ded an identification parade. In the parade, along with the Respondent, there were nine other Indian males similar to him in height and build. The Respondent had first declined to participate in the parade and subsequently agreed. He stood third from the 
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0 
ight in the line. The then primary Police suspect, one Prahalad, stood in the tenth position in the line. When the complainant was brought to the parade she stood five yards away, almost opposite to the fourth or fifth man in the parade from the right. Sh
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 
 was asked if she could identify the man who had assaulted her. The complainant looked at the first and second men and then pointed at the Respondent. She burst into tears and declined to touch the Respondent who said to her "Muni come I won}{\rtlch\fcs1

t she, visibly frightened, said "No, you will hit me". The complainant was not taken from one end of the parade to the other. She was not shown the suspect, Prahalad, who looked like the accused.

In my view there was no such impropriety in the conduct of the identification parade as justified, perse, an acquittal of the appellant. What happened at the identifi\hich\af0\dbch\af31505\loch\f0 
cation parade could properly form the subject of comment by the learned }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8921258\charrsid4479131 \hich\af0\dbch\af31505\loch\f0 Defense}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13053681\charrsid4479131 
\hich\af0\dbch\af31505\loch\f0  Counsel, and this would be weighed, along with all other relevant considerations, by the trial Court when arriving at a decision. Here, as I have indicated, the learned Magistr\hich\af0\dbch\af31505\loch\f0 
ate when much further. He held that the identification must necessarily be regarded as wholly vitiated and that for this reason alone the appellant had to be acquitted. In so doing I consider he erred in }{\rtlch\fcs1 \af0 \ltrch\fcs0

not must depend on all the circumstances of the particular case. Such a lie will amount to corroboration i\hich\af0\dbch\af31505\loch\f0 f\hich\af0\dbch\af31505\loch\f0 
 it is of such a nature, and made in such circumstances, as to lead to an inference in support of the evidence of the complainant, or if it gives to a proved opportunity a different complexion from what that opportunity would have borne had no such lie be
