equally consistent with the driver being}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4861219 \hich\af0\dbch\af31505\loch\f0 
 a mere bailee of the vehicle.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14114884\charrsid14114884
