alled by the Appellant Company in the Court below on the subject of consumption of intoxicating liquor by the Respondent. This must, I think, be done on the basis that they were honest witnesses who spoke what they believed to be the truth. That was what 
\hich\af0\dbch\af31505\loch\f0 t\hich\af0\dbch\af31505\loch\f0 he trial Judge found, and full weight must be given to his finding. As to the probative valu}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid15034148 \hich\af0\dbch\af31505\loch\f0 
e of the evidence and the infer}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0 ences to be drawn from it, I think this Court is entitled to differ from}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0

\hich\af0\dbch\af31505\loch\f0  His evidence\hich\af0\dbch\af31505\loch\f0  in chief}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0  assists very little. On cross-examination, }{\rtlch\fcs1 
\af0\afs24 \ltrch\fcs0 \fs24\insrsid11356048 \hich\af0\dbch\af31505\loch\f0 however, he did strengthen }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0 
his evidence by expressing the opinion that the alcohol had been taken within from five to ten hours previously. When asked could it have been five to twelve hours he made the \hich\af0\dbch\af31505\loch\f0 
meaningless reply "I have never heard of a case that long". As is pointed out by the trial Judge in his judgment, there is no evidence to show that the driver}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid11356048 \hich\af0\dbch\af31505\loch\f0  }{

The question arises, what inference was the trial Judge entitled to draw from the evidence of the A.M.O.? It is common ground that he was not a fully qualified medical practitioner. No effort was made}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid11356048 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0 by Counsel for the Compa\hich\af0\dbch\af31505\loch\f0 
ny to establish his qualification to express an opinion upon the question before the Court. He was not asked as to what experience he had had in cases of alcoholism, or what training he had received in the matter of the physical effects of alcohol upon th
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 
 human body. He gives no reason whatever for setting the limit of ten hours during which consumption of the alcohol must have taken place. In the result I am unable to accept the evidence given\hich\f0 \emdash \loch\f0 
which was in any event evidence of opinion only \hich\f0 \emdash \loch\f0 even upon a \hich\af0\dbch\af31505\loch\f0 b\hich\af0\dbch\af31505\loch\f0 
alance of probabilities and even without taking into account the sworn evidence of the Respondent to the contrary, as establishing the fact found by the learned trial Judge, namely that the Respondent had consumed alcohol within the previous twelve hours.
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 It is possible that he had done so. It is equally possible that he had not; and as the onus }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid11356048 \hich\af0\dbch\af31505\loch\f0 
of proof lay upon the Appellant. }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0 I am firmly of opinion that the Judge'}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid11356048

k that in accordance with the principles laid down by the cases I have cited, it is the duty of this Court to substitute its own inference from the evidence given before the trial Judge, and to find that the falsity of the statement complained of had not

the end of the policy relieving the Appellant of liability in the event of the untruth of any statement made in writing by the insured for the purposes of the policy, yet this was not pleaded and was never made an issue at the trial. At the hearing in the

Court below, Counsel for the Appellant Company expressly stated that the only issues raised by the defence were (a) the pre-accident value of the vehicle and (b) whether the policy was void as the result of a false statement made in support of a claim und

r. If the Company wished to insist on the use of what they call "Accident Report Form" for the making of a formal claim under the policy, then it would have been easy for the Company to make this clear to the insured; to inform him that although it was on
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 the face of it merely a report of an accident, it would be treated also as a claim under the policy; and to}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10096208 
\hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0 
indicate to him beyond the possibility of mistake that any incorrect statement made in answer to a question in the form, whether such incorrect stat\hich\af0\dbch\af31505\loch\f0 ement was deliberately false}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0

\hich\af0\dbch\af31505\loch\f0  the truth of each and every such statement would be a condition precedent to the Company's liability. As I understand the law, it would not matter whether the inaccurate statement was made fraudulently}{\rtlch\fcs1 
\af0\afs24 \ltrch\fcs0 \fs24\insrsid10096208 \hich\af0\dbch\af31505\loch\f0  }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0 or innocently; or whether the untrue statement was of
\hich\af0\dbch\af31505\loch\f0  any materiality whatsoever. There is thus a very heavy burden cast on the insured party to ensure the strict accuracy of all statements made in support of a claim. The "Accident Repor}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0

aim would be to place a very heavy onus on the insured personally, whether the form was completed by him or by his legal representative; and I would not be prepared to hold that such a document is a claim against the Company unless the document itself mak
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 s that unequivocally clear. In my view the "Accident Report Form" is a report of an accid}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10096208 \hich\af0\dbch\af31505\loch\f0 
ent and nothing more, and state}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183\charrsid10098183 \hich\af0\dbch\af31505\loch\f0 
ments made in the course of that accident report are not "declarations or statements made in support of any claim under the policy".}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid10098183

he Insurance Company all such proofs and information with respect to any claim as might reasonably be required. The insured was repeatedly asked for information regarding his bank accounts; but by what MacKinnon L.J. refers to as "his stupid obstinacy ove
\hich\af0\dbch\af31505\loch\f0 r\hich\af0\dbch\af31505\loch\f0  an immaterial matter" he refused to supply the information when required. I am unable to draw any inference from the decision in Welch's case impelling me}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0

he statements may be regarded as made in support of a claim many more are not. He concludes that the incorrect answer to which exception is taken by the Appellant is not a declaration or statement in support of a claim, as a correct answer to that questio
