The first point that requires determination, before the relevant individual clauses of the agreement are examined, concerns the definition of the property}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2776980 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid8859866\charrsid3360265 \hich\af0\dbch\af31505\loch\f0 whch was intended to pas\hich\af0\dbch\af31505\loch\f0 s, and did actually pass, under the agreement. }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265 
\hich\af0\dbch\af31505\loch\f0 It }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265 \hich\af0\dbch\af31505\loch\f0 
was conitended before this Court that the property in the growing cane did not pass with the property in the land itself. In my view, this proposition is untenable. In the absence of specific provision in t\hich\af0\dbch\af31505\loch\f0 
he agreement exempting growing crops, or any part of them, from the effect of the agreement I am firmly of opinion that the principle }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid8859866\charrsid2776980 \hich\af0\dbch\af31505\loch\f0 qui}{\rtlch\fcs1

not only of the lands so taken but also of what was growing on them. The application of this rule to the area covered by contract No. 525 has not been questioned. Its application to the area covered by contract No. 524 has beco
\hich\af0\dbch\af31505\loch\f0 me somewhat obscured by the facts surrounding the giving of possession of that area, and also by the operation of clause 2 (}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \i\insrsid2776980\charrsid2776980 \hich\af0\dbch\af31505\loch\f0 l
}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265 \hich\af0\dbch\af31505\loch\f0 ) of the agreement providing for a rebate of interest during the period elapsing before possession was given.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265 \hich\af0\dbch\af31505\loch\f0 According to the Case\hich\af0\dbch\af31505\loch\f0  Stated there are two points for dispute between plaintiff and defendant. These are:\hich\f0 \emdash

It is true that in the sale and purchase agreement it is provided that all}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8455923 \hich\af0\dbch\af31505\loch\f0  cane proceeds from the land ("except as hereinafter provided}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid8859866\charrsid3360265 \hich\af0\dbch\af31505\loch\f0 ") s\hich\af0\dbch\af31505\loch\f0 hall be applied in payment of the balance of the purchase money; but that provisi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8455923 
\hich\af0\dbch\af31505\loch\f0 on is qualified by the phrase "}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265 \hich\af0\dbch\af31505\loch\f0 by the purchaser working on the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8455923 
\hich\af0\dbch\af31505\loch\f0  said land from the date hereof}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265 \hich\af0\dbch\af31505\loch\f0 ". As I read clause 2 }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265

 am satisfied that, in the proper construction of the agreement, as a whole, what I have said expresses the true intention of the parties as set out in the document itself.
\par \hich\af0\dbch\af31505\loch\f0 In the result I would hold that plaintiff is entitled to be credited with the proce\hich\af0\dbch\af31505\loch\f0 
eds of the cane harvested from the area of approximately 2 acres from and after the 10th October, 1959 and that harvested from the whole area from the 8th September, }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid8859866\charrsid3360265 
\hich\af0\dbch\af31505\loch\f0 1961.

minary point. From the time plaintiff took possession of lands he took possession of everything growing on the lands. The claim by defendant to the crops which he\hich\f0 \emdash \loch\f0 or others than plaintiff\hich\f0 \emdash \loch\f0 
had planted could be sustained only if there were a definite provis\hich\af0\dbch\af31505\loch\f0 i\hich\af0\dbch\af31505\loch\f0 on in the agreement to that effect. There is no such provision.
\par \hich\af0\dbch\af31505\loch\f0 For these reasons I would answer the question put in the Case Stated as follows:\hich\f0 \emdash
