This is a claim by the Plaintiff a Moneylender to recover certain moneys lent to one Prem Singh deceased and interest thereon under a Promissory Note Ex " A ", given by the said Prem Sin\hich\af0\dbch\af31505\loch\f0 
gh to the Plaintiff. The defendants are sued as executors of the estate of the said Prem Singh deceased.
\par {\listtext\tab}\hich\af0\dbch\af31505\loch\f0 The Plaintiff gave evidence and called one witness. The defendants did not call evidence, their counsel submitting that at law the said Promissory Not\hich\af0\dbch\af31505\loch\f0 e wa}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid11357535 \hich\af0\dbch\af31505\loch\f0 s unenforceable by virtue of s.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 16 and 18 and 21 of the Moneylenders Ordinance Cap. 210.
\par {\listtext\tab}\hich\af0\dbch\af31505\loch\f0 On the evidence before me I am satisfied that the Plaintiff has complied with}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11357535 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 s.}{\rtlch\fcs1 \ab\af0\afs18 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 18 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 
\hich\af0\dbch\af31505\loch\f0 of the Ordinance relating to books of accounts. I have heard his evidence and th\hich\af0\dbch\af31505\loch\f0 
at of his witness and have examined his books of accounts. From all this it is apparent that the plaintiff kept regular accounts of loans made by him and in particular of the loan made to Prem Singh.
\par {\listtext\tab}\hich\af0\dbch\af31505\loch\f0 In the statement of defence the defendants pleaded Sect\hich\af0\dbch\af31505\loch\f0 ion 11 of the Moneylenders Ordinance. However no submissions were made in this respect by defence counse}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid11357535 \hich\af0\dbch\af31505\loch\f0 l who however submitted that s.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 
21 not pleaded in the defence had not been complied with in that the arrears of interest shown in the statement of accoun\hich\af0\dbch\af31505\loch\f0 
t attached to the writ of summons is incorrectly shown. There certainly appears to be an error in this respect. The amount shown as arrears of interest in the statement of account attached to the writ is $28.90 whereas $204.90 }{\rtlch\fcs1 \ab\af0\afs18 
\ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 claimed in the writ. Howev\hich\af0\dbch\af31505\loch\f0 
er the statement of account shows the date of loan, the principal sum and the rate of interest and that there has been}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5456978 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs18 \ltrch\fcs0

The evidence in this case shows that the Plaintiff counter-signed Promissory Note Ex " A " after it was signed by the borrowe\hich\af0\dbch\af31505\loch\f0 r. This then became sufficient memorandum or note of the contract by virtue of s.16
\hich\af0\dbch\af31505\loch\f0 (4).
\par \hich\af0\dbch\af31505\loch\f0 Secondly there is the plaintif}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5456978 \hich\af0\dbch\af31505\loch\f0 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 
s evidence that an authenticated copy of the contract (Ex "\hich\af0\dbch\af31505\loch\f0 B\hich\af0\dbch\af31505\loch\f0 ") was delivered to the borrower. The borrower himself has acknowledged re\hich\af0\dbch\af31505\loch\f0 
ceiving a true copy of the Promissory Note and there can be no doubt that this acknowledgement refers to receiving an authenticated copy similar to Ex "\hich\af0\dbch\af31505\loch\f0 B\hich\af0\dbch\af31505\loch\f0 ".
\par \hich\af0\dbch\af31505\loch\f0 However, there is no evidence of compliance with the third requirement}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11357535 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 
\hich\af0\dbch\af31505\loch\f0 mentioned in the judgment i\hich\af0\dbch\af31505\loch\f0 
n the above case, namely, that such authenticated copy was delivered before the money was lent. The Plaintiff in his evidence mentioned that he had the Promissory Note drawn and that a certified copy of it was given to Prem Singh. He does not say at what 
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0 tage this was done. Neither does Prem Singh}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5456978\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 s acknowledgment on the back of the Promissory Note of having received a copy of the Promissory Note state at what stage}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11357535 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 he received it.
\par \hich\af0\dbch\af31505\loch\f0 In the judgment in the above case it was held that " Once non-compliance wi\hich\af0\dbch\af31505\loch\f0 th th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2822182 \hich\af0\dbch\af31505\loch\f0 e provisions of s.}{\rtlch\fcs1

16 of the Moneylenders Ordinance is pleaded as a defence, the burden of proving compliance, (except perhaps as regards proof that the note or memorandum was not signed before the money was lent) is on the party seeking to enforce the

\insrsid5456978 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 copy of the contract was delivered before or after the money was lent. But such was also the case in }{
\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid681024\charrsid11357535 \hich\af0\dbch\af31505\loch\f0 Sarwan Singh v Salote Vibote}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid11357535 \hich\af0\dbch\af31505\loch\f0 (supra). The Plaintiff }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 has\hich\af0\dbch\af31505\loch\f0 
 not adduced any evidence to show that in fact the authenticated copy of the contract was delivered before the money was lent and the above case decides that the }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 
\hich\af0\dbch\af31505\loch\f0 onus }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 is on him to show that this was done. The Plaintif}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5456978 
\hich\af0\dbch\af31505\loch\f0 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 s evidence is silent on the point.

 filed certain affidavits. However since there was no agreement as to the disputed material it was agreed by both sides that the typed record as certified by the Magistrate should stand.
\par \hich\af0\dbch\af31505\loch\f0 In the course of hearing this appeal it became abundantly clear to me\hich\af0\dbch\af31505\loch\f0  that it is}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11357535 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 
not the contention of the defence that the authenticated copy of the promissory note on which the action was founded was in fact not given before the money was lent. What is contended is that the Plaintiff omitted to adduce evidence that it was
\hich\af0\dbch\af31505\loch\f0  given before the money was lent. Furthermore the appellant/plaintiff who himself was the lender gave evidence and it was never put to him or even suggested that he had failed to give a copy of the contrac}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid11357535 \hich\af0\dbch\af31505\loch\f0 t document before the money was}{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 
\hich\af0\dbch\af31505\loch\f0 lent. Indeed it cou\hich\af0\dbch\af31505\loch\f0 
ld be said that the plaintiff was, even if unwittingly, led into believing that this procedural aspect of the lending transaction was not being questioned, although in the written defence it was contended in a general way in paragraph 4\hich\f0 \emdash 
\loch\f0 " That as a furthe\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0  and alternative defence the said Defendant pleads the Moneylenders Ordinance and especially Sections 16, 11 and 18 thereof and the laws relating thereto."
\par \hich\af0\dbch\af31505\loch\f0 Reading grounds 1 and 2 of the defence together it becomes abundantly clear that the receipt of loan\hich\af0\dbch\af31505\loch\f0 
 of $500 with 12% interest was being acknowledged but it was contended that out of this sum $200 was repaid. So on the defence case itself a sum of $300 plus interest was owing.
\par }\pard \ltrpar\s39\ql \li0\ri0\sb240\sa240\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid2822182 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 
By paragraph 3 of the defence the defendant ple}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2822182 \hich\af0\dbch\af31505\loch\f0 ads non-compliance with section}{\rtlch\fcs1 \af0\afs16 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 
 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 18 of the Moneylenders Ordinance which relates to the keeping of proper books of account.
\par \hich\af0\dbch\af31505\loch\f0 The learned trial Magistrate having found in favour of the plaintiff in every respect except with regard to one aspect of the requirements of section 16 of the Money\hich\af0\dbch\af31505\loch\f0 
lenders Ordinance, it is quite obvious to me that the defence is endeavouring to take advantage of a technical matter, namely failure to adduce evidence that the money was lent after the delivery of the authenticated copy of the promissory note.}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2822182 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 There can \hich\af0\dbch\af31505\loch\f0 
be no doubt that the borrower Prem Singh received on the same day as the loan was made, namely 15th December, 1966, a true copy of the promissory note as is evidenced by the endorsement signed by him on the reverse side of Exhibit " A ". The solicitor who
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 witnessed the signature of the lender and the borrower on the promissory note itself is the same solicitor who witnessed Prem Singh}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid5456978\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 s acknowledgment.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid2822182 \hich\af0\dbch\af31505\loch\f0 This is not a case where there is evidence of the actual contravention of the mandatory provisions of the \hich\af0\dbch\af31505\loch\f0 
Moneylenders Ordinance as was the position }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid2822182 \hich\af0\dbch\af31505\loch\f0 in }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid2822182\charrsid2822182 \hich\af0\dbch\af31505\loch\f0 Saran Singh v}{\rtlch\fcs1 
\ai\af0 \ltrch\fcs0 \i\insrsid681024\charrsid2822182 \hich\af0\dbch\af31505\loch\f0  Salote Vibote}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid681024\charrsid2822182 \hich\af0\dbch\af31505\loch\f0 , }{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid681024\charrsid2822182 \hich\af0\dbch\af31505\loch\f0 but this is a case where the defendants are endeavouring to defeat a legitimate claim on a technical ground. There was in my view actual evidence of substantial compliance with the 
\hich\af0\dbch\af31505\loch\f0 provisions of section 16 of the Moneylenders Ordinance and the mere failure to adduce specific evidence in relation to the matter in dispute can be partly attributed to the defence itself. Indeed}{\rtlch\fcs1 \af0 
\ltrch\fcs0 \insrsid2822182\charrsid2822182 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid2822182 \hich\af0\dbch\af31505\loch\f0 I would go as far as to say that although there was no direc
\hich\af0\dbch\af31505\loch\f0 
t evidence to show at what stage of the transaction the authenticated copy of the contract was delivered yet there was on the peculiar facts and in the peculiar circumstances of this case sufficient material from which inference of compliance could have b
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 en drawn.
\par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 
The object of all legal proceedings is to do justice between parties within the meaning of the law. In my view to allow the defendants to take advantage of the situation in this case would be to defeat the fundamental object of law and justice}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2822182 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 es\hich\af0\dbch\af31505\loch\f0 
pecially as in this case where there is no evidence that in fact the provisions of law were contravened. In any case, in the absence of any evidence to the contrary I draw the inference from the evidence adduced by the plaintiff that there was due complia
\hich\af0\dbch\af31505\loch\f0 n\hich\af0\dbch\af31505\loch\f0 ce with the provisions of section 16 of the Moneylenders Ordinance.
\par \hich\af0\dbch\af31505\loch\f0 Consequently I allow this appeal, set aside the decision of the Magistrate}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5456978\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid681024\charrsid5456978 \hich\af0\dbch\af31505\loch\f0 s court and enter judgment for the appellant/plaintiff in the sum of $500 plus interest as}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2822182 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0
