s wife Latchmi, whose death is the subject of the charge of murder in respect of which the appellant was convicted. On all three bodies were found a series of wounds which \hich\af0\dbch\af31505\loch\f0 
had been caused by a sharp instrument such as a knife. The body of Latchmi showed twelve serious wounds to the head, neck and back. These were all incised wounds caused by a knife or other sharp instrument and several of them, according to the medical evi
\hich\af0\dbch\af31505\loch\f0 d\hich\af0\dbch\af31505\loch\f0 ence, would have required a considerable measure of force to inflict. Any one of three of the wounds would have been sufficient to cause death. From the n}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0

urdered. The only question which arose at the trial was whether it was established beyond reasonable doubt that the person who had inflicted the wounds and who was therefore guilty of murder was the appellant. The case for the prosecution was based largel

nt on the previous day, the 26th October, denied all knowledge of the circumstances of the crime and stated that the appellant had not the slightest idea who had killed his grandfather, wife and son. The statements in the course of which he incriminated h

uilt only as a result of great pressure which had been put upon him by Sangoli Nair and Jaghur Singh, and after strong persuasion from his father who had begged the appellant to take the blame upon himself in order to save his father, brother and sisters

ector Koya, and the statement recorded by Detective Corporal Hannif after due and proper warning}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid16277914 \hich\af0\dbch\af31505\loch\f0  had been given; and the eviden}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 tial value of these would not be in the slightest degree reduced by the excision from the evidence of the admission made to Sango\hich\af0\dbch\af31505\loch\f0 
li Nair. The rule regarding the quashing of a conviction based upon the evidence of an accomplice because th}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5269030 \hich\af0\dbch\af31505\loch\f0 e jury had not been advised of}{\rtlch\fcs1 \af0\afs24 
\ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0  the necessity for corroboration does not apply here. The witnesses concerned could not be considered as accomplices. \hich\af0\dbch\af31505\loch\f0 
The objection to their evidence is based solely on their previously inconsistent statements; and the Assessors had had the inconsistencies between the evidence of the witnesses and their previous statements pointed out to them and would no doubt }{

\fs24\insrsid5269030 \hich\af0\dbch\af31505\loch\f0 iminatory statement made to San}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
goli Nair and followed by the admission of guilt to Inspector Koya was the result of pressure put upon him by Sangoli Nair and Jaghur\hich\af0\dbch\af31505\loch\f0  Singh, and also of persuasion by the appellant}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid10760088\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
s father Chandu. It is clear that in a general discussion after the funeral, culminating in the confessions by the appellant, all three of these persons said that it was the duty of the guilty party to admit \hich\af0\dbch\af31505\loch\f0 
his offence in order to save trouble to the Government and}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0  to the family. At no time, how}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 
\hich\af0\dbch\af31505\loch\f0 ever, according to the evidence of these witnesses, did they put pressure on the appellant to confess to the crime. Their observations amounted merely to a statement t\hich\af0\dbch\af31505\loch\f0 
hat there was a duty cast on the guilty person, whoever he might be, to acknowledge the great sin he had committed. It is true that in cross-examination Jaghur Singh said: "I advised accused whoever had done it would be in better}{\rtlch\fcs1 \af0\afs24 
\ltrch\fcs0 \fs24\insrsid5269030 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 standing with God and with\hich\af0\dbch\af31505\loch\f0 
 the authorities if he admitted it". He}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
then went on to agree with the suggestion put to him by Counsel for}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794

fession was obtained from the appellant "either by fear of prejudice or hope of advantage exercised or held out by a person in authority", t\hich\af0\dbch\af31505\loch\f0 o adopt the words of Lord Sumner in }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0

\hich\af0\dbch\af31505\loch\f0 air and Jaghur Singh, all that Chandu said to the appellant was that the person responsible for the crime should admit it in order to save them all trouble. Chandu himself,}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 however, giving evidence for the defence, said "I told him to take the blame on him
\hich\af0\dbch\af31505\loch\f0 self and these people will help us as they have promised". He further deposed that the appellant then said "since you people are promising to assist}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 
\hich\af0\dbch\af31505\loch\f0  me I will take the blame on my}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 self". Chandu thereupon fainted. Under cross-examination Chandu stated that n
\hich\af0\dbch\af31505\loch\f0 o growls, threats, force or assault were made to his son.}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142 
\par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371\charrsid2568794 
\par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
Although no specific finding was given on the point, it would appear that the evidence of Chandu given at the trial and quoted above was not accepted as being the truth. It would, in any event, be \hich\af0\dbch\af31505\loch\f0 
hard to understand why upon the appellant}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10760088\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
s agreeing to carry out the wishes of his father his father should sustain so great a shock as to cause him to lose consciousness.}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142 
\par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371\charrsid2568794

\par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 Counsel for the appellant further contended that all the self-incriminatory statements made by t}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid10951797 \hich\af0\dbch\af31505\loch\f0 he\hich\af0\dbch\af31505\loch\f0  appellant should be ruled in}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
admissible as they resulted from a conspiracy between Sangoli Nair,}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 
\hich\af0\dbch\af31505\loch\f0 Jaghur Singh and the Police that Inspector Koya should be present}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 and ready to take over as soon as Sangoli Nair and Jaghur Singh had}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 
\ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 succeeded in breaking dow\hich\af0\dbch\af31505\loch\f0 
n the resistance of the appellant to the extent of making him confess his guilt. Counsel suggests that it cannot have been a mere coincidence that Detective Inspector Koya did in fact arrive at the crucial moment and that he was then called in to complete
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 
what they had begun. We are unable to find evidence supporting this contention. It is certainly true that Inspector Koya had told the witnesses that he would see them after the funeral, but it would be proper, in the course of his duties, that he should g
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0  at that time and make inquiries among the people who might be expected to have information of value to him. It is undisputed that Inspector Koya did in fact arrive outside Sangoli Nair}{
\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10760088\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
s house in the early evening after the funeral and ther}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5849371 \hich\af0\dbch\af31505\loch\f0 e engage in con\hich\af0\dbch\af31505\loch\f0 versation with }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 Sangoli Nair}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10760088\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 s son for some few minutes. He then noticed the fall of Chandu in the house by the doorway when the appellant}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10760088\charrsid2568794

\hich\af0\dbch\af31505\loch\f0 r this that the admission of guilt was made by the appellant to Inspector Koya. We are unable to place any sinister interpretation upon the presence of Inspector Koya with his assistant, Corporal Hannif, at Sangoli Nair}{
\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10760088\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 s house at that time and, therefore,

nsel for the appellant that in his summing up to the Assessors the learned trial Judge placed undue emphasis on the case for the prosecution and showed what he contended to be bias against the appellant when deal\hich\af0\dbch\af31505\loch\f0 ing wit}{

The learned trial Judge, both in his summing up and in his judgment, expressed the opinion that the Crown case rest}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5269030 \hich\af0\dbch\af31505\loch\f0 ed essen}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 tially upon the admissions of guilt allegedly made by the appellant. In our opinion it cannot \hich\af0\dbch\af31505\loch\f0 be put more strongly than that the case for}{\rtlch\fcs1 
\af0\afs24 \ltrch\fcs0 \fs24\insrsid7748855 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid992142\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 
the prosecution rested substantially on the confessions made by the appellant. There is, in our view, evidence which, though doubtless of insufficient strength to lead to a conviction in the absence of the confes\hich\af0\dbch\af31505\loch\f0 
sions, is at least strongly corroborative of the confessions and indicative of the appellant}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10760088\charrsid2568794 \hich\af0\dbch\af31505\loch\f0 '}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0
