sel's submission) been tried by the Magistrate under the shortened procedure prescribed by section 194 of the Criminal Procedure Code, whereas the offence of larceny contrary to section 254(1) of the Penal Code was not one which was triable under section

he use of this form does not satisfy us that the Magistrate was in fact proceeding under section 194 or that he regarded himself as doing so. Our reasons are first, that as provided by subsection }{\rtlch\fcs1 \ab\af0\afs17 \ltrch\fcs0 \insrsid15336409 
\hich\af0\dbch\af31505\loch\f0 (1)}{\rtlch\fcs1 \ab\af0\afs17 \ltrch\fcs0 \insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 
the section only becomes available "if so requested by \hich\af0\dbch\af31505\loch\f0 the Public Prosecutor"; there is}{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 
 no record that any such request was made. Secondly, that the maximum punishment under section 254(1) of the }{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15336409 \hich\af0\dbch\af31505\loch\f0 Penal Code is s
\hich\af0\dbch\af31505\loch\f0 o manifestly out}{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 
side the limits of section 194 that the Magistrate could not have failed to know it\hich\af0\dbch\af31505\loch\f0 \hich\f0 . Thirdly, by section 194(7) the maximum penalty which could be imposed after a trial under that section is a fine of \'a3\loch\f0 
5, or one month's imprisonment in default; this, again, mu}{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid4196514 \hich\af0\dbch\af31505\loch\f0 st have been known to the Magis}{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 
\lang2057\langfe1033\langnp2057\insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 trate, would have clearly been within his jurisd\hich\af0\dbch\af31505\loch\f0 
iction, and would render completely pointless his committal of the appellant to the Supreme Court.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15359769\charrsid4196514 
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 Having regard to the fact that all the Magistrate did was to take the plea of the appellant, a matter quite within his ordinary jurisdiction, and for, the re
\hich\af0\dbch\af31505\loch\f0 asons we have given, we do not accept that the use of the printed form is sufficient to show that the trial was under section 194,}{\rtlch\fcs1 \ab\af0\afs17 \ltrch\fcs0

e sentence of two years imprisoment was too severe for the offence the appellant committed.

We realise that the Judge on the spot who is conversant with the local conditions is by far the best qualified to assess the most appropriate penalty having regard \hich\af0\dbch\af31505\loch\f0 both to the of}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid6491936 \hich\af0\dbch\af31505\loch\f0 fence committed and to the char}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 acter of the prisoner. For this reason we }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid15336409 \hich\af0\dbch\af31505\loch\f0 have always hesitated to inter}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 f\hich\af0\dbch\af31505\loch\f0 ere with a sentence imposed by the trial}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15336409 \hich\af0\dbch\af31505\loch\f0  Judge, particularly in the out}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15359769\charrsid15359769 \hich\af0\dbch\af31505\loch\f0 
lying Pacific Islands. But here, with the greatest respect, we ar\hich\af0\dbch\af31505\loch\f0 e persuaded that the learned Judge has proceeded on a wrong principle in imposing a sentence of two years' imprisonment for this comparatively minor}{

\hich\af0\dbch\af31505\loch\f0 offence of stealing clothing of the value of under $5.00. We realise that the theft was from a house but th\hich\af0\dbch\af31505\loch\f0 e prisoner was not convicted of burglary.}{\rtlch\fcs1 \af0 \ltrch\fcs0

The convicted person, who had pleaded guilty, was aged 29. He had 19 previous convictions which extend from 20 years ago when, at the age of only 9, he was sentenced to four months' imprisonment, up to 7th November\hich\af0\dbch\af31505\loch\f0 
, 1969, some 18 months before the present offence. He is married with one child. In imposing sentence the learned Judge said:}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15359769\charrsid6491936
