In the present case there is a much stronger ground for suggesting that the interpreter might be considered the agent for the\hich\af0\dbch\af31505\loch\f0 
 appellant. The appellant was plaintiff in an action brought against one Ram Asre, and in support of his claim he elected to give evidence on his own behalf. As by the rules of procedure in Fiji the language of the Court must be English, it was necessary 
\hich\af0\dbch\af31505\loch\f0 f\hich\af0\dbch\af31505\loch\f0 
or the appellant's evidence to be translated into that language. Though he was not compelled to do so, he accepted the services of the court interpreter for that purpose. The onus was on the plaintiff in that action to give his evidence in such a way that
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 
it would be understood by the Court. He elected to do so by taking advantage of the services of the court interpreter. There would, therefore, in my view, be reasonable grounds for contending that the interpreter was the agent of the appellant for the pur
\hich\af0\dbch\af31505\loch\f0 p\hich\af0\dbch\af31505\loch\f0 ose of putting his statement before the Court; that there was at least an implied request by the appellant, as plaintiff in the proceedings before the magistrate, that the inter\-
preter should perform the task of translating his statement into English for \hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 
he benefit of the Court. This aspect of the matter, however, is not referred to in the form of the question submitted to us by the Supreme Court and I mention it only for the purpose of showing that some distinction exists between the facts in Gaio's case
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 and those with which we are concerned. None the less I am of opinion that the broad principle laid down in Gaio's case is directly applicable to the present case. }{\rtlch\fcs1 \af0\afs24
