This is an appeal from the decision of the Supreme Court of Fiji dated 18th October, 1968, in which the appellant, plaintiff in the Court below, calims the sum of \'a3

si died on the 10th September, 1965, and the appellant applied for and was granted on the 16th March, 1966 by the Supreme Court of Fiji, Letters of Administration of her estate. The appellant caused a Notice of Demand dated 19th January, 1967, to be sent 
by his solicitors to the respondent demanding payment of the sum of \'a3
700, which the appellant alleged was. the balance owing in respect of the sale of the Native Lease and the Assignment of the Cane Contract. A Writ of Summons was issued out of the Supreme 
Court of Fiji on the 23rd January, 1967, by the appellant against, the respondent claiming the sum of \'a3700. In the Statement of Claim the appellant alleged (inter alia):-}{\rtlch\fcs1 \af0\afs27 \ltrch\fcs0

The claim for \'a3700 was based on an alleged oral agreement between Sunbarsi and the respondent that the sum of \'a3700, being the difference between the consideration of \'a31,200 expressed in the said transfer and the sum of \'a3
500 paid by the respondent, was payable by the respondent on demand. The respondent in her Statement of Defence denied that there was any such oral
 agreement, and went further and alleged that the real and true consideration for the purchase of the Native Lease and the Assignment of the Cane Contract was \'a3500 and not \'a31,200. In paragraph 3 of the Statement of Defence the defendant says:-}{

l for the valuation of the said land for the purpose of assessing stamp duty payable on the transfer. The parties being mother and daughter wanted to avoid the costs of valuation and stated a fictitious consideration. Alternatively the Defendant says that

It was found by the learned trial Judge, and I understand conceded by the parties, that no demand was ever made by Sunbarsi on the respondent for the payment of the sum of \'a3
700 and that the first demand ever made by the appellant on the respondent was that made on the 19th January, 1967. The matter first came for trial on the 4th April, 1968, before the Supreme Court of Fiji when the transfer and the Cane Contract an
d the receipts were (inter alia) put in by consent, and further it was admitted by the parties that the sum of \'a3
700 had not been paid although liability for payment thereof by the defendant was denied. After several adjournments the matter again came befor
e the Supreme Court on the 26th September, 1968, when the appellant elected to rely solely on the documents submitted to the Court, and closed his case without giving or calling any evidence at all. The defence was then opened and the respondent, Deoki, g
a
ve evidence and so did her husband Shardanand. When the respondent, Deoki, commenced to give evidence before the learned trial Judge as to the price of the land purchased by her from her late mother Sunbarsi objection was taken by learned counsel for the 
a
ppellant upon the grounds that extrinsic evidence was inadmissible to contradict, vary or qualify the consideration shown in the transfer. The learned trial Judge ruled that the respondent was not prevented from adducing oral evidence as to the real consi
deration for the sale. Both the respondent and her husband testified that the price at which Sunbarsi had sold the said Native Lease and the benefit of the said Cane Contract was \'a3500 and not \'a3
1,200. They both further testified that the purpose for stating the consideration as \'a3

The action brought by the appellant was not brought on the Transfer as such but on an alleged collateral oral agreement made between Sunbarsi and the respondent that the balance of the purchase moneys namely \'a3
700 was to be repayable to Sunbarsi on demand. This allegation is clearly set out in paragraph 6 of the appellant's Statement of Claim. In the Transfer document itself there is no obligation expressed or implied that the respondent will pay Sunbarsi the
 sum of \'a3700 on demand. The appellant's pleadings make it quite clear that the obligation (if it exists) to pay the said sum of \'a3700 stems from the alleged oral contract which is collateral with the Transfer document and not inconsistent with it.}{

The appellant was therefore, in my view, entitled to give parol evidence of the alleged collateral oral agreement to pay \'a3
700 providing that the conditions mentioned above were observed. It is, however, clear that the appellant neither gave nor called any evidence to prove the alleged oral agreement to pay \'a3700.
 It is of course acknowledged that the transferor Sunbarsi, as at the date of the trial, had died; but it is also clear from the record that the appellant was present in the solicitor's office when the transfer was signed. As the learned trial Judge said

Learned counsel for the appellant submitted that the learned trial Judge was in error in so doing. He further submitted that it is only where no consideration or a nom
inal consideration is expressed in the instrument or the consideration is expressed in general terms or is ambiguously stated extrinsic evidence is admissible to prove the real consideration and further that where a substantial consideration is expressed

n the instrument extrinsic evidence is admissible to prove an additional consideration and that it is not in contradiction of the document to prove a larger consideration than that which is stated in the document. Parol evidence which proved a lesser cons
