The first ground of appeal concerns a passage in the judgment of the learned trial Judge set out at page 16 of the Record. The words complained of were perhaps not strictly comment, as they may have been if used in the course of summing

 There the appeal was allowed on the ground that the trial Judge was not entitled to accept a failure on the part of the accused to give sworn evidence as corroborative of any evidence given for the prosecution. In the course of the judgment, after refere

ure of Appellant to give evidence. But what he has done goes considerably beyond making a comment. He states unequivocally that in coming to his conclusions he has taken into consideration the fact that Appellant did not sub}{\rtlch\fcs1 \af0\afs24

f the judgment: that the Judge}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid4018278\charrsid787 \hich\af0\dbch\af31505\loch\f0  accepted the failure of Appellant to submit himself to cross-examination as supporting the view
\hich\af0\dbch\af31505\loch\f0  he had formed of the credibility of the evidence of the accomplice Antonio Suurai. It goes a long way towards saying that he}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid14450623\charrsid787

 give sworn evidence as corroboration of the testimony of the accomplice. In our view the learned tr\hich\af0\dbch\af31505\loch\f0 
ial Judge was not entitled to draw any such conclusion from the fact that Appellant merely accepted the Court's invitation to make a statement from the dock. In these circumstances we are unable to say that the Judge, without the support afforded by his c
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 nsideration of what he calls the important matter of Appellant's failure to submit himself to cross-examination, would necessarily have entered a conviction against Appellant." }{\rtlch\fcs1

earned trial Judge as being the truth. As the Judge expressly stated that this point was vital to his defence, a misdirection on this matter of fact may well have had a detrimental effect on the defence put forward by the appellant, or at least on the Cou

Our findings in respect of the 2nd and 3rd grounds of appeal, whether or not they would be sufficient in themselves to bring about the quashing of the conviction, are definitely relevant with regard to the 4th ground. The evi

dence taken as a whole is not strong against the accused. It presents a number of difficulties. There appears, for example, no reason why the appellant, if he had committed the robbery, should come five days later to a man who knew nothing of the appellan
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 's complicity in it, should pay him the whole amount stolen, and should say to him "that is for keeping quiet about}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid6765549\charrsid787 
\hich\af0\dbch\af31505\loch\f0  the robbery". It seems strange}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \f0\fs24\insrsid4018278\charrsid787 \hich\af0\dbch\af31505\loch\f0 
 also that he should go to such great lengths to incriminate himself, by bringing with him the screw-driver he\hich\af0\dbch\af31505\loch\f0 
 is alleged to have used five days before. There is also the discrepancy disclosed in the evidence of Maria to the effect that the appellant told them on the 10th August he had taken the money the night before. }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0
