The deceased, Bindra Mati, was the wife of Raj Kumar and the appellant is the husband of Raj Kumar's sister. At the time in question both the appellant and Raj Kumar, whose houses were a few chains apart, worked for and lived on land owned by Jitendra Lal
\hich\af0\dbch\af31505\loch\f0 . Jitendra Lal's house was about ten and a half chains from that of Raj Kumar, the intervening space at the relevant time being under young sugar cane.
\par \hich\af0\dbch\af31505\loch\f0 After dark on the evening of the 16th October, 1968, a number of people, including the appellant and Raj\hich\af0\dbch\af31505\loch\f0 
 Kumar, gathered at the house of Jitendra Lal, where they partook of yaqona and, later, beer. It has not been suggested, either at the trial or this appeal, that the alcohol then consumed was a factor in what later occurred. After drinking, the people pre
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0 ent had a meal, though apparently they did not all eat at the same time. The appellant left the gathering before Raj Kumar, f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3367317

 Raj Kumar then heard and recog}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 nised his wife's voice crying out, and he ran straight to his \hich\af0\dbch\af31505\loch\f0 
house across the canefield, followed or accompanied by others. One of those who heard the cries and followed Raj Kumar was Opendra Lal, who testified that he heard the woman's voice call "See Bhakkua is holding me" and then "See Bhakkua is hitting me". It
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 was common ground that Bhakkua is a name by which the appellant is known.
\par \hich\af0\dbch\af31505\loch\f0 Bindra Mati was found a few yards from the house in which she lived with her husband, covered with blood from a number of stab wounds. She was taken to Tavua Health Centre but after \hich\af0\dbch\af31505\loch\f0 
preliminary treatment was sent by ambulance to Lautoka. During this journey she made statements to which reference will be made later in this judgment. At Lautoka Bindra Mati was operated on but died on the operating table at about 5 a.m. the next day. He

 wounds consisted of three deep stab wounds through the chest, penetrating the lungs and one of them the heart, and a deep stab wound from the back, penetrating the stomach and major blood vessels.

". Opendra Lal's evidence was not objected to at the trial but counsel argued in this Court that they were not shown t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5180638 \hich\af0\dbch\af31505\loch\f0 o have been sufficiently contem}{\rtlch\fcs1 \af0

cause of a fire alleged to have been started maliciously. They were spoken, however, some twenty-six minutes after the fire had been started. In the present case the very content of the statements, together with the circumstantial evidence, indic}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8663127 \hich\af0\dbch\af31505\loch\f0 ates that \hich\af0\dbch\af31505\loch\f0 they were uttered con}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0

\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 panied her in the ambulance from Tavua to Lautoka. Bindra Mati was at th\hich\af0\dbch\af31505\loch\f0 
is time receiving a transfusion of fluid and was obviously in a very low condition. According to Suruj Pal she first enquired whether her husband had come and then said "Please look after my four children they would be ruined now \hich\f0 \emdash 
\loch\f0  I will not live". She t\hich\af0\dbch\af31505\loch\f0 h\hich\af0\dbch\af31505\loch\f0 
en asked Suruj Pal to tell her husband to take money which was kept in a tin and finally, according to Suruj Pal, said "Bhakku hit her on her heart and I will not live".
\par \hich\af0\dbch\af31505\loch\f0 Again, no objection was taken to this evidence at the trial, and indeed the identity o\hich\af0\dbch\af31505\loch\f0 
f the appellant as the person who held the knife by which Bindra Mati's wounds were caused was never made an issue at the trial by the defence. Counsel has now argued tha}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8663127 \hich\af0\dbch\af31505\loch\f0 
t there was insufficient indica}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 tion of the "settled hopeless expectation of imminent d\hich\af0\dbch\af31505\loch\f0 
eath" which is the prerequisite of admissibility of a dying declaration. He also indicated the apparent change from direct to indire}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8663127 \hich\af0\dbch\af31505\loch\f0 ct speech in the sentence impli}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 cating Bhakku as showing that the exact words used by the deceased}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8663127 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs21 
\ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 had not been given. As no \hich\af0\dbch\af31505\loch\f0 
objection was taken at the trial there was no specific ruling by the trial Judge on the question of admissibility but we are satisfied from the record that he was in any event amply justified in receiving the evidence. Her words "I will not live" twice ut

ered and her reference to her children, considered with the grave nature of her actual injuries, leave no doubt that she had a settled hopeless expectation of imminent death. We do not consider that the way in which her final sentence was expressed in evi

Counsel submitted to this Court that all the conversation following the words "\hich\af0\dbch\af31505\loch\f0 Yes, I did it" should have been excluded, on the ground that the Inspector should at that stage have arrested the appellant. We are}{\rtlch\fcs1

unable to regard this submission as valid. The Inspector had earlier cautioned the appellant as a suspected person pursuant \hich\af0\dbch\af31505\loch\f0 
to Rule 2 of the Judges' Rules. We think, in the circumstances, that the answer "Yes, I did it" was entirely ambiguous and }{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid8663127 \hich\af0\dbch\af31505\loch\f0 
may have been intended as a con}{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 
tinued assertion that the appellant had cut fowl. The Inspector, in our view, was entitled to ask the \hich\af0\dbch\af31505\loch\f0 ensuing question to clarify this point.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid8663127

vocation as a possible defence to the charge and there was thus a miscarriage of justice and the verdict ought not to stand."

For the purpose of this ground it is necessary to refer to the appellant's evidence which in\hich\af0\dbch\af31505\loch\f0 
troduced certain matter at variance with his earlier statements. In his cautioned statement after being charged with having wounded Bindra Mati the appellant had said (inter alia) \hich\f0 \emdash \loch\f0 
 "as I arrived near Raj Kumar's house, the same time his wife came outside\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 the house. I saw there was no one there". In his evidence he said: \hich\f0 \emdash

own-wards. I saw them and I became very scared, I thought that person was Shiu Lingam because he at one time caused some stones to be thrown at me by Fijians. I saw him running and I got very frightened and I took out my pen knife in my hand. When I proce

\insrsid3367317 \hich\af0\dbch\af31505\loch\f0 dra Mati and conceded t\hich\af0\dbch\af31505\loch\f0 he possi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 
bility that she was struck by the pen knife during the struggle. He later said, with reference to the two men he claimed to have seen \hich\f0 \emdash \loch\f0 
 "I thought it was Shiu Lingam and he would kill me today". In cross-examination he admitted that he was on good \hich\af0\dbch\af31505\loch\f0 
terms with Bindra Mati and Raj Kumar and could advance no reason for her alleged action. It should be added that, though the appellant did not refer to the matter in his own testimony, there was evidence elicited in the cross-examination of Crown witnesse
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0  that the appellant had been to Tavua on the 16th October in connection with a court case }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8663127 \hich\af0\dbch\af31505\loch\f0 
with one or more Fijians. Jiten}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 
dra Lal stated that Shiu Lingam was connected with the case, not directly, but to the extent that the Fijian involved worked for Shiu L\hich\af0\dbch\af31505\loch\f0 ingam.
\par \hich\af0\dbch\af31505\loch\f0 In his summing-up the learned trial Judge told the assessors that while counsel for the appellant had frankly}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8663127 \hich\af0\dbch\af31505\loch\f0  conceded that there was no evi}{
\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 dence upon which he could base a plea of self-defence he had nevertheless raised the issue \hich\f0 \emdash \loch\f0  the learned Judg

out a shadow of a doubt, that the matters which the appellant had raised in court were fabrications on his part. The appellant's main defence was accident, which was clearly rejected by the assessors and the court.}{\rtlch\fcs1 \af0 \ltrch\fcs0

learned Judge ought to have directed the assessors that, even though they rejected the plea of excessive force in self-defence, it was open to them to reach the view, if they accepted or were left in doubt as to the circumstances al

\insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 the retaliation proportionate to the provocation. The defence cannot require the issue to be left to the jury unless there has been produced a credible narrative of events su
\hich\af0\dbch\af31505\loch\f0 ggesting the presence of these three elements. They are not detached. Their relationship to each other \hich\f0 \emdash \loch\f0 particularly in point of time, whether there was time for passion to cool \hich\f0 \emdash 
\loch\f0  is of the first importance. The point that their Lordships wish to emphasis\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0  is that provocation in law means something more}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 than provocative incident. That is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14888486 \hich\af0\dbch\af31505\loch\f0 
only one of the constituent ele}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 
ments. The appellant's submission that if there is evidence of an act of provocation, that of itself raises a jury question, is not correct. \hich\af0\dbch\af31505\loch\f0

Taking, as we are required to do for the present purposes, the most favourable view of the evidence \hich\af0\dbch\af31505\loch\f0 given by the appellant, we find that there is here no credible narrative of events suggesting the presence of}{\rtlch\fcs1 
\af0 \ltrch\fcs0 \insrsid14888486 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs21 \ltrch\fcs0 \lang2057\langfe1033\langnp2057\insrsid11889818\charrsid11889818 \hich\af0\dbch\af31505\loch\f0 
at least one of the three elements mentioned. We refer to the necessity for the retaliation to be proportionate to the provocation. The appellant \hich\af0\dbch\af31505\loch\f0
