\par \hich\af0\dbch\af31505\loch\f0 At the outset of the hearing Counsel for the Plaintiff said that it had recently come to his notice that in fact the shop occupied by the Defendants was not "No. 26 Thomson Street" but "No. \hich\af0\dbch\af31505\loch\f0 
36 Thomson Street". Mr. Ramrakha for the Defence agreed that this was so and consented to all the pleadings, i.e. the Statement of Claim, the Defence and the Reply to the Defence being amended by substituting the words "Shop No. 36" for the words "Shop No
.\hich\af0\dbch\af31505\loch\f0  26" wherever they}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8287961 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8287961\charrsid5575745 \hich\af0\dbch\af31505\loch\f0

\par \hich\af0\dbch\af31505\loch\f0 During the course of the trial it became clear that the Defence intended to rely in part at least on the fact that the Plaintif}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid5575745\charrsid5575745

hereas it was now agreed that in fact the Defendants were not occupying "Shop No. 26" but "Shop No. 36". Further, the Defence objected to any evidence being admitted to show that the "Shop No. 26" referred to in this Agreement to Lease did in fact mean or
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 refer to the "Shop No. 36" occupied by the Defendants.}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8287961

take by both parties to that Agreement, this mistake could perhaps be rectified by a memorandum endorsed on the Agreement to this effect and signed by both parties. Counsel for the Plaintiff Company did however instead apply for and was granted a further

\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8287961\charrsid5575745 \hich\af0\dbch\af31505\loch\f0 Plaintiff Company is not valid by reason of alleged defects in its execution by the Plaintiff Company. In the first place, I am
\hich\af0\dbch\af31505\loch\f0  of the opinion that this defence is misconceived. In my view the execution of this document by the Plaintiff Company was not necessary or}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8287961

\i\fs24\insrsid8287961\charrsid13459123 \hich\af0\dbch\af31505\loch\f0 per se}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8287961\charrsid5575745 \hich\af0\dbch\af31505\loch\f0 , a valid Agreement to Lease which would e\hich\af0\dbch\af31505\loch\f0 
ntitle the Plaintiff Company to possession of the premises owned by Messrs. G. B. Hari and Company Limited apart from the right of third parties, is that of Messrs. G. B. Hari and Company Limited. By that execution of the Agreement to Lease, which has bee
\hich\af0\dbch\af31505\loch\f0 n\hich\af0\dbch\af31505\loch\f0 
 established to my satisfaction and which was not challenged at any time in any way by the Defence, the Plaintiff Company has been placed in the same position vis-a-vis the Defendants as their original Landlords Messrs. G. B. Hari and Company Limited.}{

\hich\af0\dbch\af31505\loch\f0  to be a witness of truth and I have been given no reason whatever why I should n\hich\af0\dbch\af31505\loch\f0 
ot accept his testimony. I accept his evidence and I hold as fact that Mr. Michael was authorized to sign this agreement to lease by the Plaintiff Company and that he did in fact do so.}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8287961 
\par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid16464203

4 lawfully granted by the owners of the shop occupied by the Defendants, an Agreement to Lease these premises for three years from 28th April 1964. I further hold that on 28th April 1964 the premises were occupied by the Defendants as monthly tenants unde

 the Memorandum of Tenancy dated 28th May, 1963. This tenancy was terminable by one month's notice in writing expiring at the end of any month. I hold that on 29th April 1964, notice to quit was given by the Plaintiff Company to the Defendants which termi

reply to me conceded that even if such a promise was made, which has been emphatically denied by two directors of Messrs. G. B. Hari and Company Limited, there was no consideration therefore and the Defendants cannot and do not set up any claims to any le

al or equitable rights as a result of such a promise. It is submitted, however, that this should be a consideration to be borne in mind by the Court if the Plaintiff succeeds in this action in deciding when possession should be given and in awarding costs

On the evidence before me I am not satisfied that any such promise was in fact made. It may well have been a hope entertained by the Defendants but they can have had no doubts as to the terms of their agreement with Messrs. G. B. Hari and

Company Limited when on 28th May, 1963, i.e. more than two months after the alleged promise was made, they agreed to and signed the memorandum of that date which granted them a monthly tenancy terminable on one month's notice on either side with no provis
\hich\af0\dbch\af31505\loch\f0 i\hich\af0\dbch\af31505\loch\f0 ons whatever for longer renewal or any longer tenancy, agreement or lease.
