In this case there is no doubt that the lorry driven by the 2nd defendant collided with the vehicle being d\hich\af0\dbch\af31505\loch\f0 riven by the plaintiff. The area of doubt concerns the way }{\rtlch\fcs1 \ab\ai\af0 \ltrch\fcs0 
\insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 
which that accident happened, and in order to succeed, the plaintiff must prove that it was caused by the defendant's negligence.

have been given three different versions of what happened:\hich\f0 \emdash \loch\f0 the\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3364133\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 plaintif}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid3364133 \hich\af0\dbch\af31505\loch\f0 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3364133\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 's}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0  driver, }{

 Raj stated that when his van entered the bridge the defendant's lorry was more than a chain away from the other side of the bridge. He said that the lorry sounded its horn and did not stop. Brij Raj went on to say that when he was
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368 \loch\af0\dbch\af31505\hich\f0 \'be\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 
way across the bridge he realised that the lorry was still coming on so he stopped his van completely\hich\f0 \emdash \loch\f0 and he was quite certain about this}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368 \hich\af0\dbch\af31505\loch\f0  }{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \loch\af0\dbch\af31505\hich\f0 \emdash }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368

lorry then collided with the van which was pushed back to the final position indicated on the plan. The secon\hich\af0\dbch\af31505\loch\f0 
d version of how the accident occurred is that given by Jai Singh who was the passenger in the plaintiffs van No. K369. He said that when the van entered the bridge the lorry was just about to come on to the bridge and was only a few yards from the far si
\hich\af0\dbch\af31505\loch\f0 d\hich\af0\dbch\af31505\loch\f0 
e; he was also quite certain that the van did not stop and was in fact travelling at 15-20 miles per hour, when the collision occurred. Clearly, either the driver of the van or the passenger is mistaken on a most material point in connection with}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 this case.
\par \hich\af0\dbch\af31505\loch\f0 
The third version is that given by the defendant driver of the lorry. He says that his vehicle entered the bridge first, that the van came on towards him at about 20 m.p.h. and that the collision occurred about way across the bridge on the van's side. He
\hich\af0\dbch\af31505\loch\f0  also said that he applied the brakes but they failed and he was unable to stop his vehicle.
\par \hich\af0\dbch\af31505\loch\f0 The police constable who attended the scene of the accident, and who was the first witness called by the plaintiff, prepared a plan on which he marked, }{\rtlch\fcs1 \ab\ai\af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 
\hich\af0\dbch\af31505\loch\f0 inter alia,\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 the point of impact which, he said, was agreed by bot}{\rtlch\fcs1 \af0 \ltrch\fcs0 
\insrsid6316575 \hich\af0\dbch\af31505\loch\f0 h parties. This point, marked "A}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 " on the plan, is almost exactly in the middle of the bridge although }{
\rtlch\fcs1 \ab\af0\afs16 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 I }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 
note that in his evidence the defendant driver gave the impact point as being further on the weste\hich\af0\dbch\af31505\loch\f0 rn, or van's side of the bridge.
\par \hich\af0\dbch\af31505\loch\f0 The second defence witness, a mechanic who examined the lorry, gave evidence to the effect that a washer in the braking system was leaking which constituted an inherent failure which would only become apparent if the brakes
\hich\af0\dbch\af31505\loch\f0  were applied in an emergency.
\par \hich\af0\dbch\af31505\loch\f0 From the foregoing it is clear that the plaintiff has not proved affirmatively that the accident was caused by the negligence of the defendant driver and this action must fail."

\hich\af0\dbch\af31505\loch\f0 1. With regard to the evidence before the Court it was incumbent on the learned Magistrate to find who was negligent or in what proportion.

\hich\af0\dbch\af31505\loch\f0  standard of proof of beyond reasonable doubt rather than that of civil standard of on balance of probability.

Once negligence is established and the balance of probability is evenly balanced the learned Magistrate ought to have held that the parties ar\hich\af0\dbch\af31505\loch\f0 e equally liable."

The appellant, therefore, contends that judgment should be entered in his favour and the case be sent back for hearing on the issue of quantum of damages or alternatively the case should be sent back for re-hearing as a whole.

\hich\af0\dbch\af31505\loch\f0  denote proof on balance of pro}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13726368\charrsid13726368 \hich\af0\dbch\af31505\loch\f0 
babilities. There is no doubt in my mind whatsoever that the learned trial Magistrate in this case did not equate standard of proof req\hich\af0\dbch\af31505\loch\f0 
uired in the case before him with the standard of proof required in criminal cases. The second ground of appeal must therefore fail.
