 whole case has been argued on the basis that the Defendant has conceded that the deceased's adult next of kin was his father and it is on that agreed basis I shall proceed since this point does not affect the essential merits of the case.

 renunciation by an executor and by a person entitled to administer the estate of an intestate, but I do not think, in view of the specific wording of Section 3\hich\af0\dbch\af31505\loch\f0 
(1), that the requirements of the renunciation referred to therein can be materially different \hich\af0\dbch\af31505\loch\f0 from those required of an executor. In the case of }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \i\fs24\insrsid8944574\charrsid10564647

 held that a renunciation even by letter was too late in the particular circumstances of that case and insufficient in form. He held that a renunciation was ineffective until it had been recorded in Court. It has als\hich\af0\dbch\af31505\loch\f0 
o been long established that a renunciation is only effective from the date it is actually filed in Court. I am of the opinion, therefore, that the deceased's father could not and did not effectively renounce orally in favour of the District Administrator

\par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8944574\charrsid10564647 \hich\af0\dbch\af31505\loch\f0 I would add that I have considered the submission on the part of the Plaintiff that since Section 3\hich\af0\dbch\af31505\loch\f0 
(2) of the Administration of Estates Ordinance specifically provides that renunciation under that section must be in writing on one of the forms set out i\hich\af0\dbch\af31505\loch\f0 
n the First Schedule to the Ordinance whereas no such provision is made or referred to in Section 3\hich\af0\dbch\af31505\loch\f0 (1), it ought to be presumed that a renunciation under Section 3(1) can properly be ef}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid7284578\charrsid10564647 \hich\af0\dbch\af31505\loch\f0 fected either orally or in writ}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8944574\charrsid10564647 \hich\af0\dbch\af31505\loch\f0 ing. I do not accept this view although
\hich\af0\dbch\af31505\loch\f0  I do appreciate its apparent logic. I do not accept it for this reason.
\par }{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid7284578\charrsid10564647

(2) requires a renunciation to be made in one of the forms contained in the First Schedule to the Ordinance. A study of the three forms set out in this schedule with the pro\hich\af0\dbch\af31505\loch\f0 
visions of Section 3(2) which only covers the case when a deceased has died after making a will, makes it abundantly clear that the third form cannot properly be applied to any of the circumstances that can possibly arise under Section 3(2). Form 3 in thi
\hich\af0\dbch\af31505\loch\f0 s\hich\af0\dbch\af31505\loch\f0 
 schedule can only possibly be applicable if the deceased died intestate and it is only Section 3(1) that applies in cases of intestacy. It appears to me, therefore, that despite the absence of any sp}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 
\fs24\insrsid10034803\charrsid10564647 \hich\af0\dbch\af31505\loch\f0 ecific requirement in Section 3}{\rtlch\fcs1 \af0\afs24 \ltrch\fcs0 \fs24\insrsid8944574\charrsid10564647 \hich\af0\dbch\af31505\loch\f0 (1) that a renunciation s

In this case the deceased's father executed a renunciation in writing on 10th September, 1962, i.e. long after the writ was issued in this action and on the very day the ac\hich\af0\dbch\af31505\loch\f0

ces it is clear that in this case the Plaintiff had no right or authority to issue the writ in this case as he did on 6th June, 1962, or at any time before 10th September, 1962.

\par \hich\af0\dbch\af31505\loch\f0 The claim under the Compensation to Relatives Ordinance, Cap. 20, should have been brought by and in the names of the deceased's parents in the absence of the appointment of any administ\hich\af0\dbch\af31505\loch\f0 
rator and the claim under the Law Reform (Miscellaneous Provisions) (Death and Interest) Ordinance, Cap. 17, should have been brought by and in the name of the deceased's father. As I understand it, the Court is being asked to substitute now those names f
\hich\af0\dbch\af31505\loch\f0 o\hich\af0\dbch\af31505\loch\f0 
r the name of the present Plaintiff. One of the difficulties about this course is that the Plaintiff claims that the deceased's father has in fact now properly renounced in favour of the District Administrator and the deceased's parents are not now entitl
\hich\af0\dbch\af31505\loch\f0 e\hich\af0\dbch\af31505\loch\f0 d to bring an action in their own names.

ministrator bringing this action, the deceased's father gained the benefit of not being put to the expense of taking out Letters of Administration himself and avoiding all liability for costs should his action fail. Because he did this and fail

ed properly to authorise the District Administrator to act for the estate the action is incompetent. This is undoubtedly most unfortunate since, on the evidence before me, I would have had no hesitation in holding that the Defendant was negligent and that
\hich\af0\dbch\af31505\loch\f0  \hich\af0\dbch\af31505\loch\f0 
the Plaintiff was entitled to succeed in his claim to damages for negligence. I do not, however, see how I can, in the face of the authorities on the point, properly at this stage regularise or rectify the incompetence of this action.
